I am the current owner of the property located at 4400 Breakwater Road, Mattituck, New York ("Subject Premises") and make this Affidavit in support of my application to receive Certificates of Occupancy for two of the three "summer" cabins located on the above-referenced premises. I am fully familiar with the facts herein, as more fully explained below. 2. My parents purchased the Subject Premises in 1949. Copy of deed annexed as Exhibit "A", At that time, I was 14 years old. 3. Over several years, my family commenced building the current structures on the property. Within the first year of purchase, we built the cabin at the top of the road, designated as building #1 on the survey annexed as Exhibit "B". 4. Shortly after that construction, we commenced construction of the second summer cabin, which was necessary to function as a pump house for the well, (designated as building ~). The two first structures were by the end of the summer of 1951. 5. The third cabin (designated as building #3) was constructed within the next summer or two. 6. I was present at the Subject Premises for most of the summers of 1949 to 1955, as my immediate family used the Subject Premises as a summer home. 86/88/2812 11:39 6315435899 PAGE 83/84 7. I am certain that the three cabins were completed prior to 1955. I joined the Navy in 1955 and I am certain that all of the cabins were constructed by the time I joined the Naw. 8. The main house (designated as building fl4) on the survey, was completed, upon information and belief, in 1961. 9. Upon information and belief, both the main house and one of the cabins possess Certificates of Occupancy and this Affidavit is in support of the issuance of Certificates of Occupancy on the other two pre-existing cabins. Box 1179 Southold, N.Y. 11971 RE: 4400 Breakwater Road, MattJtuck SCTM # 1000-099-005-003 Owner: Robert Husak Request for C/O's for pre-existing structures Dear Mr. Verity: I am the attorney for Robert Husak, the owner of the above-referenced property. As set forth on the enclosed old survey, there are four residential structures on the premises, one full time house and three "summer cabins." Based upon research on the title and through your Department, it appears that the year-round structure and one of the cabins have Certificates of Occupancy. It does not appear that there are C.O.'s for the remaining two cabins. Please treat this letter and the accompanying paperwork as a request to your Department to inspect the premises for the purposes of determining that the two structures without C/O's were constructed prior to April 9, 1957 and thus, can be issued certificates of occupancy for prior existing use. Enclosed please find a completed application for the Certificate of Occupancy, the owner's permission to inspect the premises and my client's check, in the amount of $200.00, made payable to the Town and two affidavits, as described below. The property has been in my client's family for about 65 years. The two affidavits are from Mr. Husak and Dora Johansen, a lifelong friend of the Husak family. These Affidavits are based on personal knowledge and each indicate that the two remaining structures were constructed prior to 1955, when Mr. Husak joined the Navy.
