THECHA~: ~We have a letter from the Superintendent of Highways dated Nov. 6, 1967 approving layout, and also a copy of the proposed covenants and restrictions. Is there anyone here who wishes to speak in opposition to this subdivisimn? ~here was no response.) THE~CH~IRFa%/~: Is there anyone present who~ishes to speak in favor of it? (There was no response.) T~E CHAIRMAN: The map is not signed or cleared by the~County Board of Health. This will have to be done. Southold Town Planning Board~ -3-- May ~, 1968 HENRY'MOISA: Do you have a letter from Greenport-regarding the water? DONAT~ TUTHILL: Not yet. But, I would like approval to go a~ead in entering into a contract on utilities and even possibly of'star, ting to lay water lines before the next meeting. THE C~AIRMA~: Rod, what is the story on the~County'Board of Health? ROD VAN,TUYL: No particular objections. They have recommended the sewage disposal and it"s just a matter, of form with them to approve it. DO~J=D TUTHILL: I mightmentionwhat is not written up in the restrictions, but this hasbeen: worked out.w%~th the understanding of Mr. Dean and M_r. TaSker, is the 20 ~Cm'n~ easement across the three pieces of property and'"the ~g, ne which is covered by a considerable sized pond - we are giving th~ easement over the entire lot so that the Town can go on the lot anywhere if theywanted to have a dm~4~4a~g area. MR. WICKHAM: There is one ithing more - on thus park and playground area - we have been running in'to more and more of a problem as to who is going to maihtain it. DONALD TUTHIT~:~ I didn't go up and have my lawyer re%~ork the re- strictions, butmy thought on that is that after a cer~tain number of lots are~sold, they will have to form~an association to maintain .the park. THE CHA~: We have, no fixed policy en t~is, hut we will have to prouide for it in some manner. We will recess this hearing until you have the approval of the CountylBoard of'Health. DONALD-TUTH~: · would ~ike your approval .to start'the ~ater lines or at least enter into-an~agreemenb~with~e ones installing. I am trying'~to megot~ate%ith DT$~O to go .underground and would'like to have y~ur approval so We Can. sign an agreement with them. THE C~: We have a motion for a tentative, approval of this layout. SUppose we specify that this carries with it permission to enter into a contract with the utility companies9 Southold Town Planning Board -4- May 22, 1968 THE ~ CHAIRMAN: Applicant is permitted to enter into contracts with the utilities company or contracting firms. All those in favor? Opposed? NONE ,~T,T, DONALD TUTHILL: Does a bond have to be signed before, the~ next meeting ? THE CHAIRMAN: ItWitt~depend upon how much work.you get done. The Town Board has to take action on the size of the bond- when they approve it and notify us,~ then we sign it. Mr. Ernest-Ra~ford of East Marion presented a survey'of property at East Marion. There was some discussion about his giving a deed subject to dedication of'highway'at-some future time. Ne ~as advised to .make an application for a minor-subdivision including survey, etc. residents in the~area S~uthold, N.Y. re'l~tive to.ch~n~e Wickham~read the~letter' of T/~e 5~ ~ theBoard~to prepare anloffi- ciai~report wJ recommendation a~d also a letter from the Building InspeCtor dated.May 16; ~1968 to Rich~rd'~on,, Esq,, atty for petitioners ~reCeipt'.of'$2-5..00 fee for application of change of zone, which~ a ~as :~acceP~ed ~y. the Town' Board and.referred~to the Plann&ng B~ard. ,.After-much discussion between the Planning'Board, Atty Cron and some of'the petitioners that~ere present, Mr, WiC~ham stated thatthe Board would not publicly discuss something which theTown Board had just'p~asse~. He also statsd'thatthe'Planning Board would like to look the propertyover again and would~then~make m recommendation to the Town Board for~a public hearing. Southold Town Planning Board -5- May 22, 1968 ~Lr. James Dean laid a survey map of property located ~ New Suffolk before the Board. He was advised to make an application to file the map. Motion was made and acarried that the Board ~pprove the layout. The original petition of Henry Horton, Cutchog. ue., N.Y. for a change of zone on property located on northeasterly corner of Main R~ad and AlVah's Lane, Cutchogue, consisting of a parcel approximately 154' x 137' from A Residential to B Business was reviewed. On motion made by Mr. Moisa, seconded by Mr. Unkelbach, it was RESOLVED that the~Southold To~n Planning Board