THIS INDENTURE, made the all sr- day of January, 1998 BETWEEN

TOGETHER with all right, title and interest, if any, of the parry of the first part in and to any streets and
roads abutting the above described premises to the center lines thereof.
TOGETHER with the appurtenances and all the estate and rights of the party of the first part in and to said
premises.
TO HAVE AND TO HOLD the premises herein granted unto the party of the second part, the heirs or
successors and assigns of the party of the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered anything
whereby the said premises have been incumbered in any way whatever, except as aforesaid.
AND THE party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party
of the first part will receive the consideration for this conveyance and will hold the right to receive such
consideration as a trust fund to be applied first for the purpose of paying the cost of the improvement, and
will apply the same first to the payment of the cost of the improvement before using any part of the total of
the same for any other purpose. 'rhe word "party" shall be construed as if it read "parties"whenever the
sense of this indenture so requires.

Southold, County of Suffolk and State of New York being more particularly bounded and described as
follows:
BEGINNING at a monument on the southerly side of Indian Neck Road at northwest corner of premises
herein described and the north east corner of land now or formerly of Levine, said monument also being
distant 759.06 feet easterly from Robinson Road;
RUNNING THENCE North 75 degrees 22 minutes 20 seconds East along southerly side of Indian Neck
Road 100.0 feet to a monument and land now or formerly of Kozlowsky;
THENCE South 24 degrees 42 minutes 20 seconds East along last mentioned land 1281.05 feet to the mean
high water mark of Peconic Bay;
RUNNING THENCE along the mean high water mark of Peconic Bay the following tie line course and
distance South 56 degrees 36 minutes 00 seconds West 99.60 feet to land now or formerly of Cohen;
THENCE North 24 degrees 42 minutes 20 seconds West along last mentioned land, land now or formerly of
Allen (formerly of Ross) and land now or formerly of Heather (formerly of Levine), 1313.61 feet to a
monument and the southerly side of Indian Neck Road at the point or place of BEGINNING.
BEING AND INTENDED TO BE the same premises conveyed to the parties of the first part by deed dated
November 23, 1986 recorded in the Office of the Clerk of the County of Suffolk on January 16, 1987 in
