SCTM#1000-9-8-3.2 Docko, Inc. on behalf of HIRAM MOODY, JR. requests a Wetland Permit to construct a 4' wide pile and timber pier and install, an 8'X 20' floating dock with hinged ramp and associated float restraint piles, boat berthing tie-off piles, utilities and ladder. The overall length of the pier from the shore waterward of the high tide line and tidal wetlands vegetation is 120'. Located: 33 Reservoir Rd., Fishers Island. SCTM#9-8-3.2 The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this deparlrnent, as well as the records available to me, it is my recommendation that the proposed action is CONSISTENT with the Policy Standards and therefore is CONSISTENT with the LWRP provided that the Board considers the following: 1. Verify that the 35' wide x 32' ramp is of sufficient height to achieve a minimum of fifty percent (50%) incoming solar radiation to the water surface. 2. Vedfy the water depths at the dock terminus. Water depths have not been indicated. In the event that the action is approved the following BMP is required pursuant to: § 275-11. Construction and operation standards. A. General. The following standards are required for all operations within the jurisdiction of the Trustees: (2) Erosion control. Installation of an erosion control structure is necessary during any building, grading, landscaping or site work activity within Trustee jurisdiction. This structure may include, but is not limited to, installation of a silt fence, hay bales, wood chip berm and silt booms. The placement of the erosion control structure(s) shall be determined by the Trustees or their designee. All intertidal construction and excavation requires the installation of a silt boom that will retain all suspended sediments within the immediate project Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its written determination 'regarding the consistency of the proposed action, Cc: Lod Hulse, Assistant Town Attorney T°w~n of Southold LWRP CONSISTENCY ASSESSMENT FORM A. INSTRUCTIONS All applicants for permits* including Town of Southold agencies, shall complete this CCAF for proposed actions that are subject to the Town of Southold Waterfront Consistency Review Law. This assessment is intended to supplement other information used by a Town of Southold agency in making a determination of consistency. *Except for minor exempt actions including Building Permits and other ministerial permits not located within the Coastal Erosion Hazard Area~ Before answering the questions in Section C, the preparer of this form should review the exempt minor action list, policies and explanations of each policy contained in the Town of Southold Local Waterfront Revitalization Program. A proposed action will be evaluated as to its significant beneficial and adverse effects upon the coastal area (which includes all of Southold Town). If any question in Section C on this form is answered "yes" or "no", then the proposed action will affect the achievement of the LWRP policy standards and conditions contained in the consistency review law. Thus~ each answer must be explained in detail~ listing both supporting and non-suooortina facts. If an action cannot be certified as consistent with the LWRP policy standards and conditions, it shall not be undertaken. Provide all proposed Best Management Practices that will further each policy. Incomplete answers will require that the form be returned for completion. DEVELOPED COAST POLICY Policy 1. Foster a pattern of development in the Town of Southold that enhances community character, preserves open space, makes efficient use of infrastructure, makes beneficial use of a coastal location, and minimizes adverse effects of development. See LWRP Section III - Policies; Page 2 for evaluation criteria. ~X Yes __ No __ Not Applicable These dock modifications makes appropriate use of an existing waterfront site and complies with environmental design factors pnhllahed by the NYS DEC~ and the DOS Coastal Management Program~ Southold Local Law No. 6~ 2004 and the Southold LWRP. The pier will be built to a 4-foot deck height over the bottom sediments until pasnino_ tb,~ anoarent mean low water line. Rails will be 42 inches above the deck. There will be no impairment of waterflow~ navigation or public access. Policy 2. Protect and preserve historic and archaeological resources of the Town of Southold. Not Applicable The only portion of the proposed work visible to any extent is the construction of a wood timber and pile supported pier with a floating dock. The only land side visual access affected by this pro. iect is at the applicant's site the Ferry. District property across the cove and immediate neighbors in this small covet which is hinh terrain lined by trees. The facility will be more visible through the leafless trees, in fall~ winter~ and early spring from the road. The dock's site will be visible from the water only when directly north of the line of the cove. The size of pile's diameters are limited based on the Town of Southold design requirements. A pier for private recreational boating off residential property in an "adjacent area" is a compatible use. NATURAL COAST POLICIES Policy 4. Minimize loss of life, structures, and natural resources from flooding and erosion. See LWRP Section IH - Policies Pages 8 through 16 for evaluation criteria. Yes __ No X Not Applicable These proposed dock modifications will take place in Silver Eel Cove and is acknowledged to be in a flood-prone area~ there is wave exposure at this site. The pier extension will be designed to accommodate complete submersion and resist hydrostatic and hydrodynamic uplift pressures due to flooding. Policy 5. Protect and improve water quality and supply in the Town of Southold. See LWRP Section III - Policies Pages 16 through 21 for evaluation criteria. Protect and restore the quality and function of the Town of Southold ecosystems including Sioonificant Coastal Fish and Wildlife Habitats and wetlands. No __ Not Applicable This nroiect is consistent with this policy because it proposes the elevation of the pier extension at an acceptable height above the bottom sediments through which ad.|acent tidal wetlands vegetation may spread~ the dock site. The NYS DEC prepared a study showin~ that the proposed pressure-treated Southern Pine timber products construction materials are suitable for this type of pro. iect in this Iocation~ except for decking which will be of untreated woods or composite (or plastic) materials. The configuration shown on the drawings provides an optimum balance between acceptable design and access standards without depriving the wetlands vegetation the opportunity to spread. No emissions will be generated by the dock facility. Policy 8. Minimize environmental degradation in Town of Southold from solid waste and hazardous substances and wastes. The pressure-treated wood trimmings from the dock construction will be collected and disposed of in accordance with current regulations so as to minimize any harmful affect. PUBLIC COAST POLICIES Policy 9. Provide for public access to, and recreational use of, coastal waters, public lands, and public resources of the Town of Southold. See LWRP Section III - Policies; Pages 38 through 46 for evaluation criteria. __ Yes __ No X Not Applicable This project is being built emanating from private land. The public trust lands and waters constitutes the area between the mean high water line and mean low water line and the resources are from the high fide line~ out. These environmental resources are being protected by the suitable alignment and height design standards dictated by the NYS DEC. There is virtually no public use of the waterfront in this area and the reconstruction of the pier and landward extension above the apparent high water line are not likely to influence or change this fact. WORKING COAST POLICIES Policy 10. Protect Southold's water-dependent uses and promote siting of new water- dependent uses in suitable locations. See LWRP Section III - Policies; Pages 47 through 56 for evaluation criteria. This usage is defined as water- dependent in the LWRP. The pier will provide for recreational boating and boat transportation access to the Island or the mainland. The pier will provide access without adverse environmental impacts and while protecting existing habitat and limited resources. 4 Policy 11. Promote sustainable use of living marine resources in Long Island Sound the Peconic Estuary and Town waters. See LWRP Section III - Policies; Pages 57 through 62 for evaluation criteria. New Ramp, Pier and Float October 14, 2011 This photograph shows the shoreline habitat beneath the existing deck, there are no tidal wetlands vegetation at this site and really no vegetative growth of any kind. There are boulders along the shoreline and these boulder form toe protection for the bluff above and to the fight. The new deck structure will be several feet higher than this deck at the shoreline landing point to allow pedestrian access beneath. HIRAM MOODY JR. New Ramp, Pier and Float October 14, 2011 This photograph shows the end of the wood deck structure, which exists along the shoreline at the Moody property. This structure will be removed and replaced with the elevated pier as depicted in the application drawings. The pier will come ashore at this point and span the upper reaches of the intertidal zone with five feet of clearance to allow pedestrian access although such access has never been observed at this site.
