BEING AND INTENDED TO BEAthe same premises conveyed to the grantor herein by

TOGETHER with all right,title and interest, if any,of the party of the first part of, in and to any streets and roads
abutting the above-described premises to the center lines thereof; TOGETHER with the appurtenances and all the
estate and rights of the party of the first part in and to said premises; TO HAVE AND TO HOLD the premises herein
granted unto the party of the second.part,the heirs or successors and assigns of the party of the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered anything whereby the
said premises have been incumbered in any way whatever,except as aforesaid.
AND the party of the fust part,in compliance with Section 13 of the Lien Law,covenants that the party of the first part
will receive the consideration for this conveyance and will hold the right to receive such consideration as a trust fund
to be applied first for the purpose of paying the cost of the improvement and will apply the same first to the payment
of the cost of the improvement before using any part of the total of the same for any other purpose.
The word "party" shall be construed as if it read"parties"whenever the sense of this indenture so requires.;

ALL that certain plot, piece or parcel of land, situate, lying and being at
Bayview, near Southold, in the Town of Southold, County .of Suffolk and State
of New York, bounded and described as follows :
BEGINNING at a concrete monument set at the Southeasterly corner of the
premises herein described, at the intersection of the northeasterly line of
Main Bayview Road with the wesperly line of Jacobs Lane, and
RUNNING THENCE along said northeasterly line of Main Bayview Road North 47
degrees 39 minutes 40 seconds, West 528 .76 feet to a concrete monument and
other land of the party of the first part;
RUNNING THENCE along said other land of the party of the first part North 31
degrees 22 minutes 20 seconds East 670 .27 feet to a concrete monument and
land of Frank Stelzer;
RUNNING THENCE along said land of Frank Stelzer South 59 degrees 30 minutes
20 seconds East 481 .48 feet to a concrete monument set on said westerly line
of Jacobs Lane;
RUNNING THENCE along said westerly line of Jacobs Lane South 28 degrees 35
minutes 50 seconds West 779.16 feet to the point of beginning.
EXCEPTING THEREFROM all that tract or parcel of land, situate, lying and
being at Bayview near Southold, in the Town of Southold, County of Suffolk
and State of New York, bounded and described as follows :
BEGINNING at a conceate monument set on the northeasterly line of Main
Bayview Road, 100 . 0 feet southeasterly along said line from the
southwesterly corner of land being this day conveyed to Mahlon D. Dickerson
and others; and
RUNNING THENCE along said land three (3) courses, as follows : (1) at right
angles to said northeasterly line of Main Bayview Road, 'North 42 degrees 20
minutes 20 seconds East, a distance of 150 . 0 feet;
thence (2) at right angles to course (1) above, and parallel to said
northeasterly line of Main Bayview Road, South 47 degrees 39 minutes 40
seconds East, a distance of 100 feet; thence (3) at right angles to course
(2) above, and parallel to curse (1) above, South 42 degrees 20 minutes 20
seconds West, a distance of 150 . 0 feet to a concrete monument set on the
said northeasterly line of Main Bayview toad;
