Suffolk Environmental Consulting, Inc. on behalf of BREWER STERLING HARBOR requests
a Wetland Permit to replace various floating dockage; replace two (2) sections of existing
timber sheathed bulkheading along the northwestern section of the marina with vinyl/fiberglass
sheathed bulkheading; and demolish the extant metal boat storage building and attached
plastic building along with the extant frame building and attached trailer and replace them with
a new one-story 9,000 sf. metal boat storage building and attached two-story 2,500 sf. office
building/storage building. Located: 1410 Manhaset Ave, Greenport. SCTM#36-1-1
The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the
Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy
Standards. Based upon the information provided on the LWRP Consistency Assessment
Form submitted to this department, as well as the records available to me, it is my
recommendation that the proposed action is CONSISTENT with the Policy Standards and
therefore is CONSISTENT with the LWRP provided the following best management practice is
required pursuant to:
§ 275-11. Construction and operation standards.
A. General. The following standards are required for all operations within the jurisdiction of
the Trustees:

Erosion control. Installation of an erosion control structure is necessary dudng any
building, grading, landscaping or site work activity within Trustee jurisdiction. This
structure may include, but is not limited to, installation of a silt fence, hay bales,
wood chip berm and silt booms. The placement of the erosion control structure(s)
shall be determined by the Trustees or their designee. All intertidal construction
and excavation requires the installation of a silt boom that will retain all
suspended sediments within the immediate proiect area.
Require that the proposed actions comply with Chapter 236 Stormwater Management of the
Southold Town Code.
Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in
preparing its written determination regarding the consistency of the proposed action.

A. INSTRUCTIONS
All applicants for permits* including Town of Southold agencies, shall complete this CCAF for
proposed actions that are subject to the Town of Southold Waterfront Consistency Review Law. This
assessment is intended to supplement other information used by a Town of Southold agency in
making a determination of consistency. *Except minor exempt actions including Building Permits
and other ministerial permits not located within the Coastal Erosion Hazard Area.
Before answering the questions in Section C, the preparer of this form should review the exempt
minor action list, policies and explanations of each policy contained in the Town of Southold Local
Waterfront Revitalization Program. A proposed action will be evaluated as to its significant
beneficial and adverse effects upon the coastal area (which includes all of Southold Town).
If any question in Section C on this form is answered "yes", then the proposed action may affect the
achievement of the LWRP policy standards and conditions contained in the consistency review law.
Thus, the action should be analyzed in more detail and, if necessary, modified prior to making a
determination that it is consistent to the maximum extent practicable with the LWRP policy
standards and conditions. If an action cannot be certified as consistent with the LWRP policy
standards and conditions, it shall not be undertaken.

With respect to the proposed demolition of the Metal/Plastic Buildings & Frame BuildingfFrailer:
As indicated within Policy 1, "Development that does not reinforce the traditional land use pattern of the Town of
Southold would result in a loss of the community and landscape character of Southold.% this project is a proposal to
remove various structures and construct a new building that would equate the same square footage afforded by
the original buildings, effectively consolidating these structures. The proposal, as designed, will not result in
adverse effects to the surrounding environment in that the project will not increase the structural coverage of the
property, and will not encroach any further towards the surface waters of Sterling Creek along the western
shoreline. In addition, this commercial marina has existed harmoniously within this location for decades which has
not resulted in any form of adverse impact to the surrounding environment. Accordingly, we believe that this
project is consistent with this policy.
With respect to the proposed reconstruction of the proposed bulkhead and dockage:
Subject proposal is consistent with the policy in that the siting/utilization of the reconstructed dock assembly
and siting/utilization of the proposed reconstructed/reconfigured bulkhead will maintain the character of the
surrounding area, which currently consists of other commercial marinas as well as many residential lots with similar
structures (i.e. dock assemblies and bulkheading along Sterling Creek). In addition, subject proposal will be in
harmony with the "... beneficial use of a coastal location..." in that this lawfully created & operated Commercial
Marina will be enhanced by the reconstructed dock assembly and bulkheading. Accordingly, we believe that this
project is consistent with this policy.

Subject proposal will not adversely impact the visual quality of the surrounding area in that the existing properg/
has operated as a commercial marina for many years without any evidence of resulting in adverse impacts to the
neighborhood. In addition~ the neighborhood itself is comprised of commercial marinas, also operating for many
years which apparently have not resulted in any form of adverse impacts to the surrounding area.
With respect to the proposed reconstruction of the proposed bulkhead and dockage:
Subject proposal will not adversely impact the visual quality of the surrounding area in that the surrounding
area is currently comprised of marinas and residential properties improved with similar appurtenances (i.e. dock
assemblies and bulkheads). Scenic resources, assumedly views of Sterling Creek, are not at risk due to the
reconstructed dock assembly and bulkheading being typical of the character of this section of waterfront.
Accordingly, this proposal will comply with Policy 3.

Subject proposal will fully comply with Policy 4 in that the reconstructed bulkheading & dock assembly is designed
to be comparable in design and scope as that of the surrounding bulkheading and dock assemblies, which have
