Would you mind clarifying my questions in RED next to your comments? We are trying to get this done as quickly as possible. According to the stamped plans of 9/7/14: There were to be (2)two planting areas which are missing; One of the drywells is not in the correct location; Driveway alongside the west side and in the rear of building is not shown on this plan; --We didn't create one--it just became a path because of the work and materials that were brought from front to back of property. However, We would like to keep it there. 20x20 raised deck on seaward side of building was not part of approved permit; (you will need to apply as-built for an amendment to your permit for deck) There is no path through the non-disturbance zone; Ok. Can we do this at a later date? Is this the path to the water line? Non-disturbance zone is not clearly delineated (can be delineated by a split-rail fence).--How high does the split rail fence this need to be? I looked up split rail fences and they are about 2 feet high Is there a min or max height? Any other measurements required? Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposed action is INCONSISTENT with LWRP Policies 4.1 and therefore, INCONSISTENT with the LWRP. 4A Minimize losses of human life and structures from flooding and erosion hazards. A. Minimize potential loss and damage by locating development and structures away from flooding and erosion hazards 3. Move existing development and structures as far away from flooding and erosion hazards as practical. Maintaining existing development and structures in hazard areas may be warranted for: a. structures which functionally require a location on the coast or in coastal waters. b. water -dependent uses which cannot avoid exposure to hazards. C. sites in areas with extensive public investment, public infrastructure, or major public facilities. CJ d. sites where relocation of an existing structure is not practical The proposed action does not meet the above criteria. The structure is located within the FEMA AO Flood Zone (Note that the map references AE el 10). The AO Flood Zone is subject to 100 -year shallow flooding (usually sheet flow on sloping terrain) with average depth of 1-3 feet. Base flood elevation is undetermined. Policy 6. Protect and restore the quality and function of the Town of Southold's ecosystem. I approved, it is recommended that the structure be re -located to higher elevations (closer to C.R. 48) and increase the setback to the freshwater wetlands to further Policy 4.1 and Policy 6. The required front yard setback from C. R. 48 is 50'. The proposed front yard setback is 115.8' and there is the ability to relocate the structure increasing the setback to the wetland. Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action. Box 1179 Southold, New York 11971-0959 Telephone (631) 765-1892 Fax (631) 765-6641 The Board of Town Trustees took the following action during its regular meeting held on Wednesday, August 22, 2012 regarding the above matter: WHEREAS, DROUZAS REAL ESTATE DEVELOPMENT CORP. applied to the Southold Town Trustees for a permit under the provisions of Chapter 275 of the Southold Town Code, the Wetland Ordinance of the Town of Southold, application dated July 2, 2012, and, WHEREAS, said application was referred to the Southold Town Conservation Advisory Council and to the Local Waterfront Revitalization Program Coordinator for their findings and recommendations, and, WHEREAS, the LWRP Coordinator recommended that the proposed application be found Inconsistent with the LWRP, and, WHEREAS, the Board of Trustees has furthered Policies 6 & 6.3 of the Local Waterfront Revitalization Program to the greatest extent possible through the imposition of the following Best Management Practice requirements: the installation of gutters to leaders to drywells, and in accordance with Chapter 236-Stormwater Management of the Town Code; a placement of a line of staked hay bales and silt fencing along the 6' contour line prior to all construction activities and maintained until completion of the construction project; and the entire area seaward of the 6' contour line is to remain as a Non - Disturbance Buffer area: and 0 WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on August 22, 2012, at which time all interested persons were given an opportunity to be heard, and, WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounding area, and, WHEREAS, the Board has considered all the testimony and documentation submitted concerning this application, and, WHEREAS, the structure complies with the standards set forth in Chapter 275 of the Southold Town Code, WHEREAS, the Board has determined that the project as proposed will not affect the health, safety and general welfare of the people of the town, NOW THEREFORE BE IT, RESOLVED, that for the mitigating factors and based upon the Best Management Practice requirement imposed above, the Board of Trustees deems the action to be Consistent with the Local Waterfront Revitalization Program pursuant to Chapter 268-5 of the Southold Town Code, and, RESOLVED, that the Board of Trustees approve the application of DROUZAS REAL ESTATE DEVELOPMENT CORP. to construct a single-family dwelling; bring in 148.3 cubic yards of fill along the southwest comer of the property; construct a retaining wall, driveway, balcony, terrace; and a 4' wide cleared path to the water; with the conditions of the installation of gutters to leaders to drywells, and in accordance with Chapter 236- Stormwater Management of the Town Code; a placement of a line of staked hay bales and silt fencing along the 6' contour line prior to all construction activities and maintained until completion of the construction project; and the entire area seaward of the 6' contour line is to remain as a Non -Disturbance Buffer area; and as depicted on the survey prepared by John C. Such survey and topographical map shall show the soundings of the area in which operations are proposed to be conducted. The horizontal control of said survey shall be based on an approved local coordinate system. The vertical control for elevations shall be based on the United States Coast and Geodetic Survey datum.
