As you are aware, all proposed site plans are subject to the objectives and standards found in Article 24 of the Town Code in congruence with additional Articles supplemental to site plan approval. Based upon the Planning Board's review of your site plan application to this point, the proposed site plan is severely inadequate in satisfying these provisions and the following must be addressed for the Planning Board to proceed: 1. The proposed site plan does not meet the purpose of Article 24 (§280-128A&B): a. (§280-128(B)(1): This application is located on a site that is too small to provide protection to the established character and value of the adjoining properties. There is no room to provide buffers to the adjacent residential property. The location may encourage parking along Cox Lane in front of the residential property where there is not an adequate shoulder for parking. b. (4280-128(B)(2): The potential traffic from this site is estimated by the ITE to be up to 450 vehicles in a day with a peak pm rate of 32 vehicles/hour. The proximity to a busy intersection and the concurrent use of the site as a mason/construction yard will likely cause traffic congestion at this site. c. (4280-128(B)(3): This site is not large enough to accommodate both uses. The land will be overcrowded with vehicles. 0 Tikal 1 Convenience Store Page Two January 11, 2013 2. The proposed site plan does not meet the objectives set forth in §280-129 where the Planning Board shall take into consideration the public health, safety and welfare of the public in general and the residents of the immediate neighborhood, specifically: a. (&280-129(A) Traffic Access: The Institute of Transportation Engineers (ITE) data (8th edition) estimates that a 24 hr. convenience market will generate about 65 vehicle trips, or about 32 cars visiting the site in the peak hour, with a total of 450 vehicles visiting the site on an average day. The single narrow driveway(15'4"at the entrance) is not safe for the intensity of use proposed. Large trucks will be interacting with convenience store patrons and their vehicles without adequate room for ingress, egress and parking. There is insufficient information regarding the amount of traffic generated by the Material Storage and Loading Operation in the rear of the subject parcel. Heavy equipment and trucks were observed on the site during the December 14, 2012 site visit. It is presumed that this activity is regular and will coincide with the activity of the proposed convenience store. Furthermore, the existing driveway is not wide enough to accommodate cars and/or trucks using it simultaneously(a note on the plan states "proposed sign for exiting traffic to yield to entering traffic"). The proposed parking in the front of the building is unsafe. Parking spaces are oriented so that cars must back out onto Cox Lane with poor sight lines to exit the property. Cox Lane is a busy road and this location is only 200'from the intersection with NYS Rt. 25. Sight lines for entering and exiting this driveway may not be sufficient for a convenience store use which generates numerous vehicle trips. b. (6280-129(B) Interior circulation and parking: The potential for unsafe interactions between pedestrians and large trucks, as well as the convenience store traffic exists. The majority of the parking area for the convenience store is located in the rear, while the entrance is located in the front. No proposal has been included for safe pedestrian flow and circulation from the proposed rear parking area. c. (6280-129(C) Landscaping and screening: Landscape requirements will be addressed later in this letter;please see below. d. (6280-129(F) Lighting: It is difficult to create a lighting scheme that is adequate for 24 hour convenience store while also compatible with an adjacent residence. Tikal 1 Convenience Store Page Three January 11. 2013 e. (4280-129(H) Gradinq and drainage: The proposed site plan does not provide for the containment of storm water run-off. f. (4280-1290) Public utilities: The existing septic system appear; to be located within the groundwater table. The Suffolk County Department of Health Services (SCDHS) would need to be consulted to determine whether this would be permitted to remain as it currently exists. 3. The subject site is not in compliance with all requirements found in §280-130 for Site Plan Approval: a. There is an open Code violation on the property(pursuant to §280- 130(B)— site work was done without Planning Board approval during the site plan process. The owner of the property was required to respond to the Code Enforcement Officer by December 24, 2012; that has not occurred. 4. The proposed site plan does not meet the purpose of Article 20 (§280-91); specifically: a. (4280-94) Transition buffer area: This application does not propose the required 25' transition buffer to the adjacent parcel zoned A-C. While this Code section does allow for a fence in lieu of a vegetated buffer, this is a 24 hour use adjacent to a residential district with potential for noise and light at all hours. A fence alone may not provide adequate protection. b. (&280-95(13) Landscaped parking area: This application does not propose the required landscaped area (the 4'perimeter landscaping required in this section would be included in the 25' transition buffer if it was provided). 5. The proposed site plan does not meet the purpose of Article 18 (§280-77), specifically: a. (4280-78) Off-street parking areas: The proposed plan provides for only 13 parking spaces, where 15 are required(convenience store +storage building). The re-configuration of the front parking area may cause the application to be even more deficient in parking. Furthermore, at the December 14, 2012 site visit, the landowner indicated that parking might not be allowed where it is currently proposed behind the existing building. This would severely limit the amount of parking provided. b. (4280-78(K)(1) Regulations for parking spaces adjacent to lots in any residence district: Tikal 1 Convenience Store Page Four January 11, 2013 This application does propose a fence as required, however, at the December 14, 2012 site visit, the landowner indicated a fence might not be allowed. Also a fence will likely not provide a sufficient buffer to residential property for this proposed use which invites a large amount of vehicle traffic (32 vehicles per hour estimated by the ITE in the peak hours). 