Dear Vic:
Enclosed please find an application for a building permit for the
erection of a canopy at the Mattituck Mobil station and a second
pump island which is to be located between the existing island
the main building.
We are requesting that partial self-s__~erviq~ use be granted to the
existing pump island and the northerly side of the proposed
island with full-service to be offered on the southerly side of
the southerly island. In addition, self-service is requested for
the proposed diesel and kerosene pumps.
The owners would like to pave an area along the back of the
existing building approximately 20 feet in width to ease ingress
and egress of tankers making delivery.
Finally, renovations are proposed for tne existing building to
facilitate the retail sale of items similar to those offered at
the Route 48 Mobil station in Peconic. These renovations are
primarily cosmetic, i.e. new tile floor and a suspended ceiling.
I will get a more detailed description of the proposed work so
that the proper building permit can be obtained if necessary.
Please advise~ an application to New York is necessary
for
the
proposed construction which is. located on the state road. Also
advise if a building permit is required for the replacement of
in-ground fuel tanks. The owners have received permission to
install replacement fiberglass fuel tanks and are scheduled to
install them next week.

IT IS HEREBY STIPULATED AND AGREED by and between
the petitioner Tartan Oil Corp. (hereinafter Tartan) and the
respondent Zoning Board of Appeals of the Town of Southold,
(hereinafter the Zoning Board), that the above Article 78
proceedings are settled upon the following terms and conditions:
1. Tartan shall apply to the Southold Planning
Board for site plan approval, which site plan, if granted,
will be conditioned upon Tartan's obtaining the variances
and special exemption Permits recited hereinbelow.
2. Upon the grant of conditional site plan
approval, Tartan shall apply to the Zoning Board for a
variance for placement of the canopy, as an accessory
structure, in the front yard for a variance of the height
requirements applicable to the canopy.
3. Simultaneously with the hearing~ on the
Zoning variance applications set forth in paragraph 2 above,
the Board shall reopen the previous variance application for
the convenience store and the special exception application
for self-service and full-service gasoline sales, both of
which had been denied without prejudice. In the event site
plan approval and the variances set forth in paragraph 2
above are obtained by the petitioner, then the convenience
store variance and special exemption applications will be
granted subject to the following conditions:
a) food service to be limited to
packaged items, plus the heating
of previously prepared foods,
all for off-premises consumption;
b) no alcoholic beverages to be sold
before 5:00 p.m. on all days when
school is in session;
all lighting at rear of property
be shielded from adjoining
residential property, in addition
to all site plan requirements
set by the Planning Board;
4. Upon Tartan's obtaining and complying with
the approvals set forth above, the Building Inspector would

be authorized to issue the appropriate certificate of
occupancy.
5. Both proceedings shall be discontinued
without costs or disbursements to either party and this
stipulation can be submitted by either party t° a Justice of
this Court to have it "so ordered" without further notice to
the other party. Either party can file this stipulation
without further notice to the other party.

Dear Valerie:
On behalf of Tartan Oil I am hereby resubmitting an application
for site plan approval for the Mattituck Mobil Station located at
the intersection of State Route 25 and Sunset Avenue. The
original application dated August 4, 1987 was returned September
15, 1987 on the basis that it was incomplete.
Enclosed please find four (4) copies of the amended site plan
providing the information requested in your letter of September
15th, together with my check payable to the Southold Town Clerk
in the sum of $100.00.
Your letter of the 15th also included a checklist of items
requesting additional information on the site plan being
submitted. Among the information requested is the location and
arrangement of the proposed means of access and egress including
proposed curb cuts. It is not the intention of the owners to
engage in a complete renovation of the site. Nor is it
necesssary under the Southold Town Code for the applicant the to
take a pre existing business and bring it into complete
compliance with the ordinance. In light of the paving which was
done on the property, the applicant is prepared to provide the
necessary drainage to retain water on the site. In addition,
there is a gap in the screening to the rear of the property which
the applicant is also prepared to remedy with some plantings.
The sole reason the applicant must submit a site plan lies in the
fact that it has submitted an application to the Southold Town
Zoning Board of Appeals to permit partial self service of
gasoline at the station. Such a use requires site plan approval.
Simply because site plan approval is required by the code does
not necessitate the full range of site improvements contemplated

in the checklist provided in your letter of the 15th.
I am prepared, at any time, to discuss the site improvements
required with you, members of the Planning Board and members of
the Building Department so that the specific site improvements
required can be addressed and made properly by the applicant.
Also enclosed is a check payable to Southold Town Clerk for
$100.00 for the filing fee.
Please place this matter on the Planning Board's next agenda. If
you have any questions, please do not hesitate to contact me.

am advised that replacement lights for the Peconic Mobil Station
are expected to arrive from the manufacturer by the end of the
month. As soon as they have arrived they will be installed by

Dear Valerie:
I have been advised that all of the lights at the Peconic Station
have been replaced under the canopy with lights that have one-
sided lenses. These have replaced the previous lights which had
lenses on five sides. The replacement of these lights was done
pursuant to our meeting of October 29, 1987.
In addition, the amended site plan showing the redesigned curbing
has been requested from the engineer and will be submitted to
you as soon as it has been received. Upon your receipt of an
amended site plan, all items required for the certificate of
occupancy should have been satisfied so that the certificate can
be issued. If you have any questions, please do not hesitate to
contact me.
