A Regular Meeting of the Southold Town Board was held Tuesday, June 19, 2012 at the Meeting
Hall, 53095 Main Road, Southold, NY. Supervisor Russell opened the meeting at 4:30 PM with
the Pledge of Allegiance to the Flag.

JAMES GRATHWOHL: I am very pleased to be hcrc today. I am chairman of the Southold
Town Landmarks Preservation Commission and today we are going to present to two different,
one is an organization, the other an individual for restoration and preservation of landmarks in
Southold town. First of all, let me introduce thc commission: Don Feller isn't here but Jamie
Gar~son, Larry Yungblut, Mel Phaff, Gary Parker, Doug Constant and Damon Rallis is our
administrative assistant. But let me just briefly tell you what we are all about because many
people unfortunately are not familiar with the Landmarks Preservation Commission and our
successes and maintaining the great style of life an ambiance in Southold Town. But our mission
is to afford proper recognition to the town's historic landmarks and to protect them from
incompatible alteration or demolition. Doing so will maintain them for thc continuing
recognition, use and enjoyment of current and future residences and visitors to the town. And we
maintain a landmark preservation roster with 150 landmarks. Now they are not all houses, for

instance the buttonwood tree in Orient is a landmark. There are several others, a windmill
someplace in town is a landmark and people can put their name on their site on this roster and it
is all voluntary. There is a revised code landmark preservation that the town (inaudible)
probably 4 or 5 years ago, so we are able to help the town maintain the well known ambience
that brings so many people here. And part of our mission also was to help encourage tourism.
So if you own a landmark that you would like listed and protected, that is the important thing, it
is kind of an insurance policy, please see us. We would be very glad to help you put your
landmark on the roster. Today we have two places that we are giving awards to. The
commercial landmark of the year and these were awarded in 2011, is the Brecknock Hall and I
would like Alice Hussie to join me. I just see our good friend from the Suffolk Times arriving.
We want to make sure she knows what we are doing. We nominated and awarded Brecknock
Hall specifically for the work done in accordance with the roster, with the landmark code and
granted the approval of the construction of a handicapped ramp required for a building change of
use for public assembly. Brecknock Hall is a little different than from some of the restoration
projects. This change, the addition of a handicap railing, ramp rather, was the only change that
we had, the Landmark Preservation Commission, had authority over because our charge is only
for maintaining the authenticity of the exterior of a building and especially the exterior that is
visible from a public way. So most of the restoration that had been done on Brecknock Hall was
interior and if you have been in the building, they have done a fantastic job. Alice Hussie is
chairman of the Brecknock Hall foundation and led that effort but we were very impressed with
the railing, it kept the authenticity of the entire building. If you haven't seen it, it goes down the
east side of the front center off the back doors. Alice, it is a pleasure to present this to you and I
would ask if you have any comments or would like to say anything on behalf of Brecknock Hall.
ALICE HUSSIE: Thank you very much.
MR. GRATHWOHL: You are very welcome. And we thank you and your colleagues of doing
such a good job.
MS. HUSSIE: You know, Brecknock Hall has been here since 1857, shortly after the railroad
came in 1844 and it was part of the Floyd family until 1960 when it kind of went downhill and
when the Brecknock Hall foundation took it over, it was home to squirrels, pigeons and other
wildlife, falling plaster. It was through 6 years and 7,000 hours of volunteer work that we got it
useable again and I thank you very much.
MR. GRATHWOHL: You are very welcome and we thank you for all the great work you have
done. Keep it up. The second award is the residential landmark for the year 2011 and it goes to
the Cohen house in Orient, 265 Orchard Street and it is owned by Clifford and Leslie Cohen.
Mr. Sorenson is accepting the certificate on their behalf. And this is an unusual, this is a real,
true restoration project because the house had been pardon the term, bastardized over the years
and certainly had lost a lot of the authenticity but with Mr. Sorenson's knowledge and assistance,
the Cohens were able to bring this back and made some additions which we approved but all in
keeping with the ambience and the historical integrity of the building. This house was built prior
to 1858 and is known as the Samuel Watson Youngs grand house and it is quite a grand house
and in 2007 is when the Sorenson's started their work and they demolished an existing bedroom,

added a new study and more living space including a screened porch but all of it maintaining the
authenticity of the house and the ambiance of the neighborhood. So Mr. Sorenson, thank you for
your good work and you can pass this on the Cohen's.
MR. SORENSON: Thank you very much.
MR. GRATHWOHL: Well, we appreciate all you are doing because not only do you do it for
the Sorenson's but you do it for a lot of people in Orient and that is why Orient is so wonderful.
MR. SORENSON: We appreciate it very much. Thank you.