6. The proposed site plan does not meet the minimum requirements set forth in the Town Code Bulk Schedule for Business, Office and Industrial Districts (§280 Attachment 2:1); specifically: a. Landscape area (percentage): The amount of landscape coverage provided is t3%, and is insufficient The minimum landscape coverage required is 35% for a General Business (B) Zone. 7. There exists an encroachment of existing gravel storage bins on to adjacent parcel(s) to the east. While the Planning Board considers the above-referenced issues to be insurmountable, the Board would like to give you the opportunity to address the insufficiencies listed above. This list is not comprehensive in that there are additional insufficiencies including but not limited to a photometric plan and the lack of a loading area that will be required to be addressed. Please submit a written response directly to the Planning Department. If we do not hear from you in writing by January 25t", the site plan application will be placed on the next available Planning Board calendar for a determination. Wilcenski December 7, 2012 Chairman - Planning Board Town Hall, 53095 Main Road Southold, New York 11971 Re: Tikal 1 Convenience Store 250 Cox Neck Lane, Cutchogue NY SCTM # 1000-97-01-6.1 Dear Mr. Wilcenski: As per a request from your office, I have reviewed the Site Plan for the renovation of an existing 3,200 SF building that will be partially converted into a retail convenience store. This site plan has been prepared by the office of Anne Surchin, Architect and has been dated 9/22/12. Please consider the following: 1. There is a note on the site plan indicating the existence of a 9'deep x 8'diameter pre-cast concrete cesspool and 3' high drainage dome with cast iron frame &solid cover. The test hole provided for the site was taken in approximately the same location. This test hole shows that groundwater is 8.2' below grade. If the bottom of this cesspool was constructed at an elevation that is 4'below the water table it should be abandoned and reconstructed to meet current Suffolk County Health Department Standards. 2. This site plan, as it currently exists, makes no provision for the containment of Stormwater Runoff that is generated by the existing site development. In general,this entire site sheds stormwater run-off in the direction of and out into Cox Lane. Drainage systems should be designed to contain all stormwater run-off generated by the existing & proposed development for this site. Drainage designs must meet the requirements of Town Code - Chapter 236 for Stormwater Management. 3. The pre-existing parking spaces located in the front of the facility require backing out into traffic on a public roadway. This is not recommended. 4. Site plan elements required by Town Code to meet provisions established for Front Yard Landscape Areas, Transition Buffer Areas, and Landscaping in Parking Areas have not been provided. I realize that the 5 parking spaces shown in front are pre-existing and without consideration for the front yard landscaping and buffer requirements. However,the newly proposed spaces in the rear of the facility only indicate a 9" off-set from the property line. All new parking areas should provide at least a 4'wide landscape buffer to meet Town Code 280-95 for Landscape Buffer Area. The issue of the Required Transition Buffer for the adjacent residential Zone should be reviewed by the Planning Board. Page 1 of 2 • • Donald J. Site Plan Notes indicate the existence of a Gravel Surface located throughout the back half of the site. A recent site inspection found no evidence of any type of site improvement or gravel surface that may have been used to pave the rear portion of the site. All new parking spaces approved by the Planning Board should be constructed to meet the minimum construction requirements for stone blend roadways. 6. Site Inspections found new concrete slab construction that is located on the inside comer of the lot that is situated approximately 175'from Cox Lane. (See Enclosed Google Earth Picture) These new concrete slabs and retaining wall structures need to be accurately shown on a survey so they can be addressed by the site plan process. It appears that these new retaining wall blocks may also be encroaching into adjacent property. 7. Additional encroachments toward neighboring properties have also been indicated along the northeasterly property line. These concrete block containment structures should be relocated in a manner that would provide a minimum 4'wide landscape buffer between all structures & property lines. If for some reason these encroachments are to remain, the Planning Board should require formal easements with the adjacent property owners to address the intrusion. All encroachments and site plan elements should be accurately delineated on a formal survey to determine the actual extent of the infringement on adjacent properties. 8. The rear, northeasterly portion of the site has a plan note which indicates that this area will remain as outdoor material storage. This portion of the site has an elevation and overall pitch that is 5' to 7' higher than the front of the property. This material storage operation area should provide permanent erosion control elements that would contain silt as well as stormwater to meet the requirements of Chapter 236. The purpose of the visit was to inspect the septic system serving the existing building. Inspection found an 8 -foot diameter by 8 - foot deep precast concrete leaching pool installed in the front asphalt paved parking area near the northwestern corner of the building. The pool was found to be empty at the time of inspection and inspection of the interior walls of the pool found it to be structurally sound and fully functional.
