DECLARATION made this ~[_ day of February, 2013, by LAZARUS

owner, hereinafter referred to as the Declarant.
WITNESSETH:
WHEREAS, the Declarant has title to certain land situate, lying and being at 2700
Sound Drive, Greenpod, Town of Southold, Suffolk County, New York, SCTM 1000-33-1-
11 said land being more particularly described in Schedule "A" which is attached hereto;
and
WHEREAS, the Property is situated in or adjacent to lands activities upon which are
regulated by the Town of Southold Board of Trustees pursuant to Chapter 275 of the Town
Code of the Town of Southold, as may be amended, and various activities conducted upon
the properly are subject Io the jurisdiction, regulation and approval or disapproval of the
Trustees prior to being conducted;
WHEREAS the Declarant has applied to the Town of Southold Board of Trustees
for a wetland permit to renovate existing house consisting of new windows, shingles and
roof; reconstruct rear second-floor deck, cut back "as built" deck from 16' to 10' and retain
8' section with proposed circular stairs from second-floor deck to rear of house: drainage
to conform to Chapter 236 of the Town code; gutters to leaders to drywells on dwelling new
access to basement under deck, as depicted on the survey prepared by Nathan Taft
Corwin III, Land Surveyor, lasted dated May 18, 2012, and stamped approved on August
22,2012 and also as depicted on the site plan prepared by Creative Environmental Design,
last dated September 14, 2012 and stamp approved on September 18, 2012.
WHEREAS, the Town of Southold Board of Trustees, as conditions for the issuance
of such Wetland Permit, required cedain covenants and restrictions be placed on the
property as shown on the aforesaid plans.
NOW, THEREFORE, this Declarant witnesseth:
That Declarant, for the purpose of carrying out the intentions expressed above does
hereby make known, admit, publish, covenant and agree that the said properly herein
described shall hereafter be subject to the following covenants which shall run with the land
and shall be binding on all purchasers and holders of said premises, their heirs,
successors, and assigns, to wit:

AUTHORIZATION
Pursuant to the provisions of Chapter 275 and/or Chapter 111 of the Town Code of the Town of
Southold and in accordance with the Resolution of the Board of Trustees adopted at the meeting held on August
22, 2012, and in consideration of application fee in the sum of $1,000.00 paid by Lazarus Alexandrou and
subject to the Terms and Conditions as stated in the Resolution, the Southold Town Board of Trustees
authorizes and permits the following:

roof; reconstruct rear second-floor deck, cut back "as built" deck from 16' to 10' and retain 8'
section with proposed circular stairs from second-floor deck to rear of house; drainage to

retaining walls, driveways and walkways in front yard; new basement windows and emergency
access to basement under deck; with the condition of establishing and subsequently

stamped approved on August 22, 2012, and also as depicted on the site plan prepared by

TERMS AND CONDITIONS
The Permittee Lazarus Alexandrou, residing at 2700 Sound Drive, Greenport, New York as
part of the consideration for the issuance of the Permit does understand and prescribe to the
following:
That the said Board of Trustees and the Town of Southold are released from any and all
damages, or claims for damages, of suits arising directly or indirectly as a result of any
operation performed pursuant to this permit, and the said Permittee will, at his or her own
expense, defend any and all such suits initiated by third parties, and the said Permittee
assumes full liability with respect thereto, to the complete exclusion of the Board of
Trustees of the Town of Southold.
That this Permit is valid for a period of 24 months, which is considered to be the estimated
time required to complete the work involved, but should circumstances warrant, request for
an extension may be made to the Board at a later date.
That this Permit should be retained indefinitely, or as long as the said Permittee wishes to
maintain the structure or project involved, to provide evidence to anyone concerned that
authorization was originally obtained.
That the work involved will be subject to the inspection and approval of the Board or its
agents, and non-compliance with the provisions of the originating application may be cause
for revocation of this Permit by resolution of the said Board.
That there will be no unreasonable interference with navigation as a result of the work
herein authorized.
That there shall be no interference with the right of the public to pass and repass along the
beach between high and low water marks.
That if future operations of the Town of Southold require the removal and/or alterations in
the location of the work herein authorized, or if, in the opinion of the Board of Trustees,
the work shall cause unreasonable obstruction to free navigation, the said Permittee will be
required, upon due notice, to remove or alter this work project herein stated without
expenses to the Town of Southold.
The Permittee is required to provide evidence that a copy of this Trustee permit has been
recorded with the Suffolk County Clerk's Office as a notice covenant and deed restriction
to the deed of the subject parcel. Such evidence shall be provided within ninety (90)
calendar days of issuance of this permit.
That the said Board will be notified by the Permittee of the completion of the work
authorized.
That the Pennittee will obtain all other permits and consents that may be required
supplemental to this permit, which may be subject to revoke upon failure to obtain same.

