party of the first part, and Gayle B. Wallace

party of the second part.
WITNESSETH, that the party of the first part, in consideration of Ten Dollars and other valuable
consideration paid by the party of the second part, does hereby grant and release unto the party of the
second part, the heirs or successors and assigns.of the party of the second part forever,
ALL that certain plot, piece or parcel of land, situate, lying and being at
Town of Southold, County of Suffolk and State of New York, bounded and described as follows:
BEGINNING at a point in the center line of a certain 20 foot right of way 215 feet easterly along said line from the
easterly line of Harbor Lane, said point being the northeasterly corner of land of George A. Brown and running thence
easterly along the center line of said right of way about 146 feet to land of Walsh; thence southerly along said land of
Walsh 69.12 feet to land now or formerly of Jacob Bowers; thence westerly along said land now or formerly of Jacob
Bowers about 146 feet to the land of George A. Brown; thence northerly along said land of George A. Brown 69.6 feet
to the point or place of BEGINNING.
TOGETHER with a right of way over said 20 foot right of way, the center line of which is the northerly line of the
premises herein described and the extension thereof westerly to said Harbor Lane and the entension thereof easterly
to Eugene's Creek
Being and intended to be the same premises conveyed by George A Brown and Patricia Brown, his wife to Gary C.
Brown and Gayle B. Wallace by deed dated August 26, 1998 and recorded on September 10, 1998 in Liber 11916,
page 192.
SAID PREMISES is known as Sec. 136, BIk. 1, Lot 4
TOGETHER with all right, title and interest, if any, of the party of the first in an to any streets and roads
abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances
and all the estate and rights of the party of the first part in and to said premises; TO HAVE AND TO
HOLD the premises herein granted unto the party of the second part, the heirs and successors and
assigns of the party of the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered anything
whereby the said premises have been encumbered in any way whatever, except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party
of the first part will receive the consideration for this conveyance and will hold the right to receive such
consideration as a trust fund to be applied first for the purpose of paying the cost of the improvement and
will apply the same first to the payment of the cost of the improvement before using any part of the totat
of the same for any other purpose.
The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so
requires.
