WITNESSETH, that the party of the first part, in consideration of TEN and no/100ths ($10.00) dollars paid by
the party of the second pad, does hereby grant and release unto the party of the second part, the heirs or
successors and assigns of the party of the second part forever,
ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected, situate,
lying and being at Orient, Town of Southold, County of Suffolk and State of New York, being more particularly
bounded and described as follows:
BEGINNING at an iron pipe on the northerly line of a 25 foot right of way, said point of beginning being North
73 degrees 01 minutes 10 seconds East, 50.95 feet and thence North 77 degrees 27 minutes 20 seconds
East, 140 feet from a monument on the boundary line between land now or formerly of Harrison M. Demarest,
Sr. and Cora Demarest and land now or formerly of Ruth L. Young, said monument being 1597.22 feet
northerly along said boundary from the Main Road, said point of beginning being the southeasterly corner of
land conveyed by Harrison M. Demarest, Sr. and Cora Demarest to Louis Demarest; from said point of
beginning running along said land now or formerly of Louis Demarest, North 8 degrees 32 minutes 40 seconds
West, 175 feet to an iron pipe; thence along said land now or formerly of Harrison M. Demarest, Sr. and Cora
Demarest, two courses, as follows: (1) North 77 degrees 27 minutes 20 seconds East, 140 feet to an iron pipe;
thence (2) South 8 degrees 32 minutes 40 seconds East, 175 feet to an iron pipe on said northerly line of said
25 foot right of way; thence along said northerly line, South 77 degrees 27 minutes 20 seconds West, 140 feet
to the point of beginning.
TOGETHER WITH a right of way over said 25 foot right of way from the southeasterly corner of the premises
westerly about 305 feet to a second 25 foot right of way hereinafter described.
ALSO with a right of way over said second 25 foot right of way, the center line of which is described as
follows:
BEGINNING at a point which is North 73 degrees 01 minutes 10 seconds East, 12.58 feet from said
monument on the boundary between land now or formerly of Harrison M. Demarest, Sr. and Cora Demarest
and land now or formerly of Ruth L. Young, and running parallel to and 12.50 feet easterly from the westerly
boundary of said land now or formerly of L.M. Young Estate, two courses as follows: (1) South 10 degrees 21
minutes 10 seconds East, 837.09 feet; thence (2) South 15 degrees 06 minutes 40 seconds East, 452.7 feet;
thence continuing through said land now or formerly of L.M. Young Estate, three courses, as follows: (1) South
81 degrees 17 minutes East, 152 feet; thence (2) South 57 degrees 45 minutes East, 178 feet; thence (3)
South 0 degrees 17 minutes East 180 feet, more or less, to a point on the northerly line of the Main Road,
about 235 feet easterly along said northerly line from the southwesterly corner of land now or formerly of
Harrison Demarest, Sr.
SUBJECT TO the rights of others, if any, to pass and repass over the rights of way hereinabove set forth; to
covenants, restrictions, easements, agreements, reservations and zoning regulations, if any; to any state of
facts an accurate survey might show.
BEING AND INTENDED TO BE the same premises conveyed to the parties of the first part by deed made by
HARRISON M. DEMAREST, SR. and CORA DEMAREST, his wife, dated May, 3, 1963 and recorded in the
Suffolk County C{erk's Office on May 13, 1963 in Liber 5346 Page 124.
Description of subject prenises is continued on attached page labled CONTINUATION OF I)ESCRIPTION.
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and roads
abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances and all
the estate and rights of the party of the first part in and to said premises; TO HAVE AND TO HOLD the
premises herein granted unto the party of the second part, the heirs or successors and assigns of the party of
the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered anything
whereby the said premises have been encumbered in any way whatever, except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the
first part will receive the consideration for this conveyance and will hold the right to receive such consideration
as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the same
first to the payment of the cost of the improvement before using any part of the total of the same for any other
purpose. The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so
requires.
CONTINUATION OF DESCRIPTION
ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon
erected, situate lying and being in the Hamlet of Orient, Town of Southold, County of Suffolk and State of
New York, bounded and described as follows:
BEGINNING at the northeasterly comer of land of ROBERT T. DEMAREST and BARBARA
D. DEMAREST and nmning thence along said land, South 77 degrees 27 minutes 20 seconds West 140.0
feet; thence on the extension northerly of thc westerly line of said land of ROBERT T. DEMAREST and
BARBARA D. DEMAREST, North 8 degrees 32 minutes 40 seconds West 290.0 feet, more or less, to the
ordinary high water mark of Long Island Sound; thence southeasterly along said high water mark, 180 feet,
more or less, to a point on the extension northerly of thc easterly line of said land of ROBERT T.
DEMAREST and BARBARA D. DEMAREST; thence along said extended line, South 8 degrees 32
minutes 40 seconds East 160 feet, more or less, to the point of BEGINNING. Containing 0.7, more or less,
acres.
TOGETHER WITH (1) a right of way recorded in Liber 274 of Deeds at Page 149, May 18,
1883 in the Suffolk County Clerk's Office, and (2) all of the right, title and interest of Harrison M.
Demarcst, Jr., Robert T. Demarest and Louis M. Demarest, if any, of, in and to the lands under the waters
of Long Island Sound.
TOGETHER WITH and subject to the rights and privileges of others over two 25 foot right of
ways as contained in a prior deed Liber 5346 Page 124.
SUBJECT TO a path 5 feet in width over the westerly part of the premises as contained in
Agreement Liber 9825 Page 447.
BEING AND INTENDED TO BE the same premises conveyed to the parties of the first part by
deed made by Harrison M. Demarest, Jr., Robert T. Demarest and Louis M. Demarest dated March 30,
1993 and recorded in the Suffolk County Clerk's Office on April 14, 1993 in Liber 11625 at Page 504.
