CLAPS and ALFRED CILETTI, the address of the partnership and the partners being 44655 County Road 48, P.O. Box 312, Southold, New York 11971, party of the first part, and V.A. Running thence along said land North 71 48' 10" East 1024.06 feet to land now or formerly of Dart; Running thence along said land the following two (2) courses and distances: (1) South 10 21' 50" East 50.47 feet; (2) South 09 37' 50" East 42.56 feet to the northerly side of Middle Road (C.R.48); Running thence along the northerly side of Middle Road South 67 06' 40' West 625.07 feet to land now or formerly of Batuyios first abovementioned; Running thence along land noworformerly of Batuyios thefollowing two(2)courses and distances: (1) North 22 53' 20" West 93.54 feet; (2) South 71 48' 10" West 388.36 feet to the point or place of BEGINNING. THE SAME being the premises conveyed to the party of the first part by deed from BCC RESTAURANT CORP. dated June 22, 1989 and recorded in the Suffolk County Clerk's office on July 6, 1989 in Liber 10889, page 533. TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and roads abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances and all the estate and rights of the party of the first part in and to said premises; TO HAVE AND TO HOLD the premises herein granted unto the party of the second part, the heirs or successors and assigns of the party of the second part forever. AND the party of the first part covenants that the party of the first part has not done or suffered anything whereby the said premises have been encumbered in any way whatever, except as aforesaid AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the first part will receive the consideration for this conveyance and will hold the right to receive such consideration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the same first to the payment of the cost of the improvements before using any part of the total of the same for any other purpose.