Dear Ms. Moore:
The Board of Town Trustees took the following action during its regular meeting held on
Wednesday, August 22, 2012 regarding the above matter:
WHEREAS, Patricia C. Moore, Esq. on behalf of LAZARUS ALEXANDROU applied to
the Southold Town Trustees for a permit under the previsions of Chapter 275 of the
Southold Town Code, the Wetland Ordinance of the Town of Southold, and Chapter 111
of the Southold Town Code, Coastal Erosion Hazard Areas, application dated June 20,
2012 and revised description on July 25, 2012, and,
WHEREAS, said application was referred to the Southold Town Conservation Advisory
Council and to the Local Waterfront Revitalization Program Coordinator for their findings
and recommendations, and,
WHEREAS, the LWRP Coordinator recommended that the proposed application be
found Inconsistent with the LWRP, and,
WHEREAS, the Board of Trustees has furthered Policy 6.3 of the Local Waterfront
Revitalization Program to the greatest extent possible through the imposition of the
following Best Management Practice requirements: establish and subsequently maintain
a 15' wide non-turf buffer along top of the bluff landward, and,
WHEREAS, a Public Hearing was held by the Town Trustees with respect to said
application on July 18, 2012 and again on August 22, 2012, at which time all interested
persons were given an opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are familiar with the
premises in question and the surrounding area, and,
WHEREAS, the Board has considered all the testimony and documentation submitted
concerning this application, and,
WHEREAS, the structure complies with the standards set forth in Chapter 275 and
Chapter 111 of the Southold Town Cede,
WHEREAS, the Board has determined that the project as proposed will not affect the
health, safety and general welfare of the people of the town,
NOW THEREFORE BE IT,
RESOLVED, that for the mitigating factors and based upon the Best Management
Practice requirement imposed above, the Board of Trustees deems the action to be
Consistent with the Local Waterfront Revitalization Program pursuant to Chapter 268-5
of the Southold Town Code, and,
RESOLVED, that the Board of Trustees approve the application of LAZARUS
ALEXANDROU to renovate the existing house consisting of new windows, shingles and
roof; reconstruct rear second-floor deck, cut back "as built" deck from 16' to 10' and
retain 8' section with proposed circular stairs from second-floor deck to rear of house;
drainage to conform to Chapter 236 of the Town Code; gutters to leaders to drywells on
dwelling; new retaining walls, driveways and walkways in front yard; new basement
windows and emergency access to basement under deck; with the condition of
establishing and subsequently maintaining a 15' wide non-turf buffer along the top of
bluff landward, and as depicted on the survey prepared by Nathan Taft Corwin Ill, Land

