Reference is made to parcel of land., Fisher's Island
from George Lamb to John/Mary Chobor.
On July 15, 1988 check was issued to Town of Southold
for the amount of $150.00 for a hearing with the
ZBA on above mentioned parcel. We tried to satisfy
and comply with your wishes regarding single and
separate ownership (parcel was purchased separately
from adjoining piece from two different parties).
For some unexplained reason this does not meet with
your criteria and as determined by your Town Attorney,
a hearing was not scheduled.
Please refund the amount of $150. since we cannot
pursue this any further.

Appeal No. 3757 - Property of George H. Lamb
Request by Applicant, John Chobor, for Refund
The applicant, Mr. John Chobor, concerning the above premises
has requested a refund of the $150.00 filing fee paid on
July 20, 1988.
Attached are copies of letters sent by the Board of Appeals to
the applicant requesting additional information, and indicating
that upon receipt, the matter WOuld then be calendared for a
public hearing.
At the present time, the requested title search (back to 1957),
survey of the property with proposed dwelling location, and
executed consent form from the current owner have not been
received; and a hearing has not been calendared or advertised.
Questions also had arisen concerning the validity of the
existence of the parcel, which appears to be for sale to the
Chobors (see Z.B.A. letter attached).
There have been referrals to the Town Attorney's office for
reviews, as well as a few telephone conversations between both
offices and the applicant and his attorney.
Based upon the above efforts to proceed with this file, the
Board of Appeals does not feel they are in a position to judge
the merits for refunding the $150.00 filing fee, and therefore
it was left for the discretion of the Town Board.

Transmitted for your information is a copy of our Town
Attorney's letter which indicates that it appears that both the
subject parcel (22.1) and the abutting parcel, now 22.2, merged
in common ownership of the Lambs.
It is urged that a single-and-separate title search and
certification be furnished back to 1957, which would include the
years of the ownership of the Lambs.
Please furnish the above together with the items mentioned
in our August 5, 1988 letter, and the Board will be in a position
to advertise this matter for the next available calendar for a
public hearing.

With regard to your memo of August 8, 1988, I have
reviewed the material.
I note that the "Single and Separate" ownership report
does not state that the property has been in single and separate
ownership since 1957, but rather since July 6, 1976, at which
time Amy A. Lamb conveyed out part of the parcel to Joan A.
Chaves.
What is missing from the material is the deed from J.
William Strueck, Jr., et al, to Raymond A. Lamb and Amy A.
Lamb, his wife, which according to the chain of title reports
covers both parcel 22.1 and 22.2. Why, also, is there another
deed to the Lambs from the Fishers Island Farms, Inc., covering
the same parcel 22.17
In any event, it appears that both parcel 22.1 and 22.2
merged during the ownership of the Lambs, and was split by Amy
Lamb's deed to Joan Chaves in 1976. Hence, that is the reason
the single and separate ownership reports state ownership only
from July 6, 1976. /~---7

Recently, we received an Appeal for a Variance for insufficient
front and side yard setbacks of a proposed dwelling structure
upon the above-described parcel.
It is our understanding that the applicants, Mr. and Mrs. John
Chobor, have an interest in acquiring the parcel from Mr. George
Lamb, who may not be available for questionning during the public
hearing. It is also our understanding that the applicants do not
have a contract of sale or other document confirming their
interest, although we have requested a written authorization from
the owner authorizing the Chobors to make Shese applications to
the Town.
We are attaching copies of the entire file for your review and
respectfully request your legal advice and opinion with refer-
ence to the accuracy of the "single-and-separate title search"
and previous merger with Lot 22.2 (now of J.A. Chaves, previously
of Raymond and Amy Lamb). There appear to have been two Estates
involved, that of Raymond and then of Amy.
The Board would like to be assured that the parcel is a
"single-and-separate" lot prior to advertising the hearing
concerning the setbacks for a dwelling. If you feel additional
information is needed before proceeding, please let us know.

Dear Mr. and Mrs. Chobor:
This letter will acknowledge receipt of your recent
application pending before the Board of Appeals. The Board
members will be conducting environmental and other reviews
necessary by State and local laws prior to advertising your
application for a public hearing.
We are at this time requesting a review of the documents
submitted in your behalf through the Office of our Town Attorney
in order to determine whether or not additional documents should
be submitted at this preliminary stage, and you will be kept
up-to-date.
In the interim, please have the following information
prepared by the current owner, or his authorized agent, and
furnished through the office of your attorney as early as
possible:
(a) Z.B.A. Questionnaire - paragraphs #8 through 11 must be
answered or explained in writing, to be returned with copies of
any contract of sale or other document pending and in effect.{The
