Archibald Young~ Acting Chairman, opened the hearing by reading the legal notice of hearing, and the affidavits attesting to its publication in the Long Island Traveler- Mattituck Watchman, and the Suffolk Weekly Times. Copies of the amendment to the Rules and Regulations for the Subdivision Or'Land were distributed at the hearing. Ail present were given an opportunityto look~themover and ask any questions. Southold Town Ptanning Board -3- April 5, ~1966 Mr. Alden Young and Witliam'WiCkha~, Esq. appeared before the Board in regard to the subdivision.to be known as "Salt Aire~Estates'', located at Mattituck, owned and developed by~Casbor~ Inco will be signed. WILLIAM WICEHA~ESQ,: We~talked to the County'Clerk about putting on the map the lot number with possible dedication to the Town of Southold~ and we got a negative answer on that. · Would you want us to turn over the one lot~ to be held in escrow until such time as a decision is made about a park and playground fund. We can't turn~itoverby lot number~ but we can turn it over by description. THECHALRMAN: I don~t wantto say yes without talking to the Town Attorney~ As far as I can see it doesn't make any difference if the Town accepts cash or'a l~t. W~'WICKHA~ESQ,: We will go on record a~ being willing to do everything as you require. THE CHA~: I don't like the idea of this lot being a numbered lot, a negotiable lot. This is the same thing as cash. WtT.LIAMWIC~ESQ.: When we deed it to you, we ~ould deed it to be used for park purposes. THE CHAIRMAbI: Frankly~ this problemhas never been presented in this way. MR. UNKE~RACH: I don~t see any.reason why it can~t~be done. WTT~.IAM WICEFLAM~ESQ.: Do you want~to hold both of the lots? THE'C~: No~ one lot will be sufficient.~ Either lot'number 31 or lot'number 32~ both are next to the leaching basin. $outhold Town Planning Board -4- April 5, 1966 WILLIAM'WIC~ESQ: In 'this case, we wouldn't present the deed to you until the map is signed. We would be willing to make anystatement or'agreement you would want us to make for'the record. THE CHAIRMAN: I see no reason not to handle it that way. We would have until the hearing to check on this with the Town Attorneys and see what he says, I see no objection to it~ but I want to clear it with him. MR. ARCHIB~T~ YOUNG: Wasn't Mr. Tasker looking into the possibility of getting some legislation through.so that we might be able to require cash. HOWARD TEP~Y: He is waiting for'a case to be settled on this. THE CHAIRMAN: I don't see any reason why we can't set this up for ahearing at our'next meeting. There is no real problem with the Board of Health. ARCHIB~3~ YOUNG: It seems to.me that we should have some intention in writing from the attorney of what the setup is so that our records will be clear kight up to the time ofcalling the hearing. We should have something from the attorney to file with our records. It seems to me that we are setting a precedent. WILLIAM WIC/qHAM~ESQ.: I would be glad to supply lou a letter of intent~ conveying over to you one of these lots, if it is determined that the Town won't accept cash, MR. Southo~d Town Planning Board -6-- April 5~ 1966 THE CHAIRMAN: Where does this Charles ~Gagen Road Extension go? HOWARD TERRY: They are going to connect this right t~ough to Oaklawn Avenue. THE CHAIRMAN: This road is called-South Street on the map. WILLIAM SMITH: This road has-neverbeen dedicated but it goes right across to Custer Avenue. THE CHA~: Is this road 50 feet wide? WIT.LIAM-SMITH: Yes. THE CHAIRMAN: I think that the record shouldshowthat the road referred to in the letter of the Superintmndent of Highways dated March 29, 1966, as~Charles G~gen RoadExtension is the same road name'S-South-Street on,the map submitted, and this will proceed across to, Oaklawn~Avenue. The Board and those present.concerning this subdivision discussed the city water situation as it regmrdsthis subdivision. This subdivision will not'have city water. The Board~andthose present also discussed the problem .of~drainage in the subdivision. THE CP~AIP~4AN: The only thing to be settled before the night of the hearing is the park and playground provision, I wish this court case would be settled so that we k~ow whatwe are doing. There are 29 lots in. this subdivision. The~record should showthat this "Fairvi~w Park" referred to by the.Superintendent of Highways in his letter of approval of the'highway layout is 3ust'a temporary/dentification for this subdivision. _WVTm.IAM-SMITH: Mr. Terry wentover this and we looked it up. Fairview~Park-.original owners were a corporation. We would have to get permission from-~Southold Development Corp. to call this Fairview Park, Section II. ~ discussion ~as~ held on what name would be given to this subdivision.) THE CHAIRMAN: The subdivision map shows, a subdivision plan fOr'Daniel T. Smith~ George Herbert-Smith and William B. Smith, andthe date March 23, 1966~ by-Alden'Young. The Only p~we-have is the park and playground, and I donZt know how to handle this. I wish we could'come to somesort of determination on park and playground provisions. We don:t~now what to do. Bob Tasker~ the Town Attorney~..can~t give us a determination-on whatwe should require and we feel we can;twaive the provisions, which we have done on occassion in the past for small developments wit~aout waterfront. We can't in fairness to otherdevelopers with waterfront ask, 100 feet of