I come before you The Southold Town Board of ~ this
you of a very serious concern.
A very high price is paid by those who live along Long Island Sound not only
finandally but as, caretakers responsible for the protection o~the environment.
It isn't oab' Imrricanes that bring harm to our ble~ ~ landslicles from
excessive rain can occur without warning.
Several years ago, one summer, after,four (4) straight days of rain everyone
awakened to find that'their slopes and stairways had fallen down to the beach.
This happened even though there was no erosion on anyone's lancL
It was very costly for everyone to replace and repair the destroyed area.
But all worked hard to protect our land and we constantly continue to do our
best to protect our fragile environment.
My bluff has been solid and without erosion. Unfortunately, that changed a
few weeks ago with the building of my neighbor Mr. Alexandrou's new stairway
to the beach below. In doing so the bluff has been dug out several feet over my..
boundary line creating a potentially dangerous situation,
No one has cometo me to acknowledge this grave error and now not only is
my bluff compromised but also my neighbor's. Where no erosion existed there is
now a landslide waiting to happen. What will be done to replace the foliage that
was torn away to expose the soil? What effects one eventUally effects all.
We are a country of laws and everyone is responsible for obeying them.
Building permits are required not just to protect people but also the environment
In closing I want to thank the Board of Trustees for their kind consideration
to the urgency of this concern.

located on the east side of 2700 Sound Drive in Greenport. I am very familiar with
the bluff and vegetation in both my back yard and my neighbor's. I know that Mr.
Alexandrou has not disturbed the soil on the bluff. He removed two shrubs that
border our houses because they contained beehives, which were a hazard. I am
happy that Mr. Alexandrou is renovating his house and property; the previous
owner neglected both for the past twenty years.

W~EREAS, a public hearing was held and concluded on
September 21, 1989 in the matter of the Application of NICHOLAS
TSIRKAS under Appeal No. 3863; and
WHEREAS, at said hearing all those who desired to be heard
were heard and their testimony recorded; and
WHEREAS, the Board Members have personally viewed and are
familiar with the premises in question, its present zoning, and
the surrounding areas; and
W~EREAS, the Board made the following findings of fact:
1. The premises in question is located along the north
side of Sound Drive, Greenport and is identified on the Suffolk
County Tax Maps as District 1000, Section 033, Block 01, Lot 11.
2. This is an application for Variances from the Zoning
Code Article XXIV, Section 100-244, for permission to construct
a one family dwelling with an insufficient 40' frontyard setback.

3. Article XXIV, Section 100-244, (B) A nonconforming
lot separately owned and not adjoining any lot or land in the
same ownership at the effective date of this Article and not
adjoining any lot or land in the same ownership at any time
subsequent to such date may be used, or a building or structure
may be erected on such lot for use, in accordance with all the
other applicable provisions of this chapter, provided that proof
of such separate ownership is submitted in the form of an
abstract of title showing changes of title to said lot, which
abstract shall be in the usual for~, shall be certified by an
attorney or a company regularly licensed to examine and ensure
title to real property in Suffolk County and shall contain a
certification that no contiguous property was owned by an owner
of the property involved since the date of any previously
applicable Zoning Law.
4. The subject premises is vacant and consists of a total
lot area of 25,250 sq. ft., lot width of 100 feet and total
average depth of 261+- feet., The proposed dwelling will have
insufficient 40' frontyard setback.
5. It is noted for the record that by a prior application
under Appeal No. 3471 , a variance to locate a new single-family
dwelling with an insufficient setback from the edge of bank
along the Long Island Sound, was approved conditionally under
the following stipulations.
6. It was the opinion of the Board that: (a) no
construction be located closer than 50 feet at the nearest point
from the top of the bank.
7. In considering this application, the Board finds and
determines:
(a) that the circumstances of this application are
uniquely related to the premises and its established
nonconformities;
(b) that there is no other method for appellants to
pursue; and placing the proposed dwelling in any other location
on the premises will require other variance relief;

(c) that the area chosen for this single-family dwelling
is not unreasonably located;
(d) that in carefully considering the record and all the
above factors, the interests of justice will be served by