SUPERVISOR RUSSELL: I just want to quickly say, Alice, to say that you got that building
useable is an understatement. It is as stunning inside and out. I have been in it many times.
Also, to the group, the Landmarks Preservation Commision, Jim and to the rest of the members,
you guys work incredibly hard, I have been to some of your meetings. I hope everybody
appreciates how much work you do at protecting the historic character of this community.

Cove Marine, Inc., Fishers Island, New York, in the amount of $3000.00 for repair and
placement of channel markers to be placed in both West Harbor and Hay Harbor, Fishers Island,
New York, as well as retrieve, repair and replace, or return missing markers and instructional
floats that are lost during the season, at a rate of $85.00 per marker plus the cost of necessary
materials, buoys to be prepared and placed at the beginning of the season, and removed and
stored by October 15, 2012; foregoing all in accordance with the bid notice of the Fishers Island
Harbor Committee and subject to the approval of the Town Attorney.

RESOLVED that the Town Board of the Town of Southold hereby grants permission to the
Mattituck Presbyterian Church to hold its annual Summerfest, on Saturday, July 28, 2012, with
the partial closure of Old Sound Avenue in front of the church provided they
1. They file with the Town Clerk a One Million Dollar Certificate of Insurance
naming the Town of Southold as an additional insured;
3. Coordinate traffic control upon notification of the adoption of this resolution with
Captain Kruszeski
4. No objects of any kind shall be thrown to event spectators
5. No permanent markings be placed on town, county or state roads or property for
the event;
6. Any road markings or signs for the event be removed within twenty-four (24)
hours of the completion of the event.
Support is for this year only, as the Southold Town Board continues to evaluate the use of town
roads. All fees associated with this event shall be waived.

Bond for Various Purposes 2012
BOND RESOLUTION OF THE TOWN OF SOUTHOLD, NEW
YORK, ADOPTED JUNE 19, 2012, AUTHORIZING THE
CONSTRUCTION OF VARIOUS IMPROVEMENTS TO TOWN-
OWNED FACILITIES LOCATED AT THE TOWN'S HIGHWAY
DEPARTMENT YARD, AT THE ESTIMATED MAXIMUM
COST OF $106,000 AND TO THE TOWN'S POLICE
DEPARTMENT HEADQUARTERS BUILDING, AT THE
ESTIMATED MAXIMUM COST OF $14,000, STATING THE
ESTIMATED TOTAL COST THEREOF IS $120,000,
APPROPRIATING SAID AMOUNT FOR SUCH PURPOSES,
AND AUTHORIZING THE ISSUANCE OF $120,000 BONDS OF
SAID TOWN TO FINANCE SAID APPROPRIATION
THE TOWN BOARD OF THE TOWN OF SOUTHOLD, IN THE COUNTY OF
SUFFOLK, NEW YORK, HEREBY RESOLVES (by the favorable vote of not less than two-
thirds of all the members of said Town Board) AS FOLLOWS:
Section 1. The Town of Southold, in the County of Suffolk, New York (herein
called the "Town"), is hereby authorized to construct various improvements to Town-owned
facilities located at the Town's Highway Department yard, at the estimated maximum cost of
$106,000 and to the Town's Police Department headquarters building, at the estimated maximum
cost of $14,000. The estimated total cost thereof, including preliminary costs and costs
incidental thereto and the financing thereof, is $120,000 and said amount is hereby appropriated
for such purposes. The plan of financing includes the issuance of $120,000 bonds of the Town
to finance said appropriation, and the levy and collection of taxes on all the taxable real property
in the Town to pay the principal of said bonds and the interest thereon as the same shall become
due and payable.
Section 2. Bonds of the Town in the principal amount of $120,000 are hereby
authorized to be issued pursuant to the provisions of the Local Finance Law, constituting Chapter
33-a of the Consolidated Laws of the State of New York (referred to herein as the "Law"), to
finance said appropriation.

