The following action was taken by the Southold Town Board of Trustees at their Regular
Meeting held on Wednesday, October 22, 2014:
WHEREAS, En -Consultants on behalf of BARBARA STROKOFF applied to the
Southold Town Trustees for an Amendment to Wetland Permit #7895 under the
provisions of Chapter 275 of the Southold Town Code, the Wetland Ordinance of the
Town of Southold, application dated September 26, 2014, and,
WHEREAS, said application was referred to the Southold Town Conservation Advisory
Council and to the Local Waterfront Revitalization Program Coordinator for their findings
and recommendations, and,
WHEREAS, the LWRP Coordinator issued a recommendation that the application be
found to be Consistent with the Local Waterfront. Revitalization Program policy
standards, and,
WHEREAS, the structure complies with the standards set forth in Chapter 275 of the
Southold Town Code,
WHEREAS, the Board has determined that the project as proposed will not affect the
health, safety and general welfare of the people of the town,
NOW THEREFORE BE IT,
RESOLVED, that the Southold Town Board of Trustees APPROVE the Amendment to
Permit #7895 to install a 3'x14' ramp to a 5'x20' float secured by (2) 8" diameter pilings
inside the boat basin; and as depicted on the site plan prepared by En -Consultants, last
dated September 25, 2014, and stamped approved on October 22, 2014.
Fees must be paid, if applicable, and permit issued within six months of the date of this
notification.
Inspections are required at a fee of $50.00 per inspection. (See attached schedule.)

The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the
Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy
Standards. Based upon the information provided on the LWRP Consistency Assessment Form
submitted to this department, as well as the records available to me, it is my recommendation that
the proposed actions are CONSISTENT with the Policy Standards and therefore are CONSISTENT
with the LWRP.
Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its
written determination regarding the consistency of the proposed action.

Rather than adding a ramp and floating d4bo the seaward end of an existing fixed walW&hich would have extended seaward of
the existing boat basin and the homeowner's property, the existing boat basin was proposed to be repaired and dredged to restore
sufficient water depth for boat dockage inside the basin. However, as age and health are making it increasingly difficult for the owners
to access their boat from the top of the basin bulkheading, a seasonal ramp and float are proposed entirely within the confines of the boat
basin and owner's property to allow for improved access. Installation of a ramp & float inside a boat basin is conforming throughout the
Town of Southold and will not create any impacts on the quality or function of the surrounding ecosystem but will remain a preferable
alternative to adding a ramp and float outside the basin and into Petty's Pond.

WITNESSETH:
WHEREAS, DECLARANT is the owner of certain real property located on Arshamomaque Avenue,
Town of Southold, County of Suffolk, State of New York, described in the Suffolk County Tax Map as District
1000, Section 66, Block 3, Lot 8, which is more particularly bounded and described as set forth in Schedule "A"
annexed hereto, hereinafter referred to as the Property;
WHEREAS, the Property is situated on lands within the jurisdiction of the Board of Trustees of the
Town of Southold (hereinafter the "Trustees") pursuant to Chapter 275 of the Town Code of the Town of
Southold or its successor, and various activities conducted upon the property may thus be subject to the
regulation and approval of the Trustees prior to being conducted;
WHEREAS, the DECLARANT therefore made application to the Trustees for a permit pursuant to the
Wetlands Law of the Town of Southold to undertake certain regulated activities; and
WHEREAS, as a condition of the granting of a Wetlands Permit to undertake such regulated activities,
the Trustees required that a ten -foot wide "nonturf buffer" be established along the landward edge of the
bulkhead,
NOW, THEREFORE, the DECLARANT does hereby covenant and agree as follows:
1) Upon the substantial completion of the aforementioned permitted activities there shall be
established and subsequently maintained along the landward edge of the bulkhead on the subject
premises a ten -foot wide "nonturf buffer" as defined by Chapter 275 of the Town Code; and