appr°Vethe change of zone on premises of Henry Horton at Cutchogue, N.Y. from "A" Res- idential-Agricultural district to "B" Business district. tn favor - ~T.,. Opposed - NONE The original petition of Helen Mokus and others, Southold, N.Y. for a change of zone on property situated att Southold, N.Y. f~om~ "A" Residential-Agricultural to "B-2" Business was reviewed. On motion made by Mr. Coyle, seconded by Mr. Grebe, it was RESOLVED that the' Southold Town Planning Board approve the change of zone on premises of Helen Mokus and others at-Southold, N.Y. from A Residential-Agricultural to B-2 Business. There being no objections, -the motion is passed. Subdivision Plan of Rollling Wood Estates at~ Laurel dated April 24, 1968 was submitted for approval. On motion made by' Mr. Wickham, seconded by Mr. Unketbach, it was RESOLVED that the Southold Town Planning Board approve layout of Map of Rolling Wood Estates dated April 24, 1968. There being no objections, the motion was passed. Southold Town Planning Board -6- May'22, 1968 The Planning Board received from'Peter J. Warren and Susen E. Warren of Peconic Bay Boulevard, Laurel, N.Y. an application for a proposed minor subdivision of premises at Lauret. Mr. Wickham made a motion that matter be laid on the table until the next'meeting. Seconded by Mr. Grebe. Motion carried. Map received fromSerge Doyen, Jr. requesting permission to make two lots on his premises at Pisher's Island. Motion was made, seconded and carried th~ the map dated Sept. 1960 be approvedand initialled bythe Board. Map was given to Mr. Grebe for return to Mr. Doyen. Matter of H~bor~Lights, Section Three, was brought up for're- view. Howard Terry stated that the final map was not in bat that the check and the application had been.received. Speculation received from'Lawrence Tuthill on Laughing Water, Section no, re~omm~ding bond in the amount of $22,000.00. Motion wa~ made and seconded that the Board recommend said bond. None opposing, motion was approved. Matter. of'Eastern.Shores, Section Five, was brought up for re- view. No one present. Matter of'I~. Ed~on's property "~ighwood" put over.~ Matter of Hoey'& Daly, Town Harbor Terrace, ~as brought up for reveiw. Sincelappli~ation is outdated,~ it.was decided'that the board should notify .them of the fact~and that they should pay~the fee if they are going to go throu~ with it. Southold Town Planning Board -7- May 22, 1968 Matter of Lee~Property, Laurel Lake, Laurel, N.Y. Letter was read from Department-of Transportation. Map of Preliminary Plans of Long Island Expressway was shown to the Board. Mr. Wickham suggested that a letter be sent to Lee sending check back and telling him to wait. Matter of'premises of Wm Br~ce May on Fishers Island. It was decided that Mr. May is not required to file the map with the Town -Clerk. Matter of George Barzac "Redwood Park" - the Board agreed that the matter is dropped as of today. Matter of Rogers in Orient - Application is outdated and ap- proval is out. Mr. Grebe made a motion to send the "fees" letter to the Town Board for approval. Motion made and carried. Performance Bond of Lawrence Tu~hill was to be updated as of tonight on Laughing Water,-Section Two. Motion made and carried that the minutes of the Southold Town Planning Board dated April 16, 1968 be approved as sent~ out. -Sou~hold Town Planning B~ard -8- ?~ May 22, 1968 Mr. Wickham reported that he had had a meeting with the Town Board and wanted to s~ggest that someQne from the~ Board ought-to attend the Town Board Meetings as an observer. Fir. Unketbach recommended that it would also be good if a member of the Town -Board attended the Planning Board meeting. Mrs. ~;iekham also stated that he thought~ something should be set~ on what-the Board can recommend and what they cannot. He ~thought they might suggest to the petitioner that he ammend his petition. He ~ also said that~ the Town Board suggested that-'the petitioner might like to meet with the Planning Board. On the matter of the Kenney's Road-North Sea Drive peti~on, motion was made, seconded and carried that a letter be ~ent_to the Town Board recommending thatthe entire parcel be rezoned from B2 and M to A with special emphasis on getting the Vacant lotgrezoned A. Motion was made, seconded and carried thatthe Southold Town ~ Planning Board set 7:30 P.M., Monday, June 17, 1968, at the Town Office, Main Road, $outhold, New Tork, as the time and place of the next regu- lar meeting of the Planning Board.
