WITNESSETH, that the party of the fust part, in consideration of Ten Dollars and other valuable
consideration paid by the party of the second part, does hereby grant and release unto the parry of
the second part, the heirs or successors and assigns of the party of the second part forever, her
undivided '/2 intrest.
ALL THAT CERTAIN plot, piece or parcel of land, situate, lying, and being at Bayview,
near Southold, in the Town of Southold, County of Suffolk and State of New York,
particularly described as follows:
BEGINNING at a point on the northerly line of North Bayview Road at the southeasterly corner
of the premises herein described and the southwesterly corner of land of Martin Shipuleski;
running thence along said northerly line of North Bayview Road the following two courses: (1)
North 72 degrees 18 minutes 00 seconds West 294.55 feet; (2) North 75 degrees 15 minutes 40
seconds West 140.85 feet to the easterly line of a certain 30 foot right of way, north 17degrees 40
minutes 30 seconds east, 1544.95 feet to the southeasterly line of a right of way leading to the
North Road to Bayview; thence along said southeasterly line of said right of way, north 67
degrees 53 minutes 50 seconds east, 62.20 feet to land of William Zeh; thence along said land of
William Zeh south 23 degrees 15 minutes 00 seconds east, 250.06 feet; thence along said land of
William Zeh and along land of Leslie Jewell north 67 degrees 53 minutes 50 seconds east 220.0
feet to land of Sayre and Young; thence along said land of Sayre and Young, south 22 degrees
06 minutes 10 seconds east, 288.87 feet to said land of Martin Shipuleski; thence southwesterly
along said land of Martin Shipuleski, being partly along a pond, about 320 feet; thence along said
land of Martin Shipuleski, being partly along a pond, about 320 feet; thence along said land of
Martin Shipuleski south 16 degrees 36 minutes 00 seconds West 1026 feet, more or less to the
point or place of beginning.
TOGETHER WITH a right of way over said 30 foot right of way along the westerly boundary of
the premises from said North Bayview Road northerly about 1620 feet to a dredged canal leading
to Goose Creek.
V SO, with a right of way over said right of way leading to the North Road to Bayview.
TOGETHER WITH all right, title and interest, if any, of the seller in and to said pond.
TOGETHER WITH all right, title and interest, including any right of way, if any, in and to a
certain parcel of land described as follows:
BEGINNING at a concrete monument set on the northerly line of a right of way leading to the
North Road to Bayview, at the southwesterly comer of land of Lyon S. Doughty: and running
along said northerly line South 47 degrees 53 minutes 50 seconds west 115 feet, more or less, to
the easterly line of a 30 foot right of way;thence along the easterly line about 35 feet to a dredged
canal leading to Goose Creek; thence in a generally easterly direction along said dredged canal
about 50 feet; thence in a general northerly direction along said dredged canal about 210 feet;
thence along said land of Lyon S. Doughty, south 28 degrees 30 minutes east 215.0 feet to the
point of beginning.
SUBJECT to any and all existing and necessary public utility easements for installing and
maintaining water mains, gas, electric light and power.
Being and intended to be all of the intrest of the same premises conveyed to Beverly A. Kendall
by a certain deed recorded on July 11, 1997, in Liber 11840 page 542.
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any
streets and roads abutting the above described premises to the center lines thereof, TOGETHER
with the appurtenances and all the estate and rights of the party of the first part in and to said
premises; TO HAVE AND TO HOLD the premises herein granted unto the party of the second
part, the heirs or successors and assigns of the party of the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered
anything whereby the said premises have been encumbered in any way whatever, except as
aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the
party of the first part will receive the consideration for this conveyance and will hold the right to
receive such consideration as a trust fund to be applied first for the purpose of paying the cost of
the improvement and will apply the same first to the payment of the cost of the improvement
before using any part of the total of the same for any other purpose.
The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so
requires.
IN WITNESS WHEREOF, the party of the first part has duly executed this deed the day and year
first above written.
