THIS INDENTURE, made the 9th day of August, Two Thousand Twelve
BETWEEN
MICHAEL F. LOPEZ, residing at 280 West 12th Street, New York, New York 10014,
party of the first part, and
THEODORE V.H. MAYER and MARGERY MAYER, husband and wife, residing at 4 Pryer
Manor, Larchmont, New York 10538,
party of the second part,
(~oC~WlTNESSETH, that the party of the first part, in consideration of Ten Dollars and other valuable
consideration paid by the party of the second part, does hereby grant and release unto the party of
the second part, the heirs or successors and assigns of the party of the second part forever,
ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon
erected, situate, lying and being at Orient in the Town of Southold, County of Suffolk and State
of New York, known as designated as and by Lot No. 5 as shown on a certain map entitled, "Map
of Beaujolais Acres," filed in the Office of the Clerk of the County of Suffolk on April 14, 1976
as Map No. 6373, bounded and described as follows:
BEGINNING at a point on the southwesterly side of Orchard Street distant 1,086.93 feet
northwesterly when measured along the southwesterly side of Orchard Street from the comer
formed by the intersection of the southwesterly side of Orchard Street with the northwesterly side
of King Street;
RUNNING THENCE South 56 degrees 02 minutes 20 seconds West, 586.37 feet;
THENCE North 29 degrees 55 minutes 10 seconds West, 98.55 feet;
THENCE North 50 degrees 14 minutes 40 seconds East, 560.82 feet to the southwesterly side of
Orchard Street;
THENCE South 41 degrees 51 minutes 10 seconds East, 156.40 feet along the southwesterly side
of Orchard Street to the point or place of BEGINNING.
BEING AND INTENDED TO BE the same premises conveyed to the party of the first part by
deed dated September 10, 1990, and recorded September 26, 1990, in the Office of the Suffolk
County Clerk in Liber 1114t, Page 549.
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any
streets and roads abutting the above described premises to the center lines thereof; TOGETHER
with the appurtenances and all the estate and rights of the party of the first part in and to said
premises; TO HAVE AND TO HOLD the premises herein granted unto the party of the second
part, the heirs or successors and assigns of the party of the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered
anything whereby the said premises have been encumbered in any way whatever, except as
aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that
the party of the first part will receive the consideration for this conveyance and will hold the right
to receive such consideration as a trust fund to be applied first for the purpose of paying the cost
of the improvement and will apply the same first to the payment of the cost of the improvement
before using any part of the total of the same for any other purpose.
The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so
requires.
IN WITNESS WHEREOF, the party of the first part has duly executed this deed the day and year
first above written.
