THE'CHA1RMAN: For the record, the name ofthis subdivision is not "Fairview Park~-Section II~ as stated in the letter from ~the~highway~Superintendent- I believe this letter from the Superintendent of Highways is meant to cover-the subdivision of Daniel T.~ George Herbert and WilliamB. Smith. I also have a letterhere from the Superintendent of Highways approving the layout ofCharles Gagen Road extension. This is shown On the subdivision map as South Street and C~earview AvenUe. I would like to clear away the preliminarys. Therehas been some talk of park and playground provisions. I would like at this time tohold 'this for later this evening. So far as I can determine everything meets all the requirements for a subdivision. Southold Town Planning Board -8- May 3~ 1966 THE~CHALRMAN:- At this time I will open the hearing by 'asking if there is anyone present who wishes to spe~k in opposition to this subdivision? (The~e was no response.) THE CHAIRMAN: Hearingnone, I have a letter of protest that should bemade part of the record. The following letter is hereby made part ofthe record: ~April 26,~ 1966~ Mr. JOhn Wickham~ Chairman, Southold Town Planning Board, Cutchogue,.~ Long Island~ New York, "Dear 'Mr. Wickham: "Regarding the property owned by'Daniel~ George and William~-Smith~ formerly the Breitstadt property--for which public hearing is scheduled for May3, 1966-- "This letter is written by-Lilliam M.-Howell of Southold, owner of the~meadow adjacent to the Smith property and her nephew, George Wells of Glen Head and South Harbor. $outhotd-- "We suppose that the meeting concerns the granting of the permit for the layout-of rgads, etc. for. the development of the property into building plots. The reason for~this letter is to bring three things to the attention to the Planning Board. "THE t%IGHT OF WAY "1. The old Nayfrom the~ Pine Neck-Road ~to g_the west side of the old ~reitstadt ~ way has been overqrown, but~'was used and Howell as long as'he was able-- and by his father-before him. It is notmarked on the survey'map of the area made by.~anTuyl and Sonw dated December22~ 1960. We do not know.what the traditional widthwas of such rights of way, for access to meadow land. $outhold Town Planning Board -9- May 3,, 1966 "THE BOUNDR¥ "2. John Howell was certain that the edge of the woodland up tothe level land was also part or-the Howell property--and cut the trees there that had blown down in the hurricane. We have not seen a map to show just where the present line has been set. The property is so old that there may be no accurate way of placing the boundary. -"3. T~e Meadow--~Approximately 6 acres + or - between the Dart and Smith properties--boardering Goose Greek on the East end extending 981 feet along the new Smith property.) "We have .been interested in ha~g the meadow become part of the permanent public wild land belonging to Southold Town and its people and this is the thing we wish the planning ~rd would give consideration to. '~hen Fair View Park was laid out, Mr. William Smith asked ifMiss Howell would sell th,e Meadow so that they could dredge a canal and sell ~water front~ lots. The sand f~om the canal was go be used as fill either side of t~e canal and that would have been the end of one more meadow and natural creek. Be- lieving that the town should keep some parts of our c~eeks in their ,natural state Miss Howell did notsell the meadow. "At that time we made a suggestion to Mr. Smith that-they lay out the. road along the edge of the woos strip with building lots only on one side. Then the entire area would have access to the Meadow. This is the way the City, of Minneapo!is is laid out--Roads go around every lake in the city but the lake side of every road is public and the other side of the roads private. This Wonderful plan, of course, increased the property values in the entire region around every lake. It gives people room~without crowding theminto 100 foot strips at the ends cf roads. "If this could be done on the property, under consideration~ Miss Howell would deed the entire Meadow to the Town and give up any claim to the right of way.which gives access to the property. At same time~ the gutter could be extended west in a natural way so that it was a small extension of the creek thru a meadow--where the people could have access to the creek~ keep theiz rowboats staked~ etc. Southold Town Planning Board -~0-- May 3, 1966 "This is needed, for with only 100'~ just the people in Fairview alone would onlyhave 2½ feet each to keep a rowboat. If the Smiths and the Town would consider this idea~ the road which was originally laid out as a straight extension from Clearview Avenue to Fairview~Park