Pursuant to the provisions of Chapter 275 of the Town Code of the Town of Southold and in
accordance with the Resolution of the Board of Trustees adopted at the meeting held on August 22, 2012, and
in consideration of application fee in the sum of $250.00 paid by En -Consultants and subject to the Terms and
Conditions as stated in the Resolution, the Southold Town Board of Trustees authorizes and permits the
following:
Wetland Permit to construct approximately 140 If. of vinyl bulkhead in place of
existing timber bulkhead; remove and replace (in-place) existing +/-4'x31' timber
walkway/catwalk; existing 10' return to be removed and replaced inside property line
with a return up to 15' in length; incidentally dredge inside boat basin to a depth of 4'
MLW and use approximately 25 cy. sand/silt as backfill; a 10' wide non -turf buffer to
be established and subsequently maintained along the landward edge of the bulkhead;
and as depicted on the site plan prepared by En -Consultants, last dated September 19,
2012 and stamped approved on September 21, 2012.
IN WITNESS WHEREOF, the said Board of Trustees hereby causes its Corporate Seal to be affixed,
and these presents to be subscribed by a majority of the said Board as of this date.

TERMS AND CONDITIONS
The Permittee Barbara Strokoff residing at 1345 Arshamomaque Ave., Southold, New York as
part of the consideration for the issuance of the Permit does understand and prescribe to the
following:
That the said Board of Trustees and the Town of Southold are released from any and all
damages, or claims for damages, of suits arising directly or indirectly as a result of any
operation performed pursuant to this permit, and the said Permittee will, at his or her own
expense, defend any and all such suits initiated by third parties, and the said Permittee
assumes full liability with respect thereto, to the complete exclusion of the Board of
Trustees of the Town of Southold.
2. That this Permit is valid for a period of 24 months, which is considered to be the estimated
time required to complete the work involved, but should circumstances warrant, request for
an extension may be made to the Board at a later date.
3. That this Permit should be retained indefinitely, or as long as the said Permittee wishes to
maintain the structure or project involved, to provide evidence to anyone concerned that
authorization was originally obtained.
4. That the work involved will be subject to the inspection and approval of the Board or its
agents, and non-compliance with the provisions of the originating application may be cause
for revocation of this Permit by resolution of the said Board.
5. That there will be no unreasonable interference with navigation as a result of the work
herein authorized.
6. That there shall be no interference with the right of the public to pass and repass along the
beach between high and low water marks.
7. That if future operations of the Town of Southold require the removal and/or alterations in
the location of the work herein authorized, or if, in the opinion of the Board of Trustees,
the work shall cause unreasonable obstruction to free navigation, the said Permittee will be
required, upon due notice, to remove or alter this work project herein stated without
expenses to the Town of Southold.
8. The Permittee is required to provide evidence that a copy of this Trustee permit has been
recorded with the Suffolk County Clerk's Office as a notice covenant and deed restriction
to the deed of the subject parcel. Such evidence shall be provided within ninety (90)
calendar days of issuance of this permit.
9. That the said Board will be notified by the Permittee of the completion of the work
authorized.
10. That the Permittee will obtain all other permits and consents that may be required
supplemental to this permit, which may be subject to revoke upon failure to obtain same.

The Board of Town Trustees took the following action during its regular meeting held on
Wednesday, August 22, 2012 regarding the above matter:
WHEREAS, En -Consultants on behalf of BARBARA STROKOFF applied to the
Southold Town Trustees for a permit under the provisions of Chapter 275 of the
Southold Town Code, the Wetland Ordinance of the Town of Southold, application
dated July 27, 2012, and,
WHEREAS, said application was referred to the Southold Town Conservation Advisory
Council and to the Local Waterfront Revitalization Program Coordinator for their findings
and recommendations, and,
WHEREAS, the LWRP Coordinator issued a recommendation that the application be
found Consistent with the Local Waterfront Revitalization Program policy standards,
and,
WHEREAS, a Public Hearing was held by the Town Trustees with respect to said
application on August 22, 2012, at which time all interested persons were given an
opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are familiar with the
premises in question and the surrounding area, and,

