dated February 9, 2012, MARILYN H. DUNN, residing at 1530 Boisseau Avenue,
Southold, New York 11971 and MICHAEL P. HAGERMAN, residing at 4115 Soundview
Avenue, Southold, New York 11971 as Co-Trustees
party of the second part
WITNESSETH, that the party of the first part, in consideration of Ten Dollars and other
valuable consideration paid by the party of the second part, does hereby grant and release
unto the party of the second part, the heirs or successors and assigns of the party of the
second part forever,
SEE ATTACHED DESCRIPTION OF PROPERTY
AND ALSO SCHEDULE "A" SETTING FORTH COVENANTS AND
RESTRICTIONS APPLICABLE THERETO,
ALL ATTACHED HERETO
AND MADE A PART HEREOF
BEING AND INTENDED TO BE the same premises conveyed to the Grantor by Deed
dated February 4, 2010 and recorded in the Suffolk County Clerk's Office on February 5,
2010 in Liber D00012515 page 666.
Together with all right, title and interest, if any, of the party of the first part in and to any
streets and roads abutting the above-described premises to the center lines thereof;
Together with the appurtenances and all the estate and rights of the party of the first part in
and to said premises;
To have and to hold the premises herein granted unto the party of the second part, the heirs
' or successors and assigns of the party of the second part forever.
And the party of the first part covenants that the party of the first part has not done or
suffered anything whereby the said premises have been encumbered in any way whatever,
except as aforesaid.
And the party of the first part, in compliance with Section 13 of the Lien Law, covenants
that the party of the first part will receive the consideration for this conveyance and will
hold the right to receive such consideration as a trust fund to be applied first for the purpose
of paying the cost of improvement and will apply the same first to the payment of the cost
of the improvement before using any part of the total of the same for any other purpose.
The word "party" shall be c,onstrue.d as if it read "parties" whenever the sense of this
indenture so requires.

ALL that tract, piece or parcel of land situate, lying and being at Pine Neck, near Southold, in the
Town of Southold, County of Suffolk and State of New York, and more particularly bounded and
described as follows:
BEGINNING at a point on the easterly line of a proposed highway to be known as "Park Way",
671.46 feet southerly along said easterly line from the southerly line of Pine Neck Road, being the
northwesterly comer of the premises; and running along other land of the party of the first part (Lot
"36"), North 78 degrees 08 minutes 40 seconds East - 221.74 feet;
THENCE still along other land of the party of the first part (Lots "48" & "47), South 13 degrees 09
minutes 40 seconds East - 131.75 feet;
THENCE along land conveyed, or about to be conveyed, by the party of the first part to Chester
Albenson (Lot "36"), South 65 degrees 20 minutes 20 seconds West - 194.52 feet to the
northeasterly line of said "Park Way";
THENCE along said northeasterly line of "Park Way", 2 courses as follows:
(1) North 39 degrees 53 minutes 30 seconds West - 52.0 feet; thence
(2) on a curve to the right having a radius of 163,34 feet, a distance of 133.01 feet to the point of
BEGINNING.
TOGETHER with all right, title and interest, if any, of the party of the first part in and to the
highways in front of and adjacent to said premises to the centerline thereof.
SAID PREMISES for the purpose of identification only are being and intended to be Lot #37 on a
certain map entitled, "Map of Southwood at Southold, New York:, made by Otto Van Tuyl & Son,
Licensed Land Surveyors, Greenport, New York, dated May Ist, 1953, which map is herein referred
to for the purpose of identification only and which map is intended to be filed in the Suffolk County
Clerk's Officer
SUBJECT to such state of facts as a more accurate survey may show provided the same does not
render the title thereto unmarketable.
SUBJECT to such state of facts as a personal inspection there may disclose.
SUBJECT to the following covenants and restrictions (see Schedule "A" hereto attached).

