En-Consultants on behalf of ERIC KLODNICKI requests an Administrative Permit to remove the
existing sanitary system located less than 100' from wetlands (in favor of an upgraded system to be
located more than 100' from wetlands); construct a pervious gravel driveway extension; replace portion
of existing asphalt driveway/parking area with pervious gravel; and install fencing to enclose proposed
swimming pool located more than 100' from wetlands. Located: 165 Sailor's Needle Rd., Mattituck.

The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of
Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards.
Based upon the information provided on the LWRP Consistency Assessment Form submitted to this
department, as well as the records available to me, it is my recommendation that the proposed action is
CONSISTENT with the Policy Standards and therefore is CONSISTENT with the LWRP provided that
that the Board considers the following additional best management practice:
To further Policy 5: Protect and Improve Water Quality in the Town of Southold and Policy 6; Protect
and Restore the Quality and Function of the Town of Southold Ecosystem.
If the action is approved, it is recommended that the existinq ve,qetat on (east of concrete wall
and frame qareqe and adiacent to James Creek) be incorporated and preserved as a perpetual
non-disturbance buffer.
Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its
written determination regarding the consistency of the proposed action.

LWRP CONSISTENCY ASSESSMENT FORM
A. INSTRUCTIONS
I. All applicants for permits* including Town of Southold agencies, shall complete this CCAF for
proposed actions that are subject to the Town of Southold Waterfront Consistency Review Law. This
assessment is intended to supplement other information used by a Town of Southold agency in
making a determination of consistency. *Except minor exempt actions including Building Permits
and other ministerial permits not located within the Coastal Erosion Hazard drea.
2. Before answering the questions in Section C, the preparer of this form should review the exempt
minor action list, policies and explanations of each policy contained in the Town of Southold Local
Waterfront Revitalization Program. A proposed action will be evaluated as to its significant
beneficial and adverse effects upon the coastal area (which includes all of Southold Town).
If any question in Section C on this form is answered "yes" or "no", then the proposed action will
affect the achievement of the LWRP policy standards and conditions contained in the consistency
review law. Thus, each answer must be explained in detail, listing both supporting and non-
supporting facts. If an action cannot be certified as consistent with the LWRP policy standards and
conditions, it shall not be undertaken.

The removal of the existing sanitary system located less than 75' from wetlands in favor of an upgraded system located almost 150' from
wetlands and out of Chapter 275 jurisdiction will improve the quality of groundwater adjacent to James Creek and ultimately the quality
of the James Creek surface waters and thus the quality and function of the tidal wetlands and James Creek ecosystems, making this
project component consistent with both Policies 5 end 6. The proposed pervious gravel driveway extension located no closer than 50
feet from wetlands is defined by Section 268-3 as a "minor action" not subject to water consistency review (i.e., "DD. Construction or
improvements of pervious residential driveways, parking areas or walkways greater than 50 feet from a tidal or freshwater wetland.");
end the conversion of the existing asphalt driveway to pervious gravel within 50' of wetlands will have beneficial impacts on water
quality and the adjacent wetlands ecosystem due to the associated decrease in surface water runoff, thus making this project component
also consistent with Policies 5 & 6.
