RE: Application for installation of a deer fence
Dear Mr. King: k~
Last Friday, April 18, 2008 when I came to Southold Town Hall to pic >ancy
for my house at 29315 Main Road, Orient, I passed by your office and was informed that there had been an
anonymous complaint from a neighbor of mine in regards to the installation of a deer fence on my waterfront, and
that ! must file an Application for this fence.
The following is a summary of the sequence of events regarding this issue. Back in February 2006 I requested
permission from you to install a deer fence which would be secured to the trees in the waterfront, as well as to the
natural boulders and rocks in the vicinity when the space between the trees was too long.
As you may recall, after approximately 1,300 linear feet of deer fence was completed, sometime in August 2006 1
informed you that practically the entire fence had been destroyed by natural breakage of some old black locust trees
as well as by accidental damage by the deers running on the steep slopes.
You were kind enough to come and inspect the damages personally. At that time we discussed trying to put another
test fence using the natural rocks on the top of the hill. The supports would be installed into the holes drilled in the
rocks without penetrating the soil. This was done as a sample for future approval; a copy of my contract for a
limited fence with Caso & Son, Co. signed in September 2007 is enclosed. Sometime in September 2007 1
informed you that a portion of the fence was done. We were to make arrangements for you to see it, with the hopes
that you'd approve of such to enclose the property, but this did not materialize.
Following my visit to your office on Friday, April 18, 2008, I've discussed the location of this fence with Mr. Doug
Adams at Young & Young. We will submit an Application and photographs of the incomplete fence, including the
survey map and location of the new fence which will hopefully be completed upon the approval of you and the
Boa~tees.

Fences, the Code and Wetland Setbacks
§ 111-10. Structural hazard area.
The following restrictions apply to regulated activities within structural hazard areas:
D. No movable structure may be located closer to the landward limit of a bluff than 25
feet.
BLUFF -- Any bank or cliff with a precipitous or steeply sloped face adjoining a beach or a
body of water. The waterward limit of a bluff is the landward limit of its waterward natural
protective feature. Where no beach is present, the waterward limit of a bluff is mean low water.
The landward limit is 25 feet landward of the receding edge or, in those cases where there is
no discernible line of active erosion, 25 feet landward of the point of inflection on the top of
the bluff. The "point of inflection" is that point along the top of the bluff where the trend of
the land slope changes to begin its descent to the shoreline.
No movable structure may be placed or constructed such that according to accepted
engineering practice, its weight places excessive groundloading on a bluff.
§ 275-11 Construction and operation standards.
General. The following standards are required for all operations within the jurisdiction of
the Trustees:

Fences. Trustees reserve the right to permit erection of a fence where the applicant has
shown that there is a need to protect his/her private property. In these rare cases, only
split-rail fences are allowed on beaches and wetlands. Such fences shall be perpendicular
to the waterline and not closer than 10 feet to MHW. Only one posted sign per 100 linear
feet of fence is allowed. Posted signs shall be no larger than 12 inches by 12 inches
square. Any fence, barricade or impediment to pedestrian traffic on the beach or wetland
area in violation of the provisions of this chapter shall be removed upon written notice to
the owner of the premises upon which such fence, barricade or impediment is located
sent by certified or registered mail. Such fence, barricade or impediment shall be
removed by the owner within 30 days of the date of the notice. Upon failure to comply
with such notice, the Building Inspector, Code Enforcement Officer or Bay Constable
may remove or cause the removal of the illegal structure. If any fence, barricade or
impediment is determined by the Building Inspector, Code Enforcement Officer or Bay
Constable to create a hazard to the health, safety or welfare of the public, such structure
may be removed and disposed of by the Town without prior notice to the owner. Upon
removal by the Town, all costs and expenses incurred by the Town for the removal of
such fence, barricade or impediment shall be the responsibility of the owner. The Town
may pursue any and all remedies available at law to recover any unpaid costs associated
with removal, including filing a statement with the Town Assessors, identifying the
property in connection with which such expenses were incurred and the owner thereof as
shown on the latest assessment roll of the Town. The Assessors, in preparation of the
next assessment roll, shall assess such amount upon such property. Such amount shall be
included in the levy against such property, shall constitute a lien and shall be collected
and enforced in the same manner, by the same proceedings, at the same time and under
the same penalty as is provided by law for the collection and enforcement of real property