The entire premises as shown upon a certain unfiled map entitled, "Map of Southwood at Southo~f~tI!.ew
York,". made by Otto W. Van Tuyl & Son, Licensed Lend Surveyors, Greenport, New York, dated ~ 1st,
1953, including the lots being conveyed hereunder and including other Ianfls of the party of the first part as
shown on said unfiled map (which map is herein referred to for the pttrpose of identification only and which
map is intended to be filed in the Suffolk County Clerk's Office) shall be subject to the following cov-
enants and restrictions:-
1. That only one single family dwelling house, for private residential 'purposes, and a private garage,
for family use, shall be built on any lot as shown on said Map. Ne trailers, tents or camping shall be per-
mitted and no occupancy of any such dwelling house shall be permitted until the outside and roof shall be
fully and completely finished and painted.
2. That no building, structure or structures on, above or below the surtace, ether than public utility
pipes or lines, shall be erected, constructed or maintained within forty' (40) feet of any lane, highway or
road as shown upon said Map, except that as to lots numbered i to 5 inclusive the set back shall be thirty-
five (35) feet, and as to lots numbered 32 and 33 the set back ~hall also be thirty-five (35) feet.
3. That no building, structure or structures on, above or below the surface, other than public utility
pipes or lines, shall be erected, constructed or maintained within ten (10) feet of sidelines boundaries and
within five (5) feet o£ the rear lines of said lots as shown upon said Map.
4. That no building, structure or structures shall be erected, constructed or maintained at a height in
excess o£ one and a half stories, and that all roofs shall be of the hip, gable or pitch roof type construc-
tion. Buildings sbail be erected on closed foundations of poured concrete or concrete blocks, and no build-
ings on posts shall be permitted. No flat roofs or lean to roofs shall be permitted.
5. That no dwelling house, exclusive of garage, shall be erected or constructed on any lot shown upon
said Map which shall cost less than $8,000.00 ~contain less than 1,000 square feet on the ground floor. All
roofs shall be of asbestos, cedar or composition shingle and no roof shall be laid down with rolled roofing.
Ail plans and specifications shall be subject to the approval of the party of the first part, in writing.
6. Ilo trade, craft, business, manufacture, industry, commerce or profession (medical and dental pro-
fesaion permitted) including hotels, boarding and rooming houses, shall be conducted en any lot on said prom-
lses as shown on said leap.
?. No fences shall be permitted along any roadway or lane as shown upon said Map. Open type or hedge
fences shall be permitted along the sidelines of said lots as shown upon said Map and shall not exceed three
(3) feet in height or six (6) feet in height along the rear lines thereof.
8. No nuisances and noises of any kind, unwholesome and offensive to the neighborhood, shall be per-
mitred to exist on any lot shown on enid Map, nor shall any accumulation of rubbish, garbage, junk or
materials of any kind he permitted to remain on any of said lots. No advertising signs, billboards or other
sign devices shall be permitted on any of said lots, excepting a developer's sign or a "FOR SALE" or "FOIl
RENT" sign of reasonable dimensions. Lot owners shall cut the grass and keep the appearance of the
lots in accordance with' the standard of the community. No outside clothes lines shall be permitted except cir-
cniar umbrella type clothes dryers.
9. No fowl, poultry, animals or livestock shall be kept on any of said lots, except domestic household
pets.
10. There shall be no outside toilets or outhouses erected upon any of said lots. An adequate septic tank
or cesspool shall be erected and maintained to take care of the sewage disposal at each dwelling erected
upon any of said lots, and the same shail.be of such design and construction as may be approved by the
Suffolk County Health Department.
· 11. Each of said lots as shown upon said Map shall be subject to electric, electric light, gas, and
telephone easements on the surface or below the surface along the roadway or lane adjacent te each of
said lots. and alor~ the easterly line of the premises herein convayedo
12. No sand, earth or sod shall be removed from the premises, or excavation be allowed to remain open
thereon, except as may be necessary' at such times aa building or landscaping operations are in progress.
13. The said covenants and restrictions are hereby declared to be covenants and restrictions attached to
and rUnning with th~ land. That .such covenants and restrictions, are to rhn /or a period of ten (10) years
