THIS INDENTURE made the 3"b°~> day of December, Two Thousand Eleven
BETWEEN MICHAEL J. CAPPA and DONNA CAPPA, husband and wife, both residing at
455 Grove Drive, Southold, New York, party of the first part, and
/4~CHAEL J. CAPPA, II1, and TODD A. CAPPA, as Trustees of the Cappa Family Irrevocable
Living Trust, dated December ~q, ,2011, residing at 123 Brook Lane, Smithtown, New York
and 135 Brook Lane, Smithtown, New York, respectively, party of the second part,
WITNESSETH, that the party of the first part, in consideration of Ten Dollars and other
valuable consideration paid by the party of the second part, does hereby grant and release unto
the party of the second part, the heirs or successors and assigns of the party of the second part
forever,
ALL that. certain plot, piece or parcel of land, with the buildings and improvements thereon
erected, situate, lying and being in the Town of Southold, County of Suffolk and State of New
York, known as designated as Lot 22 and part of Lot 1 in Block G on a certain map entitled,
"Map of Reydon Shores, Inc." and filed in the Office of the Clerk of the County of Suffolk on
July 1, 1931 as Map No. 63 l, bounded and described as fo}lows:
BEGINNING at a point on the westerly side of Grove Drive, distant 179.70 feet southerly on
an irregular course bearing to the right from the comer formed by the imersection of the
southerly side of Lake Drive and the westerly side of Grove Drive;
RUNNING THENCE north 74 degree 00 minutes west 126.75 feet to a point;
THENCE south 16 degrees 00 minutes west 30 feet to a point;
THENCE north 74 degrees 00 minutes west 30 feet to the dividing line between lots 5 and 19
on the filed map;
THENCE along the easterly line of lot 19 south 16 degrees 00 minutes west 30 feet;
THENCE south 74 degrees 00 seconds east 150.10 feet to the westerly side of Grove Drive;
THENCE northerly along the westerly side of Grov6 Drive along an arc of a curve bearing to
the left having a radius of 3665.00 feet a distance of 60.38 feet to the point or place of
BEGINNING.
TOGETHER with the right to use for boating, bathing and fishing all that portion of beach lying
in front of Section A and B, as shown on said map, in common with Reydon Shores, Inc., and
with others who now have or may hereinafter acquire rights in the same~ s~bject, however, to
such reasonable roles and regulations with respect to the use thereof as Reydon Shores, Inc. may
from time to time put into effect. _ .....
TOGETHER with any right to the reasonable use and enjoyment of that portion of the inland
harbor owned by the said Reydon Shores, Inc. and to the use of a portion of the northerly line
of the bulkhead and to such other portions of said bulkhead as may be set aside in common with
other plot owners to date and others who may hereafter acquire title to land from Reydon
Shores, Inc. may from time to time put into effect, to being expressly understood that Reydon
Shores, Inc. shall not be held liable in any way whatsoever for any accidents or accident that
may occur in connection with the use and enjoyment of said bulkhead and harbor from any
cause whatsoever.
BEING AND INTENDED to be the same premises described in deed to the party of the first
part dated, September 25, 2000, and recorded in the Suffolk County Clerk's Office on October
3, 2000, in Liber 12075, at Page 293.
SAID PREMISES ARE KNOWN AS: 455 Grove Drive, Southold, New York.
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any
streets and roads abutting the above described premises to the center lines thereof;
TOGETHER with the appurtenances and all the estate and rights of the party of the first part
in and to said premises; TO HAVE AND TO HOLD the premises herein granted unto the party
of the second part, the heirs or successors and assigns of the parc of the second part forever,
AND the party of the first part covenants that the party of the first part has not done or suffered
anything whereby the said premises have been encumbered in any way whatever, except as
aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that
the party of the first part will receive the consideration for this conveyance and will hold the
right to receive such consideration as a trust fund to be applied first for the purpose of paying
the cost of the improvement and will apply the same first to the payment of the cost of the
improvement before using any part of the total of the same for any other purpose.
The word "party" shall be construed as if it read "parties" whenever the sense of this indenture
so requires.
IN WITNESS WHEREOF, the party of the first part has duly executed this deed the day and
year first above written.
