DBCL~R~TION OP COVEN]kNTS This DECLARATION made and dated this 23rd day of March, by COFAM REALTY, a partnership with an office at 4623A Bohemia, New York, hereinafter referred to as MT TNBS 8 ETH = WHEREAS, the Declarant is the owner in fee of the real property described in Schedule "A" attached hereto and made a part hereof; and WHEREAS, an application for site plan approval for the property described in Schedule "A" has been filed with the Planning Board of the Town of Southold; and WHEREAS, the Planning Board of the Town of Southold deems it advisable and in the best interests of the Town that Declarant impose certain covenants upon said real property, NOW, THEREFORE, in consideration of the grounds, the Declarant declares that the above described real property is held subject to the following covenants: 1. There shall be no buildings or structures forward of the front line of the building shown on the approved site plan dated March 26, 1993, and last revised March 22, 1994. 2. No further building, structure or other improvement may be made at the property described in Schedule "A" without the approval of the Town of Southold Planning Board. These covenants shall run with the land and can be modified only at the request of the then owner, with the approval of a majority plus one of the Planning Board of the Town of southold after a public hearing. Adjoining property owners shall be entitled to notice of such public hearing, but their consent to any such modifications shall not be required.