Section 3. The following additional matters are hereby determined and declared:
(a) The periods of probable usefulness applicable to the objects or purposes
for which said serial bonds are authorized to be issued are in excess of five (5) years; however,
the bonds authorized pursuant to this resolution and any bond anticipation notes issued in
anticipation of the sale of said bonds, shall mature no later than five (5) years after the date of
original issuance of said bonds or notes.
(b) The proceeds of the bonds herein authorized and any bond anticipation
notes issued in anticipation of said bonds may be applied to reimburse the Town for expenditures
made after the effective date of this resolution for the purpose for which said bonds are
authorized. The foregoing statement of intent with respect to reimbursement is made in
conformity with Treasury Regulation Section 1.150-2 of the United States Treasury Department.
(c) The proposed maturity of the bonds authorized by this resolution will not
exceed five years.
Section 4. Each of the bonds authorized by this resolution and any bond
anticipation notes issued in anticipation of the sale of said bonds shall contain the recital of
validity as prescribed by Section 52.00 of the Law and said bonds and any notes issued in
anticipation of said bonds shall be general obligations of the Town, payable as to both principal
and interest by a general tax upon all the taxable real property within the Town. The faith and
credit of the Town are hereby irrevocably pledged to the punctual payment of the principal of
and interest on said bonds and any notes issued in anticipation of the sale of said bonds, and
provision shall be made annually in the budget of the Town by appropriation for (a) the
amortization and redemption of the bonds and any notes in anticipation thereof to mature in such
year and (b) the payment of interest to be due and payable in such year.
Section 5. Subject to the provisions of this resolution and of the Law and
pursuant to the provisions of Section 21.00 relative to the authorization of the issuance of bonds
with substantially level or declining annual debt service, Section 30.00 relative to the
authorization of the issuance of bond anticipation notes and Section 50.00 and Sections 56.00 to
60.00 and 168.00 of the Law, the powers and duties of the Town Board relative to authorizing
bond anticipation notes and prescribing the terms, form and contents and as to the sale and
issuance of the bonds herein authorized, and of any bond anticipation notes issued in anticipation
of said bonds, and the renewals of said bond anticipation notes, and as to executing contracts for
credit enhancements and-providing for substantially level or declining annual debt service, are
hereby delegated to the Supervisor, the chief fiscal officer of the Town.
Section 6. The validity of the bonds authorized by this resolution, and of any
notes issued in anticipation of the sale of said bonds, may be contested only if:
(a) such obligations are authorized for an object or purpose for which the
Town is not authorized to expend money, or
(b)
the provisions of law which should be complied with at the date of the
publication of such resolution, or a summary thereof, are not substantially
complied with,
and an action, suit or proceeding contesting such validity is commenced within twenty days after
the date of such publication, or
(c) such obligations are authorized in violation of the provisions of the

COUNCILMAN RULAND: Before I cast my vote, I would just like to say that while the
resolution is very much in legalese, the practical matter of it is it is a more reconstruction of
facilities and repair. Desperately needed repair of facilities that we already have, so it is not that

SEQRA for Bond/Highway & PD Improvements
RESOLVED that the Town Board of the Town of Southold hereby finds that the proposed
"Bond Resolution of the Town of Southold authorizing the construction of varion~
improvements to Town-owned facilities located at the Town's Highway Department Yard
and Police Department Headquarters" is classified as an Unlisted Action pursuant to SEQRA
Rules and Regulations, 6 NYCRR Section 617, and that the Town Board of the Town of
Southold hereby establishes itself as lead agency for the uncoordinated review of this action and
issues a Negative Declaration for the action in accordance with the recommendation of Mark
Terry dated June 19, 2012, and authorizes Supervisor Scott A. Russell to sign the short form
EAF in accordance therewith, and is consistent with the LWRP pursuant to Chapter 268 of the
Town Code of the Town of Southold, Waterfront Consistency Review.

SUPERVISOR RUSSELL: That would complete the business of the agenda. I would invite
anybody that would like to address the Town Board on any issue to please feel free? Dan?
Dan Catullo, Mattituck
DAN CATULLO: Dan Catullo, Mattituck. I was attacked by two big dogs on Bailie beach about
a month and a half ago and I was wondering what the cause was, what proposed, what possibly
could have caused an environment that allowed this to happen? Here is what I came up with, 90
% or more of the people that come to Bailie beach are letting their dogs run free most or all of
the time that they are on that beach and Bailie's beach is known locally as the dogs beach. That
is its definition. My wife in fact overheard at a garage sale that they were referring to that, I am
taking my dogs up to the dog beach. How and why did this happen? Where did that definition
come from? All of the beaches surrounding us, right across the narrow outlet, the opening of
Mattituck inlet, we have got Breakwater beach there, the same thing with the bay side where
Veteran's beach is. You have got Southold town beach, all of them have signs prohibiting dogs.
Bailie's doesn't, we are just somehow back of the bus type folks. We just can't, as far as I am
concerned, it is just an inequity. Not fair. Getting back to that attack that I had experienced. To
call that terrifying is an understatement somewhat akin to character/zing Adolph Hitler as
inconsiderate. It's just, the horror of those minutes of the attack is hard to convey in words. It is
unimaginable and I just really am still suffering from some of the trauma of that and there are
some court actions that are going to be forth coming on it. these incidents are that infrequent
actually either. Many of the media won't report them entirely. They will be overlooked or
forgotten for the most part. I do remember one incident that was particularly bad and that was
the California woman who was attacked in her very own apartment house. She was killed,
mutilated and killed in the apartment house by her neighbors dog, a really horrific event. And I
myself have experienced the other side of this dog attack business because I can be objective. I
ran the emergency room of Lawrence Hospital, which is a Bronxville hospital, that itself is a
suburb of New York City. A lot of wealthy, well-educated people live there, people of celebrity
types that should know better but I had to treat a lot of dog bites there. Therefore, ! can be as I
say, objective in my view of what dogs can do, what they are capable of. And they are all the
more reason why the situation at Bailie beach is, to me, intolerable. It is not only as a matter of

