Extend for 24 Months Fairfield Southampton Residential
Planned Development District Zoning Designation and Time
Frame to Complete Substantial Construction
WHEREAS, on April 28, 2009, the Town Board of the Town of Southampton adopted LOCAL
LAW No. 14 of 2009 amending Chapter 330, Article XXVT (Planned Development District), of
the Southampton Town Code by adding a new Section 330-248 (U) entitled "Fairfield
Southampton Residential Planned Development District" (FSRPDD); and
WHEREAS, pursuant to {}330-244(3) (Expiration of approval), approval of a PDD shall expire
36 months after the date of the approval by the Town Board, unless appropriate Planning
Board approvals have been obtained and substantial construction has begun; and
WHEREAS, on May 13, 2010, the Planning Board of the Town of Southampton approved the
site plan of FSRPDD; and
WHEREAS, on 3anuary 25, 2011, the Suffolk County Department of Public Works requested
a change in the collection system for FSRPDD, which necessitated revisions to the FSRPDD
Approved Site Plan; and
WHEREAS, on October 27, 2011, the Planning Board of the Town of Southampton adopted
an AMENDMENT to the APPROVED STTE PLAN for FSRPDD; and
WHEREAS, on April 25, 2012, Fairfield Southampton, LLC requested a 30-month extension
for the FSRPDD approval to obtain all necessary municipal approvals required in order to get
a building permit and commence construction of the subject project; and
WHEREAS, the applicant has demonstrated, at a September 20, 2012 Town Board Work
Session, that they have been diligently pursuing said approvals; and
WHEREAS, in order to insure that the landowner continues to diligently pursue and obtain
all necessary municipal approvals, the landowner shall demonstrate in writing to the Town
Planning and Development Administrator, at six month intervals, all actions taken and
permits received in furtherance of obtaining a building permit and commencing substantial
construction of the subject project; now therefore be it
RESOLVED, that the Fairfield Southampton Residential Planned Development District zoning
designation for the subject property, and the time frame within which to have substantial
construction completed on the subject property, is hereby extended for 24 months, to and
including September 25, 2014.
