SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply dated July 17, 2012 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: The relief, permit, or interpretation requested in this application is listed under the Minor Actions exempt list and is not subject to review under Chapter 268. PROPERTY FACTS/DESCRIPTION: The subject parcel is 74,349 square feet. It is improved with a two story dwelling. It has 185 feet of frontage along an access R.O.W. from the Main Road at its westerly property line, 347.66 feet along its southern property line, 180.35 feet and 70.85 feet (two courses) along its rear easterly property lines and 151.35 feet and 267.98 feet (two courses) along its northerly property lines, as shown on the survey prepared by Joseph A. Ingegno, L.S., dated September 23, 1999, revised January 6, 2003. The parcel has wetlands located in the rear of the property. BASIS OF APPLICATION: Request for Variance from Article III Code Section 280-15 based on an application for building permit and the Building Inspector's May 15, 2012 Notice of Disapproval concerning permit to construct accessory garage, at: 1) accessory garage will be located in other than the code required rear yard. RELIEF REQUESTED: The applicant requests variances to construct a detached accessory garage in a side yard and partially in a front yard, where the code requires accessory structures to be located in the rear yard. ADDITIONAL INFORMATION: The adjoining property owner to the north, at the public hearing, did not express an objection to the proposed location. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on August 2, 2012, at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property Page 2 of 3 - August 16, 2012 ZBA File#6584 - McDonough/Hook¢ CTM: 1000-18-6-21.8 and surrounding neighborhood, and other evidence, the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law §267-b(3)(b)(1). Grant of the requested variances will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. Accessory garages ave characteristic of improved residential parcels and there was no evidence presented that the use of an accessory garage in the proposed location would cause a detriment to the nearby properties. 2. Town Law §267-b(3)(b)(2). The benefit sought by the applicant can be achieved by some method, feasible for the applicant to pursue, other than an area variance. The applicant could construct the garage as an addition to the existing dwelling or place it in a rear yard location. However, a northerly rear yard location may cause harm to the existing septic system from vehicular traffic riding over septic system piping and a southerly rear yard location would require a redesign and long extension of the driveway. 3. Town Law §267-b(3)(b)(3). The variance granted herein are mathematically substantial, representing 100% relief from the code. However, there is existing vegetation that will screen most of the proposed accessory garage from the adjoining property owner to the north, this adjoining property owner presumably being most affected by the proposed location. 4. Town Law §267-b(3)(b)(4) No evidence has been submitted to suggest that the requested variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 5. Town Law §267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law §267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of an accessory garage located in a side yard and partially in a front yard, while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Schneider, seconded by Member Goehringer, and duly carried, to GRANT, the variances as applied for, and shown on the architectural plans entitled Site Plan, dated 7/3/12 and the Plan and Elevations, sheets 1,2 and 3 dated 4/20/12, all prepared by Elizabeth Thompson, RA. Any deviation from the survey, site plan and/or architectural drawings cited in this decision will result in delays and/or a possible denial by the Building Department ora building permit, and may require a new application and public hearing before the Zoning Board of Appeals. Any deviation from the variance(s) granted herein as shown on the architectural drawings, site plan and/or survey cited above, such as alterations, extensions, or demolitions, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. McDonough & H. Hooke garage REASONS FOR APPEAl,: 1. BOARD OF APPEALS There are many other garages in the area similar to our proposed garage, next to the house and connected by a breezeway, in our case, a pergola. Our proposed garage is confirming in all other aspects. The proposed garage, porch and pergola will enhance the appearance of the property and the neighborhood. We live on a private Road, so the garage will not be visible on the Main Road. This proposal is the most feasible because: a. Following the line parallel to the rear property line from the back corner of the house would require the garage to be behind the septic system. This would mean the driveway would have to go over the sewer pipes connecting the septic tank to the leaching pools. We have experience (at a different house) with the sewer pipe being broken because of being driven over. b. The average rear property line is at an odd angle, again away from the road, and down the hill toward the wetland. The house was angled toward the sun to maximize the efficiency of the solar panels. (Because the panels are efficient, the house has no electric bill and thus less carbon emissions, making it environmentally advantageous for the town.) Because of the angle of the house facing the sun, the rear comer of the house is farther back than it would be if the house were parallel to the road. c. If the garage were in the rear yard behind the septic system, it would create a hardship because it would be: i. On much lower ground, causing water to drain down the property into the garage. ii. 60 feet further from the house (we measured) which would have to be plowed in winter iii. 60 feet further from the house which would mean a 60 foot uphill walk to the house. d. A garage attached to the house would be a hardship because: i. It would put the garden that is now behind the house completely in the shade. ii. We have made a considerable investment in the garden. We have many native plants and plants unusual to Orient that we got from the New England Wildflower Society that are unusual to Orient, bird friendly, and are in our garden. They require a sunny location and the shade of the garage would be harmful to them. iii. The property is very large, so the greater distance between the house and garage is more appropriate for the lot and scale of the property iv. The pergola will have plants growing on it, and create a pleasing connection between the front yard and back yard landscaping A garage to the East of the house would be a hardship because: i. we have a vegetable garden in that location ii. The rear yard location on the East Side would require a VERY long driveway to plow in winter, and again it would be downhill toward the wetland iii. We would rather keep cars and oil away from our well, which is right down the hill from the East location because of possible pollution ,, . BO~,.qD OF APPEALS iv. This East location is even a longer walk to the porch muaroom door on the West Side of the house that we use as our main entrance to the house, and which we have connecting to our proposed location, as there is no entry on the east side of our house. The request is substantial, however, it is mitigated by the fact this is a private road, the garage will not be visible from Main Road, it has the least impact on our neighbors and least amount of land disturbance. The property is large compared to the house and garage. Setbacks from front, rear and side yards are very large and greater than required minimums. Keeping the garage on the higher ground reduces any physical or environmental impacts, it places the garage away from the wetlands and outside of the jurisdiction of any wetland agencies. As stated in #3, setbacks are all large. The proposed construction is in scale with the size of the lot, and as in #1 will enhance the appearance of the property and the neighborhood. The neighbor on the West Side is very far away and there would be no impact on him. All storm water will be retained onsite as per town code. Yes. Because we designed the whole house around the solar panels so it would be an environmentally efficient house, it is at an angle other than parallel to the road. Placing the garage in the usual position in relation to the house and parallel to it places it in a location not in the required rear yard. We plan in the future to put solar panels on the roof of the garage when the technology for hybrid cars is better, so we can charge our car from the roof of the garage. Because of this, we want to maintain the same angle to the sun as the house.