fact, it is not only friendly, life threatening situations but friendly dogs, so called friendly dogs
can also produce problems. You have situations where a dog runs along amiably and then leaps
up on you. I have had that happen where inadvertently a claw caught me in an expensive
sweater and causes a tear or a run. They are slobbering saliva over bare skin or open wounds at
the time and possible health problems from that. it is not a good thing. You know, friendly is
really a matter of perception and perception is a matter of perspective. When you see a large dog
racing towards you with its mouth wide open, as far as I am concerned, that is a killer attack dog
until proven otherwise. The shouts of reassurance from the owner down the beach
notwithstanding. A bad situation. I mean, dogs aren't allowed in town without leashes. You go
to Mattituck center or Cutchogue, Southold, I haven't seen dogs offa leash there. Even the roads
leading to those places I haven't seen dogs off leashes. But you get to Mattituck, you get to
Bailie beach, the owners take the leashes off, off they go, free as the wind to do what dogs will
do. What is the mechanism here? What do they think, what do the dogs owners think is
happening that transforms this dog now into a totally innocuous animal that is incapable of
inflicting any harm? It doesn't make sense. I mean, it is sort of like a werewolf effect but only
in reverse. And for that a full moon effect. What is it that causes that transformation in the
minds of these dog owners? The salt air? The sand underfoot? The smell of the sea? It is hard
to even imagine. I graduated Cornell University with a biology major and I never encountered
any such phenomena as that in the real world any way. This whole business with the deer park,
you brought this up Scott, last meeting, if that closes and I don't know what the status of that is
but if that closes, we are going to have some of these heedless folks with their bad behavior
bringing dogs to the offshoot, to the over flow area which would be Bailie's. now that is going
to make a bad situation even worse. Something to really consider. In this very building during
these meetings you have had and especially the last three where I have watched them on the TV,
you have had a common theme running throughout and that is passing laws that aim to improve
the health, safety and welfare of the public. The health, safety and welfare of the public. Aren't
we part of the public there at Bailie's? Aren't we people, towns folk, aren't we entitled to some
of that? My wife, my 16 year old daughter, they many times will go out on the beach aiming for
a nice peaceful walk. They come back reporting seeing a dog or a couple of dogs running free
down the beach, they will move off to the periphery, detour to the base of the bulkhead or to the
shore or even in the water to avoid a confrontation, many times unsuccessfully. So it is not fair,
it is not just fair. So I ask the Board to remedy this situation. Let's not let proper beach conduct
and safety be in the realm of the discretion of the dog. Let's have a strict leash law in place. I
mean, an absolutely strict leash law. An unequivocal, without any exceptions and by that I
mean, none of this addenda of in control. It really just makes the whole point senseless. It
immobilizes it. it is debatable, it is vague, it is arbitrary. I mean, the dog owner is going to have
his own definition of what in control is and the victims will be 180 degrees opposed. I have seen
police, I have called police in different instances and different patrolmen have had different
views of what in control is, so it is arguable, much like medieval scholars arguing over how
many angels can dance on the head of a pin. It is just there is no reality to it. strict leash law,
dogs off the leash, a photograph which targets the animal, shows the geography of where this
occurred, there is your evidence. You are on the beach, you are on the leash. That is your case.
There is your evidence, here is your fine. And fining this people, fining these I consider indecent
people who are doing these things much like is going on in the dog park is, well, it's the way you
will have to teach these people, it has to be that way. I guess it has got to be that way and as a