Coastal Erosion Permit for the renovation of the existing house consisting of new windows, shingles
and roof; reconstruct rear second-floor deck, cut back "as-built" deck from 16' to 10' and retain 8'
section with proposed circular stairs from second-floor deck to rear of house; drainage to conform to
Chapter 236 of the Town Code; gutters to leaders to drywells on dwelling; new retaining walls,
driveways and walkways in front yard; new basement windows and emergency access to basement
under deck; and a 10' wide non-turf buffer to be installed and maintained along the landward edge of
the top of bluff. Located: 2700 Sound Drive, Greenport. SCTM# 33-1-11
The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of
Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards.
Based upon the information provided on the LWRP Consistency Assessment Form submitted to this
department, as well as the records available to me, it is my recommendation that the proposed action is
INCONSISTENT with the Policy Standards and therefore is INCONSISTENT with the LWRP.
6.3 Protect and restore tidal and freshwater wetlands.
A. Comply with statutory and regulatory requirements of the Southold Town Board of Trustees
laws and regulations for all Andros Patent and other lands under their jurisdiction.
Comply with Trustee regulations and recommendations as set forth in Trustee
permit conditions.
Numerous actions were conducted without the benefit of a permit.
Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its
written determination regarding the consistency of the proposed action.

The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of
Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards.
Based upon the information provided on the LWRP Consistency Assessment Form submitted to this
department, as well as the records available to me, it is my recommendation that the proposed action is
INCONSISTENT with the Policy Standards and therefore is INCONSISTENT with the LWRP.
6.3 Protect and restore tidal and freshwater wetlands.
Comply with statutory and regulatory requirements of the Southold Town Board of
Trustees laws and regulations for all Andros Patent and other lands under their
jurisdiction

Require compliance with Chapter 236 - Stormwater Management due to slopes and driveway pitch.

LWRP CONSISTENCY ASSESSMENT FORM
A. INSTRUCTIONS
All applicants for permits* including Town of Southold agencies, shall complete this CCAF for
proposed actions that are subject to the Town of Southold Waterfront Consistency Review Law.
This assessment is intended to supplement other information used by a Town of Southold agency
in making a determination of consistency. *Except minor exempt actions including Building
Permits and other ministerial permits not located within the Coastal Erosion Hazard Area.
Before answering the questions in Section C, the preparer of this form should review the exempt
minor action list, policies and explanations of each policy contained in the Town of Southold
Local Waterfront Revitalization Program. A proposed action will be evaluated as to its significant
beneficial and adverse effects upon the coastal area (which includes all of Southold Town).
If any question in Section C on this form is answered "yes", then the proposed action may affect
the achievement of the LWRP policy standards and conditions contained in the consistency review
law. Thus, the action should be analyzed in more detail and, if necessary, modified prior to making
a determination that it is consistent to the maximum extent practicable with the LWRP policy
standards and conditions. If an action cannot be certified as consistent with the LWRP policy
standards and conditions, it shall not be undertaken.

LWRP CONSISTENCY ASSESSMENT FORM
A. INSTRUCTIONS
All applicants for permits* including Town of Southold agencies, shall complete this CCAF for
proposed actions that are subject to the Town of Southold Waterfront Consistency Review Law.
This assessment is intended to supplement other information used by a Town of Southold agency
in making a determination of consistency. *Except minor exempt actions including Building
Permits and other ministerial permits not located within the Coastal Erosion Hazard Area.
Before answering the questions in Section C, the preparer of this form should review the exempt
minor action list, policies and explanations of each policy contained in the Town of Southold
Local Waterfront Revitalization Program. A proposed action will be evaluated as to its significant
beneficial and adverse effects upon the coastal area (which includes all of Southold Town).
If any question in Section C on this form is answered "yes", then the proposed action may affect
the achievement of the LWRP policy standards and conditions contained in the consistency review
law. Thus, the action should be analyzed in more detail and, if necessary, modified prior to making
a determination that it is consistent to the maximum extent practicable with the LWRP policy
standards and conditions. If an action cannot be certified as consistent with the LWRP policy
standards and conditions, it shall not be undertaken.
