EXERCISE OF POWER OF APPOINTMENT
UNDER INDENTURE DATED JULY 7, 19,,.917
WHEREAS, by Indenture dated July7, 1997 (the "Deed"), I, Jean O. Hogan, transferred
title to the real property and residence known as 230 Dogwood Lane, East Marion NY 11939
(the "Property"), more particularly described on Exhibit "A" attached hereto, to my children,
Nancy H. Oetinger. Richard R. Hogan, and Lee C. Hogan, as Jo!nt tenants with the right of
ERE^s, the Deed is su%ct to the life ,sc oc up Cy of the Property by me and
by my husband, Robert F. Hogan, or the survivOr; and
WHEREAS, under the Deed I reserved a special power of appointment, exercisable as
often as I may choose, to change the remainderman to or among any one or more members of a
class consisting of my descendants, in any degree, whether presently living or bom hereafter, in
such proportions and amounts, without regard to equality, outright ofin trust, as I may direct and
appoint during my lifetime by a properly written and acknowledged ihstrument, and recorded
prior to my death, making specific reference to this power of appointment; provided that I may
not appoint to myself, my estate, my creditors or the creditors of my estate, under any
circumstances; and
WHEREAS, I wish to exercise my special power of appointment and change the
remaindermen to my daughter, Nancy H. Oetinger, outright.
NOW THEREFORE, Reserving the further right to exercise my special power of
appointment under Indenture dated July7, 1997 and change the remaindermen. I hereby exercise
said special power of appointment and change the remainderman to my daughter, Nancy H.
Oetinger, outright.

ALL THAT CERTAIN plot, piece or parcel of land, with the buildings and improvements
thereon erected, situate, lying and being at East Marion, in the Town of Southotd, County of
Suffolk, State of New York, which plot is known as and by the lots numbered one hundred two
(I02) and one hundred three (103) as shown on a map entitled "Map of Section Two Gardener's
Bay Estates, situate at East Marion, Long Island", which map was filed in Suffolk County
Clerk's Office on September 23, 1927, under the number 275.
THIS DEED IS SUBJECT to the life use and occupancy of the premises by the Jean O. Hogan
and Robert F. Hogan, husband and wife, residing at 501 Plush Mill Rd, Apt. 202, Wallingford
PA 19086, or the survivor(s) of said Grantee's.
WHEREAS, Jean O. Hogan hereby reserves a Special Power of Appointment, exercisable as
often as she may choose, to change the remaindermen as follows: to or among any one or more
members of a class consisting of Jean O. Hogan's descendants, in any degree, whether presently
living or born hereafter, in such proportion and amounts, without regard to equality, outright or
in trust, as Jean O. Hogan may direct and appoint during her lifetime by a properly written and
acknowledged instrument, and recorded prior to death, making specific reference to this power
of appointment. Jean O. Hogan may not appoint herself, her estate, her creditors or the creditors
of her estate, under any circumstances, and
BEING and intended to be the same premises conveyed to the party of the first part by Deed
dated 7/19/86 and recorded on 7/29/86 at the Office of the Suffolk County Clerk in Liber 10088
CP363.
TOGETHER with all right, title and interest, if any, of the Grantor in and to any streets and
roads abutting the above described premises to the center lines thereof; TOGETHER with the
appurtenances and all the estate and rights of the Grantor in and to said premises herein granted
unto Grantee, and Grantee's heirs or successors and assigns forever; TO HAVE AND TO
HOLD the premises herein granted unto the Grantee and Grantee's heirs, successors and assigns
forever.