bonus we get some money for the coffers of the town as well. But I would say that that's the
way to go. I think there is going to be a lot of opposition doing anything, if we have a leash law,
it should be extended to all those beaches I mentioned. To Breakwater and to Southold town
beach because we all should be in the same boat, there should be equality around. And this
allows that there won't be a funneling effect from having a non-restricted area for dogs, a
restricted area out in the periphery for dogs and it will all be channeled down into a non-
restricted area which would be Bailie's beach. That would increase your entire population there
and produce increase problem, the other alternative would just be to close Bailie beach
completely, just as the other beaches are. This would give us equality.
COUNCILMAN TALBOT: Sir, I think they all fall under the same circumstances, no dogs are
allowed on any of the beaches in town. Inaudible. I have never heard of Bailie's beach being
referred to as the dog beach but it may very well to a lot of people.
MR. CATULLO: That is the general consensus.
COUNCILMAN TALBOT: We do have a leash law in town and obviously, a lot of the things
that you said we have been discussing over recent weeks, some people don't want to adhere to
anything or take care of their own dogs.
MR. CATULLO: I got that impression (inaudible).
SUPERVISOR RUSSELL: Let me just clarify a couple of points, first Dan, I just need you to
state your name for the record. Actually, the town doesn't have any criteria for different, they
are all the same standard for all the town beaches. They are actually permitted on beaches and
they need to be under the owner's control. There isn't a leash requirement. Maybe that is not
sufficient, I will agree with you there. That is an ambiguity of the law I would agree with. But
the other beaches you mentioned which is Breakwater and Veteran's beach, they are actually
park district beaches, they are not governed by Southold Town. The town beaches which would
be New Suffolk beach, Bailie beach, town beach over here and we have signs up requiring that
people pick up after their dogs, maybe that is not sufficient. That is something we can certainly
discuss and take that issue up as a Board. Maybe we do need a leash law at this point. The
residents in New Suffolk raise the same complaints with me on a regular basis that you are
raising in terms of the over use of dogs running amok on that beach in New Suffolk, with the
same problems. I assure you, we have a lot of pressure on all of our beaches. It is not Bailie
beach isn't experiencing something that any of the other beaches aren't experiencing. We have a
tremendous amount of pressure of public use and of course, pets add a whole new component to
that.
MR. CATULLO: It is so ambiguous because I have patrolmen coming out, they see these dogs,
I mean, I have been attacked by a dog with just that railing between me and them and the owner
is saying he is under control. If it weren't for that barrier between the road and the beach itself,
he would have been at me. i mean, these are, I told the police this, they never mentioned that
there shouldn't be an unleashed dog of any kind. Now this thing with control, as I said, it is
totally arbitrary.

SUPERVISOR RUSSELL: What I am going to do is I am going to copy that law and I am going
to put it on for discussion for the Town Board to take up in two weeks to discuss. Maybe that
law isn't sufficient any longer.
MR. CATULLO: With the attack I mentioned, I won't get into details because there is court
action coming up but this initiated with the dogs and we are talking about two football fields
length. Now what kind of control can you have when the dogs are at that distance? It is
ridiculous, it is not, you know, and where is the line that says this is the amount of space for this
particular dog that I have control? That is why if you have a leash law that says here is the leash,
it is physically affixed and if it is a photograph, I mean, if you see picture and the geography of
the area and there is no leash attached directly, you have got all the evidence you need, you can't
argue out of that. That is what I am saying. You mentioned you know, there is a requirement
that it be in control. It is meaningless, too arbitrary.
SUPERVISOR RUSSELL: We will put that whole section up for discussion with the Town
Board in two weeks.
MR. CATULLO: Thank you.
SUPERVISOR RUSSELL: Who else would like to comment and address the Town Board on
any issue? Made?

MARIE DOMINICI: Made Dominci, Mattituck. First I would like to applaud the Town Board
for going so far as to implementing solar at the landfill. I think it is a wonderful thing, I think we
will see a tremendous influx of cash flow for the town and being a solar homeowner myself, I
can tell you my last electric bill was $11.81 so who is going to complain about that? so
congratulations for taking that on and bringing it to the table. Now I am going to bring up my
favorite subject, the Love Lane traffic. I sent A1 Krupski a shot from, was it yesterday?. I don't
recall if it was yesterday or today. It was a little distant, but it was an 18 wheeler, it was 7:30 in
the morning and I mean, I just don't understand. In previous times there was a sign there that
said no through trucking except for deliveries. What is the adversity why we couldn't just put
that sign back and monitor what is going on there? Because it is happening and you know, either
a truck has to hit somebody or crash into a building before we do something about it, it doesn't
make any sense but I think for the safety of the people on Love Lane and I put myself in that
category because I am always there drinking their coffee. So maybe for selfish reasons I am
asking for the sign but at the end of the day, I mean, I really would ask the town to seriously
entertain having that sign reinstated. It is really important for the safety of the people. And so
have you thought some about it?
SUPERVISOR RUSSELL: Actually I just got an email today from a resident of Mattituck who
miffed at the rate of speed that an 18 wheeler was traveling just yesterday to cut through to get to
the North Road to continue east.

