The dock will intrude less than 22% into the waterway at low tide; will not traverse any vegetated marsh; and will be constructed with untreated decking, thus minimizing or preventing any physical loss, degradation, or functional loss of ecological components or fragmentation of ecological communities. The dock will intrude less than 22% into the waterway at low tide; will not traverse any vegetated marsh; and will be constructed with untreated decking, thus minimizing or preventing any physical loss, degradation, or functional loss of ecological components or fxagmentation of ecological communities. Therefore, the project will be consistent with Policy 6, and the statutory and regulatory requirements of the New York State Tidal Wetlands Act and Chapter 275 of the Town Code.
