SEQR Negative Declaration Page Two April 12, 2010 This site plan is for the construction of a 6,244 sq. ft. second winery building on a previously developed and approved 50.4-acre parcel in the Agricultural Conservation Zoning District. The site is not located within a Critical Environmental Area as designated pursuant to subdivision 617.14(g). The property is currently improved with a 7,404 sq. ft. winery building with pervious parking areas around the building in connection with the use. The remainder of the parcel is active agriculture comprised of existing vines immediately adjacent to State Route 25 east, west and southern portion of the property. No substantial adverse change in existing air quality, ground or surface water quality or quantity, traffic or noise level will occur as a result of the proposed action. The property is improved. While the proposed use will cause an increased intensity over the current use, the proposed action will not cause a substantial intensification of use. Correspondingly the proposed action will not cause significant impacts to agricultural, open space or recreational resources. Potential impacts from the commercial use (noise) to residential uses to the east, west and south is proposed to be mitigated by hours of operation and distances from property lines. The proposed use a retail winery, will be closed before 6 p.m. and exceed zoning setback requirements. The proposed building will be located at its closest point approximately 223 feet from any property line having rows of grape vines in between. All exterior lighting proposed is dark sky compliant (full cut-off fixture) and will be shielded as to not illuminate adjacent properties. Further, no major change in the use of either the quantity or type of energy will occur or a known creation of a hazard to human health is expected to occur as a result of the proposed action. The 50.4 acre site is farmed and partially cleared, therefore, the proposed action will not result in the significant removal or destruction of large quantities of vegetation, substantial interference with the movement of any resident or migratory fish or wildlife sp,ecies, significant habitat area or result in adverse impacts to a threatened or endangered species or the habitat of such a species. The proposed action is located on a parcel that was previously reviewed and approved by the Planning Board.