MS. DOM1NICI: We really need to do something about that, so I would respectfully request that
the Board take it under consideration seriously and maybe act on it. because what could it cost
us in dollars and cents to put that sign there? But a lawsuit could cost us a lot more, so I ask that
you do that. and lastly, the last time I was here since we talked about our water and how
precious a commodity it is and I mentioned about people who have sprinkler systems that go on
whether it is raining or not and is the town considering taking any action on trying to implement
you have to put on a monitoring system so that we can save what is left of our water? Are we
taking that under consideration or is...
SUPERVISOR RUSSELL: All of those things are subject to discussion as part of the natural
resources chapter of the comprehensive master plan.
MS. DOMINICI: Okay.
SUPERVISOR RUSSELL: Recommendations like that you should take go to the website and
forward those to the Planning Board and planning staff so they can evaluate those types of
recommendations. But that is how we plan on capturing a lot of those outstanding issues and
concerns that people have.
MS. DOM1NICI: Okay. Alright, thanks for your time.
SUPERVISOR RUSSELL: Okay. Thank you.
Robert Dunn, Peconic
ROBERT DUNN: Robert Dunn, Peconic. Just a little update on Mill Lane erosion thing. It
doesn't seem to be a hot button thing because we had a mild winter but it has continued and the
danger in, and it is continuous and I know we are working on the (inaudible) thing but the danger
and it is continuing is that part of the design, Jamie's design for the armament says that we have
to, the town has to stay above the high water mark. Well, as the erosion continues, the high
water mark gets closer and closer to the road, so time is kind of the essence there or we are going
to end up with the armament being on the road. That's kind of an exaggeration but at some
points it is gone in feet that the high water mark is getting closer to the road as each grain of sand
gets washed away.
SUPERVISOR RUSSELL: My understanding is, the permit we are still waiting from, I am
actually going to be, I have the opportunity to discuss the issue directly with the DEC tomorrow
at a meeting that is in Riverhead on another issue but I know the regional director Peter Scully
will be there and I was going to talk to him and his staff about...
MR. DUNN: I don't want to be nagging about it but I am just kind of giving you an update
what...

MR. DUNN: I know you guys don't have the time to go and look every little problem in the
town so I am bringing it to you. I am not at all nagging and I do know there is movement on it.
SUPERVISOR RUSSELL: It really shouldn't have taken us this long but I can't ....
MR. DUNN: But that's it, just to point out the consequences of time. The other thing that was
really the reason I came, I looked at two of the beaches today in addition to Goldsmith's by the
jetty. There are no cans out and I have made four trips to the dump along with one of my
neighbors. On Memorial Day we loaded up two pickup trucks, we have a pig in the
neighborhood that seems to think they don't need to go to the dumps, so they dump it at the
beach. But that there is no cans there, there is also a lot of other people, just to further address
the dog issue, people think, they do clean up. I am not going to say they don't, they clean up and
then they dump it where the can would be but is not. And some people have told me that the
Board has come up with the decision that the cans would be year round at one point, I don't
necessarily agree with that because I think in the winter they could become projectiles or end up
in the Sound but certainly I think the cans could be out by before Memorial Day. now Memorial
Day was the big day and a lot of people go to the beach and they left, they deposited their piles
of whatever where the can would be if it was there and it is not. More than that, it is really
disgusting to walk across from your house and see five or ten bags of the little bags that people
get for their dogs. It's just, you know, really the problem is with the birds when they decide they
are looking for a meal, they just tear everything up.
COUNCILMAN KRUPSKI: The problem is with the people leaving everything.
MR. DUNN: Well, that is the bigger problem, you have also got on Goldsmith's, opposed to the
other beaches, you have the fishermen, they come down with, they bring their dinner and from
takeout and they tie the bags, they pile it there and they are thinking they are being neat but the
birds don't care, they see a pile of bags and they go right through them.
COUNCILMAN KRUPSKI: They are not thinking that, they are thinking they are done with it
and they don't care.
MR. DUNN: They are thinking they are done.
COUNCILMAN KRUPSKI: They don't care.
MR. DUNN: But they don't think they are being dirty because someone is going to come and
clean up after them and that they have tied the bag, they have made an attempt.
COUNCILMAN KRUPSKI: They don't care, there is no attempt there. No.
MR. DUNN: And it's not, I don't want to just blame it on the fishermen, that's real handy, there
are people that use the beach that when they leave the beach at the end of the day they tie up
their bag and throw it where the can would be. So, I know it is not fair to the town to expect the
town to pick up after people but if the cans ....