WHEREAS, the Board has considered all the testimony and documentation submitted
concerning this application, and,
WHEREAS, the structure complies with the standards set forth in Chapter 275 of the
Southold Town Code,
WHEREAS, the Board has determined that the project as proposed will not affect the
health, safety and general welfare of the people of the town,
NOW THEREFORE BE IT,
RESOLVED, that the Board of Trustees have found the application to be Consistent
with the Local Waterfront Revitalization Program, and,
RESOLVED, that the Board of Trustees approve the application of BARBARA

At the meeting of the Southold Town Conservation Advisory Council held Wed., August
15, 2012 the following recommendation was made:
Moved by John Stein, seconded by Doug Hardy, it was
RESOLVED to SUPPORT the Wetland Permit application of BARBARA STROKOFF to
construct approx. 140 If. of vinyl bulkhead in place of existing timber bulkhead; remove
and replace (in-place) existing 4'X 31' timber walkway/catwalk; incidentally dredge inside
boat basin to a depth of -4' MLW and use approx. 25 cy. sand/silt as backfill.

The CAC Supports the application with the Condition of a 15' non -turf vegetated buffer
and the chicken -wire fence is removed. The CAC questions the location of the dredge
spoil site.

The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of
Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards.
Based upon the information provided on the LWRP Consistency Assessment Form submitted to this
department, as well as the records available to me, it is my recommendation that the proposed action is
CONSISTENT with the Policy Standards and therefore is CONSISTENT with the LWRP.
It is recommended that the proposed 10' wide non- turf buffer be vegetated with native species.
Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its
written determination regarding the consistency of the proposed action.

Approximately 25 cubic yards sand/silt spoil will be incidentally dredged from inside boat basin via excavator and used
as backfill landward of recontmcted bulkheads.
Statement of the effect, if any, on the wetlands and tidal waters of the town that may result by
reason of such proposed operations (use attachments if appropriate):
The project consists of the maintenance of existing erosion control structures and a boat basin and catwalk for boat
through the in-place replacement of the bulkheading with a bulkhead constructed with vinyl sheathing; the in-place replacement of
the existing catwalk, including the replacement of its treated timber decking with untreated decking; and the dredging of the inside
of the boat basin. Therefore the project will effectively maintain the historically established use and site conditions with the benefit
of replacing treated materials with untreated materials. The project will be further mitigated by using a silt curtain to contain
temporarily produced turbidity during the dredging activities and will establish a 10' wide nonturf buffer landward of the
reconstructed bulkbeading. Therefore, the project will result in a net beneficial impact to the existing site conditions. It is also
worth noting that the project has been designed in accordance with the written recommendations of the Trustees contained in a
Field Inspection Report dated 10/13/10, a copy of which is attached hereto.

proposed actions that are subject to the Town of Southold Waterfront Consistency Review Law. This
assessment is intended to supplement other information used by a Town of Southold agency in
making a determination of consistency. *Except minor exempt actions including Building Permits
and other ministerial permits not located within the Coastal Erosion Hazard Area.

sand/silt as backfill, all as depicted on the project plan prepared by En -Consultants, dated July 17, 2012.

definitions of minor actions contained in Chapter 268-3, specifically "B" and "GG", respectively. As the proposed work also includes

The project consists of the maintenance Misting erosion control structures and a boat bassi Cand catwalk for boat dockage through the
in-place replacement of the bulkheading with a bulkhead constructed with vinyl sheathing; the in-place replacement of the existing
catwalk, including the replacement of its treated timber decking with untreated decking; and the dredging of the inside of the boat basin.
Therefore the project will effectively maintain the historically established use and site conditions with the benefit of replacing treated
materials with untreated materials. The project will be further mitigated by using a silt curtain to contain temporarily produced turbidity
during the dredging activities and will establish a 10' wide nonturf buffer landward of the reconstructed bulkheading. Therefore, the
project will result in a net beneficial impact to the existing site conditions. It is also worth noting that the project has been designed in
accordance with the written recommendations of the Trustees contained in a Field Inspection Report dated 10/13/10, a copy of which is
attached hereto.
