SCTM#1000-36~l-1 PROPERTY LOCATION: 1410 Manhasset Ave. (adj. to Sterling Creek and Sterling Basin) Greenport NY SEQRA DETERMiNATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without further steps under SEQRA. SUFFOLK COUNTY ADMiNISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply dated July 17, 2012 stating that this application is considered a matter for local determination as them appears to be no significant county-wide or inter-community impact. LWRP DETERMiNATION: This application was referred for review under Chapter 268, Waterfront Consistency review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. The LWRP Coordinator issued a recommendation dated July 24, 2012. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to us, it is our recommendation that the proposed action is CONSISTENT with LWRP policy standards and therefore is CONSISTENT with the LWRP. PROPERTY FACTS/DESCRIPTION: Subject parcel contains 9.92 acres and is located in a MII zone. It is improved with four framed buildings, metal boat storage building, a shed, a plastic building, an in-ground swimming pool, a restaurant and 145 boat slips with 6 large floating wood docks and associated parking area for this boat marina. It has 648.70 feet of frontage on Manhasset Avenue and a portion of the property is located in the Village of Greenport. BASIS OF APPLICATION: Request for Variance from Article XXII Code Section 280-116(B) based on an application for building permit and the Building Inspector's May 24, 2012 Notice of Disapproval concerning a building permit to demolish and construct a boat storage and office/storage building, at; 1) proposed structures at less than the code required bulkhead setback of 75 feet. RELIEF REQUESTED: The applicant requests variances to demolish existing boat storage building, and two other accessory building and construct in place and in kind a new boat storage and office/storage building with setbacks of 48.5 feet and 3 feet from the existing bulkhead, where the code requires a 75 foot bulkhead setback. ADDITIONAL iNFORMATION: This Board requested comments from the Planning Board. In a memo dated July 24, 2012, the Planning Board states, they generally have no objection as this property has historically been used for boat storage and a marina. Additionally, this proposal would further the goal of the Town's Comprehensive Plan to enhance the Town's waterfront while maintaining its fundamental characteristics. CTM: 1000-36-1-1 FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on August 2, 2012 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence, the Zoning Board finds the following facts to be true and relevant and makes the following findings: l. Town Law §267-b(3)(b}(1). Grant of the variances will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties because the applicant proposes to replace the existing structure with a new more code compliant building of similar size utilizing the same footprint. Additionally, the applicant is proposing to replace the existing docks and bulkhead while the existing building is being replaced. 2. Town Law §267-b(3)(b){2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The building location was chosen many years ago to allow for travel lilts to maneuver about the property, in order to conduct the business of storage and maintenance of large boats. The benefit of the variance would allow the applicant to continue to do business. 3. Town Law §267-b(3)(b)(3). The variance granted herein is mathematically substantial, representing nearly 100% relief from the code. However, the applicant is proposing, only, to replace the build within the same footprint. In addition there does not appear to be another location on this property that could accommodate a building of this size without the need for even more severe relief from the code. 4. Town Law §267-b(3)(b)(4) No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The neighborhood consist of mixed uses including residential, another boat yard, two restaurants and two cemeteries all of which have co-existed for many years. The parcel in question is zoned Marine II and the structure proposed is an allowable use within the MII Zone. As noted in the LWRP report, the improvement of the boat storage building with attached two story office/storage building (water enhanced use) supports policy number 10.1 (b) which entails improving the economic viability of water dependent uses. 5. Town Law §267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law §267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a new boat storage and office/storage building while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Dinizio, seconded by Member Weisman, Chairperson, and duly carried, to GRANT~ the variance as applied for, and shown on the site plan prepared by Condon Engineering P.C. and dated 03/31/2012 CONDITIONS: 1. Site Plan approval from the Planning Board is required Any deviation from the survey, site plan and/or architectural drawings cited in this decision will result in delays and/or a possible denial by the Building Department of a building permit, and may require a new application and public hearing before the Zoning Board of Appeals. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setback~ and other.features as are expressly addressed in this action. The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity. Located at 1410 Manhasset Avenue, Greenport SCTM#1000-36-1-1 ZBA#6581 The Planning Board has reviewed the requested variances to construct the proposed boat storage and office buildings less than 75' from an existing bulkhead (+48.5' & +3') and generally has no objection. The subject parcel is zoned Marine-Il (M-II) and is located in Greenport where the proposed uses of a marina are consistent with the Town Code and the Town's Comprehensive Plan. The proposed boat storage building and office appear to not cause concern since the proposed area has historically been used for boat storage and a marina. The above-referenced proposals would further the goal of the Town's Comprehensive Plan to enhance the Town's waterfront while maintaining its fundamental characteristics. Thank you for this opportunity to provide comments. I was out to all sites yesterday. Other than increasing the width of the buffers, prohibiting the application of fertilizers, herbicides and pesticides on Flahej~ -they had a really green lawn in sod.., there is not much in water quality protection we~an do. The storm water controls are sufficient; however, I was concerned about locating a drywell (north of residence) in Flood Zone AE 6. I recommend that the one dry weir be located outside of this flood zone if possible. I could not pick up the water line on the survey in relation to the drywells. The BOT should clarify this. As I discussed in the review the BOT created a 15' buffer in the east of the property against the bulkhead, but I recommend that due to the sensitivity of the parcel/area that the buffer is expanded to include all vegetated areas that occur to the north and south (basically all vegetation adjacent to the water bodies). The increase in buffer sizes reduces the areas in lawn, hence irrigation application of fertilizers, herbicides or pesticides. It also provides nutrient filtration (depending on density and composition of plants) and bacteria containment. ~ the BOT originally created a 15' buffer but then reduced it to 10' in the final permit (I agent and they did not know why). The property is proposed to be filled and the house elevated to flood zone requirements. A concern is how the fill will affect the adjacent property to the northeast. A wall is noted with 5.9' elevation but the Board should have their engineer verify that afl storm water will be contained on-site. Storm water controls are proposed. The property has enough room for a 15' buffer, however, in this instance I took in consideration the vegetation that they were proposing so I did not recommend an increase. Duetothe environmentalsensitivity ofthecreek and extreme low depth to groundwater the prohibition of fertilizers, herbicides and pesticides in the lawn area would also further the LWRP policies, but I wanted to discuss with that with Leslie before I proposed the BMP. The other way to go rather than prohibit the application of fertilizers is for homeowners to use no more than 1 lb NIl000 sq. ft. per year. This BMP will be in the comp plan. The proposal, as designed, will not result in adverse effects to the surrounding environment in that the project will not increase the structural coverage of the property, and will not encroach any further towards the surface waters of Sterling Creek along the western shoreline. In addition, this commercial marina has existed harmoniously within this location for decades which has not resulted in any form of adverse impact to the surrounding environment. Accordingly, we believe that this project is consistent with this policy. With respect to the proposed reconstruction of the proposed bulkhead and dockage: Subject proposal is consistent with the policy in that the siting/utilization of the reconstructed dock assembly and siting/utilization of the proposed reconstructed/reconfigured bulkhead will maintain the character of the surrounding area, which currently consists of other commercial marinas as well as many residential lots with similar structures (i.e. dock assemblies and bulkheading along Sterling Creek). In addition, subject proposal will be in harmony with the "... beneficial use of a coastal location...' in that this lawfully created & operated Commercial Marina will be enhanced by the reconstructed dock assembly and bulkheading.