SUPERVISOR RUSSELL: We are going to have to pickup anyway, might as well be in cans.
MR. DUNN: If the cans were there, people would use them. And maybe early in the season
they don't need to pick up every day like they do in July and August but if the cans were there,
people would use them and perhaps to pick up once a week or twice a week would make a
difference.
SUPERVISOR RUSSELL: I seem to think and I am not certain, that DPW puts the cans out
right before the official opening of the beaches which is the 23rd of June. It is generally the week
that kids graduate.
MR. DUNN: I understand that, that is actually the term, I went to Pete Harris' office. He wasn't
there but his secretary explained that but it just, that doesn't work.
SUPERVISOR RUSSELL: I agree.
MR. DUNN: I mean, I will be honest at one point it was my fault. Early on in May, there was
some driftwood on the beach and it had nails in it and stuff and I kind of stacked it up over there,
I wasn't going to the dump and I noticed two days later, somebody piled garbage bags on top of
it. so then I said, uh uh, we have got to do this and somebody else cleaned out a tire from the
beach, put it there and I took that to the dump because they were, the tire then became a
receptacle. And this has happened every weekend since the end of May. So it seems to me that
the cans need to go out earlier and I know, I checked to see maybe they just missed Goldsmith's
but none of the beaches have them. So I mean, we spent a lot of money this weekend on
overtime cleaning up from the beach cleanup but then we don't have cans out, so. Okay, thank
you.
SUPERVISOR RUSSELL: Thank you. Dan, before I go I am going to just ask anyone who
hasn't spoken yet and then we will go to round two after that.
Lynne Summers, Mattituck
LYNN SUMMERS: Lynn Summers, Mattituck. Last Friday I was doing some shopping on
Love Lane and I went to the crosswalk by Love Lane Kitchen to go across and all of a sudden I
see a black car, had to go 70 miles an hour, straight down Love Lane. 4:30 in the afternoon. It is
unnecessary, I feel badly for people visiting here, for protecting, I have lived here 42 years,
haven't had anything like that ever happen. It was very, very scary and we need to protect the
citizens and we need business down there to be done safely. So we either have to put signs or we
have to have more protection. I went looking for a cop, couldn't find one. I could tell you the
make of the car but I couldn't get the license plate. But this needs to be taken care of and soon
before something happens. Because it is happening earlier in the morning and at the end of
business of the day and I went back in the store down the street and I said have you noticed that
and business people have. So please do something. Thank you.

JIM DINIZIO: Jim Dinizio, Greenport. I read in the Suffolk Times a couple of weeks ago about
this water quality issue, the baykeeper came in, he wants to put better cesspools in and in the
Suffolk Times a friend of mine, a man that was on the Board that I am on Bob Villa, wrote a nice
article about the water authority and his health department and while I am no expert and I don't
pretend to be, his point was I thought that if it ain't broke, don't fix it. That, you know, you have
all you need to control your water quality with the laws that exist and you know, another
comment about how much more expensive it would be for, to put this types of systems in. that
they were requesting that you do. Now, my comment has nothing to do with any of that other
than I thought it was a good piece of common sense, that we have laws, we should abide by
those laws before we try to add more. And this is going to leave you to another piece of
common sense that I think is lacking and that is in land preservation. You know, it is nice that
you save farms, it is nice that you save vistas, I think that's a worthy cause. I think that in one
instance in Greenport at the end of 4th Street you have gone too far. That, there is a piece of land
down there, it is a couple of acres, not that big. Used to be a bunch of oil tanks on there, okay?.
Owned by Mobil since I was a little boy. Okay? I can remember playing down there. And it
has continued to be owned by Mobil and my point is owned and they paid their taxes diligently
every year. Now, my school district just went through a big thing with Orient, you.know, the big
scare was if Orient wants to send their children to another school closer, not closer but within a
distance, our school would probably have to close down because we don't have enough children
in our school from Greenport to make it happen. Most of our sports are made up of probably
only 25% Greenport kids and the rest of them are Mattituck, Southold, Shelter Island. The only
one is basketball. So, you know, it is a school that is struggling and to assist, for the town to
assist the Peconic Land Trust in letting them take that piece of property and take that $16,000 a
year from the school district, to my mind is a worthless endeavor. Mobil can never develop that
piece of land, it is useless to anybody. You can't sell it for a house, nobody is going to buy it if
they know there is oil tanks on there. And the people who mined it, Mobil Exxon, are the people
who own it. and they should pay until they can sell that land to somebody who will pay taxes.
Now, I say this because our district is infested with tax exempt pieces of property. Every time
you turn around, someone wants something from the Village or from the school district and I
will name you a few. One is Mitchell Park, used to be a thriving business there, a restaurant,
hotel, (inaudible) used to pay their taxes. We have three electric generators in our system, none
of them pay their fair share of taxes. Can you imagine what Shoreham Wading River would
have been like if that had happened there? Moore's Woods is entirely offthe tax rolls. There is
a passenger ferry now coming into Greenport, they are going to use a piece of land that is off the
tax rolls, Mitchell Park, and for their parking, they are going to use the school parking. Another
piece of land that is off the tax rolls. A business that my school district has to support with lack
of taxes. And then there is the library. I know the library is tax exempt, it is a nice thing to have
but it is in our district. We share that library with Orient and East Marion. They don't, they are
not hurt by the fact that four houses could be built on that lot paying taxes. They benefit from it
but they certainly don't have anything to do with it coming off the tax rolls. And last but not
least, the hospital. I thank god every day that hospital is there, I make my living there. But quite
honestly, it is on a prime piece of land that could be paying taxes, okay? I don't want you to
move the hospital, I think it is the greatest thing. But the entire town benefits from that and our
school district does not. So I am hoping that the next time, this is just a statement, it is really not,

