Domino = Fax r '�i� Fax(631) 765-6641 •�i BOARD OF TOWN TRUSTEES April 18, 2012 TOWN OF SOUTHOLD Ms. Amy Martin Fairweather Design Associates, Inc. 205 Bay Ave. Greenport, NY 11944 RE: PETER & MARY KORNMAN 1077 BAY HOME RD., SOUTHOLD SCTM#56-5-39 Dear Ms. Martin: The Board of Town Trustees took the following action during its regular meeting held on Wed., April 18, 2012 regarding the above matter: WHEREAS, Amy Martin on behalf of PETER & MARY KORNMAN applied to the Southold Town Trustees for a permit under the provisions of Chapter 275 of the Southold Town Code, the Wetland Ordinance of the Town of Southold, application dated March 26, 2012, and, WHEREAS, said application was referred to the Southold Town Conservation Advisory Council and to the Local Waterfront Revitalization Program Coordinator for their findings and recommendations, and, WHEREAS, the LWRP Coordinator issued a recommendation that the application be found Consistent with the Local Waterfront Revitalization Program policy standards, and, WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on April 18, 2012, at which time all interested persons were given an opportunity to be heard, and, WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounding area, and, WHEREAS, the Board has considered all the testimony and documentation submitted concerning this application, and, 2 • WHEREAS, the structure complies with the standards set forth in Chapter 275 of the Southold Town Code, and, WHEREAS, the Board has determined that the project as proposed will not affect the health, safety and general welfare of the people of the town, and, NOW THEREFORE BE IT, RESOLVED, that the Board of Trustees has found the application to be Consistent with the Local Waterfront Revitalization Program, and, RESOLVED, that the Board of Trustees APPROVES the application of PETER & MARY KORNMAN to remove the as-built platform and replace with a 4'X 14' walkway with handrail and 12'X 20' on-grade patio beginning 12' landward of existing platform/walkway, and as depicted on the site plan prepared by Robert I. They realize they should not have rebuilt without permits but had no knowledge of the former permit issued to the property owner prior to the owner they purchased the home from that stated any reconstruction would need to moved landward 10'. This application is for an alternative to what was the previously allowed(historic) platform and instead they have asked us to apply for a somewhat larger, bricks or pavers in sand patio on grade which would be framed out in Azek or some other acceptable man- made lumber substitute, to hold it in place. The plan also incorporates a 4' wide walk way with a handrail constructed of the same materials used above on the west side that will allow sure-footed passage from across the rip rap area to the beach for Mr. Kornman who has spine/walking-stability disabilities to get across the rocks to the beach to swim. The proposed walk way is 4' wide by approximately 22' long plus appropriate steps to meet the beach grade safely. As an alternative the 12 feet between the patio &walk way needed across the rip rap might also be done as brick or pavers in sand. The requested Patio area is proposed at 12' x 20' to allow for summer use of table & chairs and is just under 38' feet seaward of the residence's deck & approximately 10'8" landward of the rip rap as shown on the survey & site plan. Both adjoining properties have structures that bridge this rough terrain and we wish similar access to the shoreline, but need to create a safe, less obvious path of materials you can allow.
