Box 2124 Greenport, NY 11944 RE: KENDALL TODD 670 BAYVlEW DR., EAST MARION SCTM#37-5-3 Dear Mr. Costello: The Board of Town Trustees took the following action during its regular meeting held on Wed., July 18, 2012 regarding the above matter: WHEREAS, Costello Marine Contracting Corp. on behalf of KENDALL TODD applied to the Southold Town Trustees for a permit under the provisions of Chapter 275 of the Southold Town Code, the Wetland Ordinance of the Town of Southold, completed application dated May 30, 2012, and, WHEREAS, said application was referred to the Southold Town Conservation Advisory Council and to the Local Waterfront Revitalization Program Coordinator for their findings and recommendations, and, WHEREAS, the LWRP Coordinator issued a recommendation that the application be found Consistent with the Local Waterfront Revitalization Program policy standards, and, WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on July 18, 2012, at which time all interested persons were given an opportunity to be heard, and, WHEREAS, the Board members have personally viewed an~l are familiar with the 3remises in question and the surrounding area, and, WHEREAS, the Board has considered all the testimony and documentation submitted concerning this application, and, WHEREAS, the structure complies with the standards set forth in Chapter 275 of the Southold Town Code, and, WHEREAS, the Board has determined that the project as proposed will not affect the health, safety and general welfare of the people of the town, and, NOW THEREFORE BE IT, RESOLVED, that the Board of Trustees has found the application to be Consistent with the Local Waterfront Revitalization Program, and, RESOLVED, that the Board of Trustees APPROVES the application of KENDALL TODD to remove existing concrete walkway landward of bulkhead; remove existing wooden ramp and 5'X 18' floating dock; remove 76' of existing bulkhead and construct 76' of new bulkhead and new 6' east return in-place raising top elevation of new bulkhead +2.0'; install new 36"X 10' seasonal aluminum ramp onto a 6'X 20' seasonal floating dock secured by two 8" dia. anchor pilings; dredge an area 30'X 23' below dock to -4.0' below mean Iow water, removing approx. 40 cy. of spoil and dredged spoil to be placed as backfill for voids landward of bulkhead, and supplement dredged spoil with clean trucked in sand approx. 35 cy. as needed. SCTM#37-5-3 The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available'to me, it is my recommendation that the proposed action is CONSISTENT with the denoted following Policy Standards and therefore is CONSISTENT with the LWRP provided the following best management practice is required pursuant to: § 275-11. Construction and operation standards. A. General. The following standards are required for all operations within the jurisdiction of the Trustees: (2) Erosion control. Installation of an erosion control structure is necessary during any building, grading, landscaping or site work activity within Trustee jurisdiction. This structure may include, but is not limited to, installation of a silt fence, hay bales, wood chip berm and silt booms. The placement of the erosion control structure(s) shall be determined by the Trustees or their designee. All intertidal construction and excavation requires the installation of a silt boom that will retain all suspended sediments within the immediate project area. The proposal to dredge an area 30'X 25' below dock to -4' below mean Iow water is INCONSISTENT pursuant to policy: 6.3 Protect and restore tidal and freshwater wetlands. Comply with statutory and regulatory requirements of the Southold Town Board of Trustees laws and regulations for all Andros Patent and other lands under their jurisdiction Comply with Trustee regulations and recommendations as set forth in Trustee permit conditions.