I don't really want you to comment on it because it could go down a really deep hole but the next
time that Peconic Land Trust wants to take a piece of land off the tax rolls, could you just kind of
think is that really the road that you want to go down with that particular piece of property? We
are going to lose $16,000 simply because someone is going to sign a piece of paper, okay?
Nothing else is going to happen down there, it is not going to benefit anybody but maybe some
people will be able to walk on that piece of property once or twice a year. The only people that
are going to benefit is Peconic Land Trust because they are going to get a fee for maintaining
that. That fee comes out of the school coffers, so the next time this happens, could you please,
just think in that direction. I know you just took a farm off, the Pekunka farm. Good idea, it's in
a great location but how much does the school lose through that? could have been developed
maybe with a couple of houses that could have helped. We have this Kace development, that has
been going on for who knows how many years now? But quite honestly, if it had just been
annexed, the property and built, you would not have hurt the school district one bit. The kids
that would have been put in there would not have raised the taxes by, they were estimating
$16,000 per child. It doesn't work that way in Greenport. It may work that way someplace else
but in Greenport we don't have enough children in our school to make the school work. So I just
want you to know that there is somebody out here in the audience from Greenport that is a little
bit upset by the fact that you supported Exxon Mobil in relieving them of their duties from and
the responsibilities from taxes. Thank you very much.
SUPERVISOR RUSSELL: Would anybody else like to address the Town Board? Dan, did you
want to say something else?

MR. CATULLO: I just wanted to add something that the other fellow had said, at the end of
Bailic beach, they have the garbage buckets there and two days ago I went down there, I was
picking up some stuff and I threw it in, the same deal though. These bags arc there and they are
poked in and they are just a mess, people arc developing, I mean are delivering their own
garbage there and it is really a shame. I was wondering, they have these surveillance cameras
now at the red lights, the yellow/red light deal that is going on, is there any possibility, the
expense, I don't know what the price of those are but is it expensive to have a surveillance
camera alternating around perhaps? Where you could have some views of what this is?
UNIDENTIFIED: Inaudible.
MR. CATULLO: Yeah, monitoring? It is expensive. I didn't know.
COUNCILMAN KRUPSKI: You can get the game cameras and they are fairly inexpensive.
That is what it is going to come to.
UNIDENTIFIED: You can put a camera but then you have to pay someone to monitor it. I
think (inaudible) maybe change the law on dumping? That definitely, you would get a fine
(inaudible). It worked in the city, they were having a problem with contractors.
SUPERVISOR RUSSELL: We looked into the cameras as a means of trying to enforce it. the
problem was the enforceability in terms of court, if we don't have someone there taking a video,

there is no one there to attest to the authenticity of the video, identifying the culprit. There was a
host of legal issues that was presented. Plus the cost of the equipment was astronomical. But
certainly it is something we looked at, we have had some success on the trails using closed
circuit video. Again, not necessarily in prosecuting people but in getting people to know that we
know who you are and you need to stop in terms of that. but it is an ongoing problem. Again, if
you put two barrels out, enough garbage shows up that you need 4, if you put 4 out, you will
end up needing 8. It is a problem throughout the entire town and all of the public assets are
overly exploited by not just day trippers but by people who live in the community and find it
more convenient to dump their garbage in a big blue barrel. It is everywhere you go it is a huge
issue. We are getting into the garbage business as much as we don't want to be.
MR. CATULLO: All over the city, New York City, we got caught with one of the yellow/red
things and there was no big court deal going on with it, they just said we have got you and pay
the fine or else. So we did. And that was just for a minor infraction, going through a yellow and
red. It seems to me they can afford it to put these cameras in or even if you had one and two sort
of fakes that you could rotate around to keep people, if they see something up there, they are apt
to maybe say better not.
SUPERVISOR RUSSELL: I agree.
MR. CATULLO: Some kind of psychological warfare or something
