SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply dated July 17, 2012 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: This application was referred for review under Chapter 268, Waterfront Consistency review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. The LWRP Coordinator issued a recommendation dated July 24, 2012. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to us, it is our recommendation that the proposed action is CONSISTENT with LWRP policy standards and therefore is CONSISTENT with the LWRP. PROPERTY FACTS/DESCRIPTION: Subject parcel is improved with a one story frame house located on Beachwood Road (a Private Road). It has 72.99 feet of frontage on Beachwood Road, 196.51 feet along the east property line, 149.37 bulkhead on Great Peconic Bay and 222.39 feet on the western property line (which consists of mostly wetlands) in the R40 zone district as shown on the survey dated October 18, 2011 last revised June 12, 2012 prepared by John T. Metzger, Peconic Surveyors, PC. BASIS OF APPLICATION: Request for Variances from Article XXII Code Section 280-1t6(B) and Article XXlll Section 280-124 based on an application for building permit and the Building Inspector's June 21, 2012 Notice of Disapproval for demolition and reconstruction of single family dwelling, at; 1) less than the code required bulkhead setback of 75 feet, 2) less than the code required minimum side yard setback of 15 feet, 3) less than the code required rear yard setback of 50 feet. RELIEF REQUESTED: The applicant requests variances to demolish and reconstruct a single family dwelling with a bulkhead setback of 37 feet in the side yard and 45 feet in the rear yard where the code requires a bulkhead setback of 75 feet. Additionally, applicant requests a minimum side yard of 12.7 feet where the code requires 15 feet and a rear yard setback of 45 feet where the code requires 50 feet. Page 2 of 3 - August 16, 2012 ZBA Fileg6585 - Gaylord FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on August 2, 2012 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence, the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law §267-b{3)(b)(1). Grant of the variances will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The applicant proposes to remove an existing two car garage with a non-conforming setback from the road. This action will greatly improve the streetscape for the entire neighborhood. In addition, the work to be completed on the house will only minimally increase the footprint by squaring offa portion on the building and adding new decks and entry ways. 2. Town Law §267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance because any expansion of the house will require a variance due to it's proximity to the wetlands. 3. Town Law §267-bO)(b)(3). The variances granted herein are mathematically substantial, representing approximately 50% relief from the code at its most severe measurement. However, none of the existing setbacks of the house will be decreased and the front yard non-conforming setback will be eliminated after removal of the garage. 4. Town Law §267-bO)(b)(4) No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code and has submitted a plan to comply with all current drainage and run off which will greatly improve the conditions that's currently exist on the property. Additionally, the Southold Town Trustees required the establishment of a naturally vegetated 10 foot wide, non-turf vegetated, buffer landward of the bulkhead under permit #7765. The applicant will be required to conform to the recommendations of the LWRP memorandum. 5. Town Law §267-bO)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of pumhase. 6. Town Law §267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a new dwelling while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Dinizio, seconded by Member Goehringer, and duly carried, to GRANT, the variances as applied for, and shown on the Survey prepared by Peconic Surveyors P.C. and dated June 12, 2012 CONDITION: 1. The application of fertilizer, herbicides and pesticides on the lawn area is prohibited. That the above conditions be written into the Building Inspector's Certificate of Occupancy, when issued. SCTM#1000-116-4-20.1 The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my determination that the proposed action is CONSISTENT with the below listed LWRP polices and therefore CONSISTENT with the LWRP. 4. I Minimize losses of human life and structures from flooding and erosion hazards. The following management measures to minimize losses of human life and structures from flooding and erosion hazards are suggested: Minimize potential loss and damage by locating development and structures away from flooding and erosion hazards. Move existing development and structures as far away from flooding and erosion hazards as practica/. Maintaining existing development and structures in hazard areas may be warranted for: a. structures which functionally require a location on the coast or in coastal waters. b. water-dependent uses which cannot avoid exposure to hazards. c. sites in areas with extensive public investment, public infrastructure, or major public facilities. c. sites where relocation of an existing structure is not practical Due to the partial demolition of the existing structure, lot configuration and environmental sensitivity; relocation of the existing residential structure is not practical. The structure is located within an AE El 6 Flood Zone and the applicant proposed to raise the grade of the site and elevate the structure to reduce potential impacts from flood hazards. The Board of Trustees required the establishment of a naturally vegetated 10' wide, non- turf vegetated, buffer landward of the bulkhead under Permit No 7765 issued on March 12, 2012. Additional Recommendations: 1. Due to the environmental sensitivity of the parcel and water body- it is recommended that the Board consider prohibiting the application of fertilizer, herbicide and pesticide on the lawn area. Pursuant to Chapter 268, the Board shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action. Other than increasing the width of the buffers, prohibiting the application of fertilizers, herbicides and pesticides on Flaher~¥ -they had a really green lawn in sod.., there is not much in water quality protection we~n do. The storm water controls are sufficient; however, I was concerned about locating a drywell (north of residence) in Flood Zone AE 6. I recommend that the one dry well be located outside of this flood zone if possible. I could not pick up the water line on the survey in relation to the drywells. The BOT should clarify this. As I discussed in the review the BOT created a 15' buffer in the east of the property against the bulkhead, but I recommend that due to the sensitivity of the pareel/area that the buffer is expanded to include all vegetated areas that occur to the north and south (basically all vegetation adjacent to the water bodies). The increase in buffer sizes reduces the areas in lawn, hence irrigation application of fertilizers, herbicides or pesticides, it also provides nutrient filtration (depending on density and composition of plants) and bacteria containment. ~; the BOT originally created a 15' buffer but then reduced it to 10' in the final permit (I agent and they did not know why). The property is proposed to be filled and the house elevated to flood zone requirements. A concern is how the fill will affect the adjacent property to the northeast. A wall is noted with 5.9' elevation but the Board should have their engineer verify that all storm water will be contained on-site. Storm water controls are proposed. The property has enough room for a 15' buffer, however, in this instance I took in consideration the vegetation that they were proposing so I did not recommend an increase. Due to the environmental sensitivity ofthe creek and extreme Iow depth to groundwater the prohibition of fertilizers, herbicides and pesticides in the lawn area would also further the LWRP policies, but I wanted to discuss with that with Leslie before I proposed the BMP. The other way to go rather than prohibit the application of fertilizers is for homeowners to use no more than 1 lb NIl000 sq. ff. per year. This BMP will be in the comp plan. Has the ZBA placed such restrictions on sensitive properties in the past? I had no large concerns other than storm water control on Brewers.
