ThIS INDENTURE, made the Iq ~'~ay of June, 2012
BETWEEN THOMAS A. PETERS, residing at 225 Williamsburg Drive, Southold, NY 11971, individually and
as administrator of the Estate of Kathryn Peters, atk/a Katherine Peters, a/YJa Catherine Peters, late of
Southold, Town of Southotd, County of Suffolk, New York (Suffolk County Surrogate's Court File No. 357A00),
who died intestate on the 9th day of February, 1997, party of the first part, and
THOMAS A. PETERS, residing at 225 Williamsburg Drive, Southold, NY 11971, as to an undivided nineth-nine
(99%) percent interest; and LINDA SUE READ, residing at 2637 East 24th Street, Ground Floor, Brooklyn, NY
11235, as to an undivided one (1%) percent interest; as joint tenants with right of survivorship, party of the
second part,
WlTNESSETH, that whereas letters of administration were issued to the party of the first part in the Estate of
Stanley Peters by the Surrogate's Court, Suffolk County, New York on March 21, 1996 under File No. 170A96,
and whereas letter of administration were issued to the party of the first part in the Estate of Katherine Peters,
a/Ida Katherine Peters, a/Ida Catherine Peters by the Surrogate's Court, Suffolk County, New York on
February 9, 1997 under,File No. 357A00 and by virtue of the power and authority given by Article 11 of the
Estates,'Powers and Trusts Law, and in consideration of TEN and noll00ths ($10.00) dollars paid by the party
of the second part, does hereby grant and release unto the party of the second part, the distributees or
successors and assigns of the party of the second part forever,
ALL that certain plot, piece.or parcel of land, with the buildings and improvements thereon erected, situate,
lying and being in the Town of Southold, at Bayview, County of Suffotk and State of New York, bounded and
described as follows:
BEGINNING at a point on the southeasterly line of a certain 50 foot road, hereinafter described, said point
being 264.00 feet southwesterly along said southeasterly line from its intersection with the southwesterly line
of Bayview Road; and from said point of beginning;
RUNNING THENCE along land now or formerly of Stanley Peters South 53 degrees 02 minutes 30 seconds
East 162.59 feet to a point which is 10 feet more or less southeasterly from the northwesterly edge of a
dredged canal;
THENCE on a line 10 feet more or less southeasterly from said northwesterly edge of said dredged canal,
South 25 degrees 16 minutes 10 seconds West 101.00 feet;
THENCE North 47 degrees 19 minutes 00 seconds West along land now or formerly of Thomas Szala 166~86
feet to a point on the southeasterly line of said 50 foot road;
THENCE North 25 degrees 16 minutes 10 seconds East along the southeasterly line of said 50 foot road
84.00 feet to the point or place of BEGINNING.
TOGETHER WITH a right of way over said 50 foot road for ingress and egress to and from the described
premises, the southeasterly line of which i.s described as follows:
BEGINNING at an iron pipe set on the southwesterly line of Bayview Road, said pipe being South 59 degrees
01 minutes 00 seconds East 229.50 feet along said southwesterly line from a concrete monument set at a
deflection point in said line; from said point of beginning running South 25 degrees 16 minutes 10 seconds
West 515.00 feet to a stake.
The northwesterly line of said 50 foot road is parallel with and 50 feet northwesterly from the above described
southeasterly line measured at right angles thereto.
BEING AND INTENDED TO BE the same premises conveyed to Catherine Peters by deed made by Stanley
Peters and Catherine Peters dated January 13, 1972 and recorded in the Suffolk County Clerk's Office on
February 8, 1972 in Liber 7102 at Page 525.
TOGETHER with all right, title and interest, if any, of the party of the first part, in and to any streets and roads
abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances, and
also all the estate which the said decedent had at the time of decedent's death in said premises, and also the
estate therein, which the party of the first part has or has power to convey or dispose of, whether individually,
or by virtue of said will or otherwise; TO HAVE AND TO HOLD the premises herein granted unto the party of
the second part, the heirs or successors and assigns of the party of the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered anything
whereby the said premises have been encumbered in any way whatever, except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the
first part will receive the consideration for this conveyance and will hold the right to receive such consideration
as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the same
first to the payment of the cost of the improvement before using any part of the total of the same for any other
purpose. The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so
requires.