the waterfront~ then the next day allow some fellow without waterfront get by.without any contribution to theTown 'park and Playground. We just don:t know what to do. DANIEL,SMITH~ Who wOuld maintainthis park and playground? THE CHAIRMAN: That would be dedicated tO the Town. This is in a sense out of our hands. In some cases~where there are several sections of a d~elopement, we will not require 100 feet out of each section. We will settle for 200 Or 300 ~' feet for four or five sections. Then the Town, has,enough~ waterfrontage inone place to do something with. What we have just done with thelast application we asked if they would be wiiling to give up one lot, a~acent to a leaching area. L SMITH: I would say that we would a~kfor some assurance from the Town that they would take care of it and don~t let it grow up in a weed Patch. I can see their point with waterfront property. THE CN_%~: It's best to have it next to the drainage area which is already taken Care of by the Town. ARCJ-'T-T~a~L~ YOUNG: This is a policy that has been thought up and adopted am0ung ourselves., and we want to treat everyone the same. Southold Town Planning Board -8-- April 5~ 1966 THE CHAIRMAN: Well~. we are not going to settle this tonight, and I don't know how to settle it. ARCHIB~?~ YOUNG: I think that all of these questions have got tO be straighten out,as we go. along. ~fwe adopt a policy that is good for the Town,, all well and good. We are going to make some mistakes. It's just a thing of how long have we had subdivisions here in-~Southold Town. I am very much opposed ~to cutting this land up into small parcels like in Mineola. They had lots 25~ by 100~. I would beanery much opposed to any of this down here. I have had the experience and that isn't good,~lanning. We got to take the waterand drainages, and all of these things in~o consideration. THE CHAIRMAN: If you want to have a hearings and get this going~ youcan do what Bill Wickham didin this other case. He will send us a letterof intent and after'the subdivision is filed.with the'County'Clerk,, he will convey or dedicate to the Town~a .lot which if and when the court case is set~led might-be released So that the Town can accept cash for a park and playground fund. WILLIAM SMITH:.~ould it have to be on this property?What about a better ar~a? THE' CHAIRMAN: If you have a better area~ I don~t see why the Boardcanrt accept it. Another area that youhave developed. We willwaive the provision under the condition that youagree to give a ~etter parcel at another'time, If youhave,some property%hat you will develope at a future time we are interested. DANIEL SMITH: We will talk it over. I think~that we cold work something out on that lot deal. The Board briefly viewed and discussed this proposal. Mr. Alden Young stated that this was all very preliminary and may neverbecome a reality. The Southold Town Planning Board received from-the $outhold Town'Board the following resolution: WHEREAS, thisBoard believes it in the public interest that the Building Zone Ordinance of theTown of Southold be amended to provide requirements for'the erection of shopping centers to provide that buildingpermits be required for the erection or addition of all buildings and that a minimum lot area be required for each family occupying a dwelling unit. NOW, THEREFORE~ BE IT'RESOLVED~ that the Building Zone Ordinance of the Town ofSouthold, Suff01k~County~ New York, be and the same hereby is amended as follows: Io 'ARTICLE'IV B ~of said Ordinance is heregy'amended by adding a new section thereto to be section 442, to'read as follows: SECTION 442-- Notwithstanding any'other provisions of this Article, abuilding or a combination of buildings containing retail stores~ mercantile establishments, officesw banks and financial institutions~ commonly known as shopping centers, may be erected or'altered in the "B-2" Business District~ subject., however~ to the following requirements: Southold Town Planning Board -12- April 5, 1966 1. The lot area shall be not less than one El) acre~ 2. At least twenty-five (25%) per cent of the lot area shall be landscaped with .grass and plantings. 3. ARTICLE VII, Section'703,~ of said Ordinance is hereby amended to read as fOllows: SECTION 703 - No building shall be erected or added to until a permit therefor has been issued by'the Building Inspector. III..ARTICLEX of said~ Ordinance is kereby'amendedto by adding thereto a new'section to he'Section 1008~. to read as follows: SECTION 1008 - NOtwithstanding any other provisions of this Ordinance~ no multiple dwelling shall be erected, altered or. used which does no provide a lot area of at least twelve thousand five hundred (12,500) square feet for each family or dwelling unit. On motion by'Mr. $oisa~ seconded by Mr. Grebe, it was RESOLVED that thel$ou'thold Town Planning Board recommend to the~$outhold Town Board an estimated performance bond of $10,000.00 for the completion of the roads in the subdivision to be known as Salt Aire'Estates, located at Mattituck, in the Town of~Southold~ Suffolk~County,~ New York~ owned and developed byCasbor~ Inc. Vote of the Board: Ayes:- Mr. Wickham~ Mr. Moisa, Mr. Grebe, Mr. Young, Mr. Unkelbach. A letter was written to Mr. Austin Sarr, District Engi~eer~ New York~State~ Department of Public'Works at Babylon~ explaining the designation of~CountyRoad 27 and the proposed highway~to be Route no. 105.
