At that point it is a difficult position if anyone else wants to at some future time try to connect to it. I have talkedto several people about this~ including some members of the Town B0ard~ and we are notlhap~ about it. don'~tknow what the solution is~ but the'fact~you mightdestroy Value of the property. The Planning Board has got to look into 'the future. Someune may wantto connect tothis road and we want to make it~ not as easy.as possible~.~at least possible to. connect~ and there is a real gully through there. It is appropriate for the Planning. Board in a case like this to require this road to terminate at reasonable condition so'that attachment can bemade without undo cost or'problems. Southold Town Planning Board -5- ~February 15~ 1966 ~STUP~:~ Attachment can be made. ~r. Sturm pointed to the map showing Where attachment tO Sound Drive could be made~. As I told you before, there are other plans that will makepossible access for down here now at 'the beach. Down here ~ointing to map~ there is no problem. THE CPL%~: It seems unnatural to run the road down along the beach because this destroys the value. I am talking about co~tin~ing this road further'west. FRANK STURM: That is a natural curve rightdown. You still have to go down on a hill basis. RAYMOND DEAN: Where will this road lea~,, nowhere? THE'CPL%I~: At the present time itleads .nowhere. fA discussion ~as~eld on the grade of the road and fill for th'e area by-the end ofthe road by Inlet Pond. Mr.~- Sturm stated that no~lpla~s for bulldozing were shown on the map. The Chairman stated that the Board should ask for a corrected' profile map. ~r. Van'Tuy~ stated that~he could show an alteration on the old profile map~ and have the revisedmap filed. THECHAIRMAN: Now~.the park and playground provisions have been met for the subdivision. EDSON~ ESQ.: We ask for the approval of this s~bdivision subject-to the modification, amendmentofthe profilemap and this including the 50 feet surfacing of the road, and for the setting of the bond. ~It was stated that the estimate for the bond would be submitted as soon as Fir. EDSON.,ESQ,': I think it'would be better, to wait for ~ir, Tuthill. ~THE'CSL%IRMAN: If youprefer-to wait, if there is no objection~ I will recess the'hearing until Fir. Tuthill arrives ~ith the estimate for the performance bond, and we will reconveine after.the next case. The Planning Board received from the Town Board the original petition of Frederick~Rich~~ Southold, New York relative-to an OpenDevelopement Area underthe provisions of-Section 280-A of'the Town Law of the State of New York.. The Planning Board is instructed to prepare an official report defining theconditions described iht he petition and determine the area so affected and make a recommendation to the Town Board. This property in question is lOCatedwest of.the property of Southold Fife'District on the north side of the Main3Road -Southold, extending north to the Aong IslandRailroad and east to~Boisseau Avenue,~ approximately~6 acres of land h~ving the metes~and bounds set forth in survey map by Otto W. Van Tuyl &-Son, which is attached to application. The Chairmanread the application for the open 'development area. He then inquired what the status~was of the_ proposed new amendmentsregarding apartment houses. Mr. Terry.infOrmedhim that no action had been taken on these propesed amendments. HALTER KAPP%ESQ.: There are three units~ oneis still under'construction. One oflthemhas four. lunits~, two have 7un,its each,. They are small~, frankly they~a~e qu~e'similar to a motel on the~oUtside. Theylare mostly ocCUpied by'one individual, Has .any one,on the Board ubeen down'to see this? I think-that you' are familiar with it, butgo down there'am4 look-at it. Just sitting down here and talking doesn't bring out the true picture, THE CHAIRMAN: I don'trecall that we have ever approved access for 20 feet. I would Say that right,Jnow~this is the main problem. $outhold TownPlanning Board -7~ February 15., 1966 WALTER KAPP,ESQ.: Let me say this as far as your objection is concerned~ there is 6 acres of land and 56 units~ if'we widen the roads people are going to go faster. Your state law requires a 20 foot access. We are going~by-the State Law and it says in the law that 20 feet will be presumptive means of access, or~ words to that affect. There is a reason for these things, this is not a subdivision or a development~ THE CHAIRMAN: Everyone' always says that widerroads will make people go faster. This is an old story. However~ we are also concerned with population density-here. We have this new amendment which controls population density'and we can rely on that. WALTER EAPP.,ESQ,: This .man has 56 units on 6 acres of land. What are~g to do with motels? These units are on the same ~dea except they 'are used all year around. THE" CHAIRMAN: I~ll tell you what'the ~ifference is, these buildings are j amed right in there. We li~e in the country, we have broad lawns. Accross the street from these buildings are houses with broad lawns, and here these buildings are jame~ in. What do you mean by jamed in ? MR.. YOUNG: They are jamed in with narrow roads.. We have so manynarrow roads we cannot do anything about. We won't be called a very good Planning Board ifwe allow more narrow roads. TME CHAIRMAN: The first thing we have to do is go