Docko, Inc. on behalf of LUCILLE BALCOM requests a Wetland Permit and Coastal Erosion
Permit to repair 142 If. of 6' wide pile and timber pier and boat lift waterward of the apparent
high water line. Located: Private Rd., Fishers Island. SCTM#4-4-15
The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the
Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy
Standards. Based upon the information provided on the LWRP Consistency Assessment
Form submitted to this department, as well as the records available to me, it is my
recommendation that the proposed action is CONSISTENT with the Policy Standards and
therefore is CONSISTENT with the LWRP.
Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in
preparing its wdtten determination regarding the consistency of the proposed action.

LWRP CONSISTENCY ASSESSMENT FORM
A. INSTRUCTIONS
1. All applicants for permits* including Town of Southold agencies, shall
complete this CCAF for proposed actions that are subject to the Town of
Southold Waterfront Consistency Review Law. This assessment is intended
to supplement other information used by a Town of Southold agency in ~
making a determination of consistency. *Except for minor exempt actions
including Building Permits and other ministerial permits not located within
the Coastal Erosion Hazard Area.
2. Before answering the questions in Section C, the preparer of this form should /
review the exempt minor action list, policies and explanations of each policyJ
contained in the Town of Southold Local Waterfront Revitalization Progran~.
A proposed action will be evaluated as to its si~.m~ificant beneficial and advise
effects upon the coastal area (which includes all of Southold Town). ~
3. If any question in Section C on this form is answered "yes" or "no'}/then the
proposed action will affect the achievement of the LWRP polic)/standards
and conditions contained in the consistency review law. Thus, grach answer
must be explained in detail, listing both suvoortino and n~/n-supportlno
facts. If an action cannot be certified as consistent with tl)~ LWRP policy
standards and conditions, it shall not be undertaken.

support of not support the policies. Provide all proposed Best Management Practices

DEVELOPED COAST POLICY
Policy 1. Foster a pattern of development in the Town of Southold that enhances
community character, preserves open space, makes efficient use of infrastructure, makes
beneficial use of a coastal location, and minimizes adverse effects of development. See
LWRP Section III - Policies; Page 2 for evaluation criteria.

The oier repair oroiect makes appropriate use of an existing waterfront site and complies with
environmental design factors published by the NYS DEC, and the DOS Coastal Management
Program, Southold Local Law No. 6, 2004 and the Southold LWRP. The pier will maintain a 4-
foot deck height over the bottom sediments until passing the apparent mean low water line.
Rails will be 42 inches above the deck. There will be no impairment of watefflow or navigatlc~n.

These proposed pier renairs will take place in East Harbor and is acknowledged to be in a flood
prone area; there is wave exposure at this site. The pier repairs will be designed to accommod,~..
complete submersion and resist hydrostatic and hydrodynamic uplift pressures duc to flooding.

This proiect is consistent with this policy because it proposes to maintain the elevation of the pier
extension at an acceptable height above the bottom sediments through which adjacent tidal
wetlands vegetation may spread. The dock site, however, is so rocky and so heavily shaded that
the tidal vegetation along the shoreline is minimal. No adverse impact on tidal or submerged
vegetation is anticipated as a result of the proposed project. In addition, the NYS DEC prepared a
study showing that the proposed pressure-treated Southern Pine timber products construction
materials are suitable for this type of project in this location, except for decking which will be of
untreated woods or composite (or plastic) materials.

usage is del'reed as water-dependent in the LWRP because the pier extension will for recreational
boating and provide boat transportation access to the mainland. The pier to shore is to provide
