WlTNESSETH, that the party of the first part, without consideration paid by the party of the second part, does
hereby grant and release unto the party of the second part, the heirs or successors and assigns of the, party of the
second part forever,
ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erecl~ed, situate, lying
and being at Fishers Island, Town of Southold, County of Suffolk and State of New York, being more particularly
bounded and described as set forth on Schedule A hereto.
BEING AND iNTENDED TO BE the same premises conveyed to the party of the first part and Mark David Eichorn
by deed made by Eichorn Fishers island, L.P., dated November 29,2010 and recorded in the Office of the Suffolk
County Clerk on December 7, 2010 in Liber 12645 page 295, the party of the first part having acquired the entire
interest of the said Mark David Eichorn in such premises by deed of even date herewith intended to be recorded
in the Office of the Suffolk County Clerk immediately prior to the recording of this deed.
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and roads
abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances and arl the
estate and rights of the party of the first part in and to said premises; TO HAVE AN D TO HOLD the premises herein
granted unto the party of the second part, the heirs or successors and assigns of the party of the second part
forever.
AND the party of the first part covenants that the party of the first part has not done or suffered anything whereby
the said premises have been encumbered in any way whatever, except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the first
part will receive the consideration for this conveyance and will hold the right to receive such consideration as a trust
fund to be applied first for the purpose of paying the cost of the improvement and will apply the same first to the
payment of the cost of the improvement before using any part of the total of the same for any other purpose. The
word ~party" shall be construed as if it read "parties" whenever the sense of this indenture so requires.

Subdivision Plan, Property of John S. Guest and Margaret H. Guest, his
wife, prepared by Chandler, Palmer and King, Norwich, Connecticut,
December 4, 1989, which map was filed in the Office of the Suffolk
County Clerk on July 24, 1995 as Map No. 9717.
BEGINNING at a monument at the intersection of the westerly line of
Crescent Avenue with the southwesterly line of said Crescent Avenue,
said monument being located 5,960.73 feet North of a point which is
3,667.96 feet West of the United States Coast and Geodetic Survey
Triangulation Station "PROS";
RUNNING THENCE South 15 degrees 39 minutes 54 seconds East,
492.94 feet to a point;

a monument;
