WITNESSETH,that the party of the first part, to whom letters
testamentary were:issued by the Surrogate's Court, Suffolk County, New York
Oil June 13 , 1997 and by virtue of the power and authority given in and by said last will
and testament, and/or by Article 11 of the Estates, Powers and Trusts Law, and in consideration of

paid by the party of the second part, does hereby grant and
release unto the party of the second part, the distributees or successors and assigns of the party of the second
part forever,
ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected, situate,
lying and being in the Bay View, in the Town of Southold, County of Suffolk
and State of New York, bounded and described as follows :
PARCEL I :
BEGINNING at a point on the easterly side of New Cedar Beach to
Paradise Point Road, which point is distant 353 feet northerly from
the intersection of the said New Cedar Beach to Paradise Point Road
with the northerly side of Cedar Beach Road; and running thence
( 1 ) easterly at right angles, or nearly so , to said New Cedar Beach
to Paradise Point Road along the line of the property now or
formerly of Charles W. Elner, 570 feet to the Beach line ; thence
( 2 ) northerly along said Beach line to a point where the same
would be intersected by a line drawn parallel to course ( 1 ) as
above described and distant therefrom at all points 150 feet in a
northerly. direction; thence
( 3 ) westerly along said parallel line to the easterly side of said
New Cedar Beach to Paradise Point Road; thence
(4 ) southerly along the easterly side of New Cedar Beach to
Paradise Point Road 150 feet to the point or place of beginning.
All said dimensions being more or less .
PARCEL II ;
BEGINNING at a monument set on the easterly line of Paradise Point
Road at the no corner of lands now or formerly of
Gittinger and the southwesterly corner of lands now or formerly of
Weymouth and running thence
( 1 ) along the lands now or formerly of Weymouth, South 65 degrees ,
15 minutes 30 seconds east a distance of 400 feet to a point;

• ( 2 ) along other lands now or formerly of Gittinger North 70
degrees 07 minutes 10 seconds West a distance of 401 . 54 feet to a
point on the easterly line of Paradise Point Road; thence
(3 ) along the easterly line of Paradise Point Road, north 24
degrees 53 minutes 20 seconds. East a distance of 34 feet to the
point or place of beginning .
TOGETHER with any and all right, title and interest in and to the
Beach land lying in front of the easterly end of the premises
designated PARCEL I above and between said premises and the mesne
high water mark of Shelter Island Sound, and together with the
appurtenances and all the estate and rights of the parties of the
first part in and to said premises .
Being the same premises conveyed. to Clayton Weymouth by Deed dated
June 26 , 1984 and recorded in the Suffolk County Clerk' s Office on
September 14 , 1984 in Liber 9641 of Deeds at Page 210.
The premises are not in an agricultural district and the parcel is
entirely owned by the transferrors.
This conveyance is made as part o'f a distribution by the Executor
of the Estate of Clayton Weymouth to the residuary beneficiary
under his Last Will and Testament, Louise C. McCord, as part of the
distribution of decedent ' s Estate .
