the party of the second part, the heirs or successors and assigns of the party of the second part forever,

TO HAVE AND TO HOLD the premises herein granted unto the party of the second part, the heirs or
successors and assigns of the party of the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered anything
whereby the said premises have been incumbered in any way whatever, except as aforesaid.
AND THE party of the first part,in compliance with Section 13 of the Lien Law, covenants that the party
of the first part will receive the consideration for this conveyance and will hold the right to receive such
consideration as a trust fund to be applied first for the purpose of paying the cost of the improvement, and
will apply the same first to the payment of the cost of the improvement before using any part of the total of
the same for any other purpose. The word "party" shall be construed as if it read"parties"whenever the
sense of this indenture so requires.

ALL THAT CERTAIN plot, piece or parcel of land with the buildings and improvements thereon erected,
situate, lying and being in the Town of Southold, County of Suffolk, and State of New York, known and
designated as lot #15 on a certain map entitled, "Map of Terry Waters at Bayview, Town of Southold,
Suffolk County, NY," made by Otto W. Van Tuyl & Son and filed in the Suffolk County Clerk's office on
12/29/58 as Map #2901, which lot is more particularly bounded and described as follows:
BEGINNING at a point set on the south line of Rambler Road where the division line between lots 16 and
15 as shown on the aforesaid map intersects the south line of said Rambler Road; running thence from said
point of beginning along the division line between lots 16 and 15 South 02 degrees 38 minutes 40 seconds
West 150.00 feet to a boat basin; running thence along said boat basin along the arc of a regular curve
bearing to the left having a radius of 175.00 feet a distance of 61.09 feet to lot #14 on the said map; running
thence along said lot #14 North 17 degrees 21 minutes 20 seconds West 150.00 feet to the south line of
Rambler Road; running thence along the south line of Rambler Road along the arc of a regular curve bearing
to the right having a radius of 325.00 feet a distance of 113.45 feet to the said division line between lots 16
and 15, the point or place of beginning.
REGULATED TIDAL WETLANDS associated with tidal pond off Hog Neck Bay are located at Rambler
Road, Southold, County Tax Map Number: District 1000, Section 88, Block 05, Lot 37, otherwise known
as the properties of Jane Norsdstrom and her heirs, assigns, or successors. This property is subject to the
provisions of New York State Environmental Conservation Law (ECL) Article 25 or its successor, and the
conduct of regulated activities may occur only pursuant to ECL Article 25 if prior approval is given by the
New York State Department of Environmental Conservation (NYSDEC) or its successor. Regulated
activities include, but are not limited to the erection of any structure(s); excavation; dredging, grading and
filling; clearing of vegetation; and application or chemicals.
THIS DEED IS MADE TO MODIFY deed date November 4, 1997 recorded in the Office of the Clerk of
the County of Suffolk on November 10, 1997 in Liber 11861 page 624 to add notice covenant required by
the New York State Department of Environmental Conservation pursuant to permit number 1-4738-
01709/00001.
BEING AND INTENDED TO BE the same premises conveyed to the party of the first part by deed dated