could curve in-along the edge of the fringe of woods for the length of the meadow which is nearly 1,000 feet. "Without changing the entire layout of the proposed develop- ment the extra land worth of such a road could be added to the plots On the north side of the road making them larger and more valuable. "It is probably a certainty that all the property in the area would become more v~luable if this were done,, although at the moment, it may seem like a financial loss to the Smiths.. "If the planning bOard and the Town thought-the plan of owning the ~meadow with public access along its entire worth edge worthwhile and there was a blocade because or,supposed financial loss to the developers, I, George J. Wells, would be Willing to contribute up to $10,000.00 to the Town to use as compensation to the owners of the property to make it all possible. I had arranged in my-will to give sudh a sum in trust for the Southold Park District in memory of my father, with the hope that it'would'be used to buy water front propertybut perhaps it would serve its~purposed well if it is needed now. "one more thing about the value of the lots along the meadow. Neither Miss Howell nor'I, the heir to the property~ have any intention of selling the meadow so that it can be dredged and filled and the plots become~water front' plots. "This winter the New York State Conservation~Department has said they are interested in the meadow for the-Wetlands Wild Life Program so the property-will probably be transferred to the State~ if the town cannot see its way-clear to making use of it. "Respectfully submitted., /s/ Llllian~M. Howell~ /s/ George J. Wells~ Glen'Head,. April. 26, 1966." $outhold Town'Planning Board -11- May 3, 1966 THE CHAIRif~/~: At this time Iwould like to stop here~ and if iH' is okayw~scus's this letter later. ~Since there is no one present/wishes to speak in opposition to this application~ I will ask-to hear from anyone that~is in favor of it. R.G. TERRY,-ESQ..: On behalf of ~the'Smith's I urge youF favorable consideration. It ig~y understanding~ that because of thms matter'you antlcmp~t~&~r~cessorholding this matter · ~ . , ~ ~ . · . in abeyance. I mlght ].ust~kor the record there ls some doubt in my mind as .far as ~ f title ~ or'the location of the right'of way or proof o~i~ht~ of ~ay. It ~s a matt r that'can be worked out. MR. UNKELBACH: Has ~he right of:waybeen in existence in recent years? R.G. TERR¥-~ESQ.: I don'tknow. WI?.~IAM SMITH: Thee is no right of way there as such.. We are not, contesting it, we know that there is a right~ of way -there. R.G. TERRY~ESQ.: There may have been some s~rt:of'right of way, we have no proof of any right ofwaygranted in any/deeds. The fact thaH we don't have proof doesnt mean thatthe right of way doesn'~t exist. I~think that the question of. the boundary l~ine~.could be .settled by a boundary agreement. ~'-~think it's nice this talk about turning this land over andbecoming a public park, but I don't~know-whay they-waited until we made %his application to do something about it~ We need public parks and this could be benefical to %he developer. I don't- like to delay the application indefinitely. THE CHAIRMAN: At this time I think it would be well to recess this hearing° I~have talked to the attorneys for both sides and_I have talked toboth the-owners, Mr. Bill Smith~ and Mr. G. Wells. It is obvious that some of these things can'tbe straighted .out tonight. I would like to if ~ is ~greeable to recess this hearing and~ry to work some of these things out. ARCHIBALD YOUNG: There hasn't been. anything said about THE CHAIRMAN: ~T~ey are not have public water here. Southold Town Planning Board -12- May 32 1966 THE' CHAIRMAN: I will at this time recess this hearing for one month until the June. meeting of'the Plannisg Board. I would like to say in discussion that I have considered myself some what of an authority on meadow. I probably'have more meadow property that anyone else in the Town of $outhold. I feel that your deeds are extremely general and in talking with the parties from both, side there is a boundary dispute that goes back about 70 .years. If it has been that' long~ we are not going to se~le it right here. Further, because I think all the members of the Planning Board have r~_~at_~ this letters I don't know if it states a copy~was sent- to the Supervisor who was very much interested and is coming in tatter~ this evening, and the Town Board will have something to say 'about it. It still seems to me that with a little cooperation on bothsides there isn"t an' before the next-meeting~ you. They are interested How far itskirts the could drop a loop down fairly'longer highway another lot~ but if distinguished and be worth it. You would on the map. why it can't be settled no great hardship to theroad skirt the meadow. important point. If you meadow~ you wouldbave ld have to loose get'the right of.way agreement, it' might substantial~zchanges ~T.