over our records and see if we. have e~er approved a 20 foot'access. difference. THE CHAINMAN: Well,. we~ill go down and look attthis. WALTER KAPP,~ESQ~: I thi~k 'that's one answer. $outhold Town Planning Board --8- February 15~ 1966 THE CHAIRM~: I think we will also have to go over our records. We have a beautiful~village. There isn't anything I~can do about this, but there are some certain rules that we, the-Planning Board have to go by; is it an asset, do-es it interfere with health~, safety'and welfare oft he Town? Right off the bat, the thing that hits us is the 20 ifoot access. We want to look at this. WALTER KAPP~ESQo: Take a look-at it an see what's there and what is being done. I can't see any~difference between this-and'a motel unit~ THE CHA~: Motels don~t come to usefor 20 fobt access. I agree that there is a need for a thing like this, but we want' to look at it and we will report back to you. ~The Board agreed to look the propertyand buildings' in question over and give a report at their next regular-meeting. Mr.~ Kapp will be notified of the next regular meeting of the Planning Board.) THE CHAIRMAN: I twill reconviene the hearing on Eastern Shores at Greenport, Section IV, at this time. I will read the estimate for the bond presentedby our engineer. "Gentlemen: "My estimate for the bonds for the roads and water'mains at Eastern Shores,-Section 4, Greenport,~ is as follows: "Land Clearing -none "Rough grading - completed "Fine grading 1,700 if$ $.30/lf "Surfacing 1,700 lf~ $2.00/lf ""Drainage 2 catch basins $ $1,000 ea. 150 if of 12" pipe ~ $2.40/lf "Water'mains 4 hydrants $ $300.00 ea. 1700 if of 6" pipe $ $4.50/lf "Increase costs over 3 year period "Adminstrative costs $ 540.00 3400.00 2000.00 360.00 1200.00 7650.00 1500.00 800.00 $ 44o. oo "Recommend a bond of $18,000.00 Respectfully s~bmitted, /s/ ~.awrence M. Tuthill." Southold Town Planning Board -9- February 15, 1966 ~rank'STURM: Imentioned to you last time that we have given out the contract for the water. HaLf of it has been o~ner ~ completed, the/half will be completed in the Spring. I was wondering if we could omit that from the bond since we already have the contract for installation of the water. ~ir. Sturmwent hydrants have been put in and other two have been installed. However, the not be installed until the population increases. -~he'Chairman advisedMr. Strum that it would t~ better to post a bond for both the water and the roads. Mr. Sturm agreed to do this.) On motion by Mr. Grebe, seconded by'Mr. Young, it was RESOLVED that the'Southold Town Planning Board recommend to the Southold Town Board a performance bond of $18,000.00 for the completion of the roads and the watermains in the subdivision "Eastern Shores at Greenport~ Section ~g", located at Greenport, New York~ owned and developed by H.J.S.' Land & Developement Corp. Vot~ of the-~Board: Ayes: - Mr. Wickham, Mr. M~isa, Mr. Grebe~ and Mr. Young. THE' CHAIRMAN: Is there anything else to come ~efore this hearing? ~There was no response.) THE CPLmIR~gAN: We are asking you for an amended profile map, corrected legal description of the property, and the bond will have to be posted and approved. If there is nothing further on this hearing on. Eastern Shores atGreenport, Section IW,~ I will declare the hearing closed. Mr. Bleeker appeared before the Board with a revised preliminary map of a subdivision to be known as "Willow Point" located at Arshamomaque, Town of Southold~ Suffolk~County, New York. The proposed subdivision will be approximately 21acres and will contain 31 lots. There is a proposed man- made canal shown on the preliminary map. This proposed canal will run in from Budd's Pond. South.ld Town Planning Board -10- February 15~ 1966 Mr. Bleeker pointed out thathe had changed thelocation of the 30 foot right of way shown on the preliminary map. MR. BT.~RKER: I would like ~to mention one thing in regard to bringing this Town road all the ,way down to thebeach. The people are not in favor of it at'all. '~heir experience has been that people come down, get on the beach and leave trash. We were hoping that the Town wouldn*t ~sist on running this road all the way to the beach. THE C~IRMAN: I~ll tell you what happens sometimesa the Town Board requires it often. ThehighwaySuperintendent can recommend against opening it up right to the beach. Mr. Bleeker stated that ethere presently-was a buil~g on the property'that would have tobe removed or added to because it's not in keeping~ith what Mr. ~eker intends to do with the property. The' Chairman inquired of Mr. Bteekerlwhether he anticipated any problems with the CountyBoard of Health on elevation. Mr. Bleeker'stated there appea~ed to be no problems. He said he-has talked to the Board of Health. Southold Town'~lanning Board -11- February 15a 1966 Ths Chairman stated that preliminary approval could be given to this subdivision subject to working out the park and playgDund area provisions and possible drainage easements. The Chairman also stated '-t~at the Town Attorneywas presently looking into the pos~i~lity of having a park-and p~yground fund. R. Terry~ Esq. felt that the location of this subdivision near thehigh School where there are recreational facilities would prehaps be sufficient so that'a park, andplayground area would not'be required iht his subdivision.