~EN'YQUNG: The only wait-until June meeting. for the next meeting. Thi: would bother' me, you going to have something ,e to go ~in~ July. THE CHAIRMAN: to the Town~ it isn't goin you would .have to change ggin~ to givethis property the, outline. The thing ~ighway~- layout. W~N.IAM'SMITH: I way will be in that deed from 1866. The right of had it recorded. R. G2 TERRY, ESQ.: competence to'give or sig ~be a question of Mrs. Howell's ~is land to the Town of Southold. WvwJ.IAMSMITH: This has a whim or'Mrs. Howetl's for several years to put a road ~long that meadow. I have said to here many X EX times that I am~not.going to pu a road along the water front. It doesn't~ make sence to make changes in the road to comply.with a whim of hers. If we gave it to the Town and we get some sort of right, of way to t~e meadow, that's okay with us. Planning SO_uthol d Town/Board. -13- May 3~. 1966 THE'CHAIRMAN: I want to say for the_ record .that I told Mr. Smith last night the Planning Board has amended their Rules and Regulations. No permission for'man made canals will be given without the approval of~ the Planning Board. The Planning Board is going to be extremely careful how they grant ~ .such permits from now on. Anything we have up to now' w.e are committed to. These canal's carry in too much salt water, and the Town Board is with us on this since the report cf .the Town' Engineer. WILLIAM ~SMITH: I think'that when you get into discussion with Mrs. Howell, what-part~ of the property she is turning over to ~the-Town will be on her terms. THE CHAIRMAN: We don~t know how much is-inFl~ved in transferring a right of way. 'R,~. TERRY,ESQ.: Ail she would have to do is sign over the right of way, but~ she .may put all sorts of restrictinns on it. MR.' UNKELBACH: How many people are involved in this rigkt of way? R.'G. TERRY,ESQ,: One as far as I~know. THE. CHAIRMAN: What is involved in relocating the lots? ALDEN YOUNG: It's a preliminary plan again. . WILL/AM SMIT~: I don't know what'the cost is to daSe~ but. everything you have done to date is wasted. THE CHAIRMAN: I think you. could give UP three or four of these lots and'change the location of the roa~. SUPERVI~RALBERTSON: I think if you puta 50. foot-raad inthere you won't have much m~adow left. You would have to put it on up land and take some of the~Smith property. THE -CJ/AIRMAN: You could put the road i~.frQ~t Of some of these lots. My contention iswhat do you ~ant-to do, and how ~o~ou want to do it. Southold Town Planning Board -14- May 3, 1966 WV~IAM SMITH: I will tell you 'this, we are not going to relinquish our'claim to the w.ood land oruptand. (The Hearing was recessed until~e June meeting of the Planning Board and negotimtions Will be madewith all parties involved.) Mr. George Axi~me, and Mr. and Mrs.~ DeHamn appeared before the Board to discuss their~meadow property located in the Cedar Beach area which is full of~sewage, ~Yhere the sewageis coming from, or what is causing it, they do not know. They also wanted to discuss with the Board the possibility of putting in a fresh water pond. They. presented to the Board a bag of .~1 which was affected by this sewage. TheChairman advisedFzr. &'Mrs.--DeHaan that they should contact ~the soil conservationist in-Riverhead and ask them to look into the situation. Theywill also be helpful in the'Planning efa fresh water pond. Mr. Rogers appeared before the Board with a preliminary subdivision pl:an of the Duvall Property, ioca~ed in'Or~nt. This subdivision would have-some I10 lots,alI~-over one acre in size. Thesubdivision wouldhave its own water supply The. Planning Boar.d held a diScussion with.Superv~or Albertson, Councilman Valentine and Dema3~est, and- Robert Tasker, Town Attormey. Increasing the size of lots was discussed. Mr. Tasker advised that in' order to. increase the size of lots-for'subdivision.~there would have to be a change in the~ Zoning ordinance, How to slow up subdivision applications and approvals was~so discussed. ~ Some suggestions were tomake the process of filinglonger and more drawn out, The thought~of~requiring curbs andgutte~Swas also discussed..The' Sup~rvisor~lad~~sied the~Planning Board that-the Town Board is not as intention requiring r~Rd ends at the water as they'use to be. Southold Town Board of~'Rlanning -15- May 3, 1966 The subdivision application of Mr. Reese, Harbor Lights Estates, Section II, was discussed.
