Box 1412 Southold, NY 11971 Re: Approval: Site Plan for De Art of Nature, LLC Located at 23423 CR 48, ±900' east of Cox Lane and CR 48, Cutchogue SCTM#1000-84-1-10.4 Zoning District: A-C Dear Mr. Strang: The following resolutions were adopted at a meeting of the Southold Town Planning Board on August 13, 2012: WHEREAS, this site plan is for a proposed 17,888 s.f. addition to an existing 37,183 s.f. glass greenhouse structure and two (2) new office trailers @ 720 s.f. each on a 5.8 acre parcel in the A-C Zoning District, Cutchogue; and WHEREAS, the applicant submitted an application for site plan review on January 25, 2012; and WHEREAS, at a Work Session held on February 27, 2012, the Planning Board accepted the application for review; and WHEREAS, on March 15, 2012, the Planning Board, pursuant to Southold Town Code §280-131 C., distributed the application to the required agencies for their comments; and WHEREAS, on April 5, 2012, the Cutchogue Fire District determined there was adequate fire protection and emergency access for the site; and WHEREAS, on April 6, 2012, the Suffolk County Planning Commission deemed the site plan application a matter for local determination as there appears to be no significant county-wide or inter-community impact(s); and J De Art of Nature Page Two August 14, 2012 WHEREAS, on April 9, 2012, the Southold Town Planning Board, pursuant to State Environmental Quality Review (SEAR) 6 NYCRR, Part 617.5 (c) determined that the proposed action is a Type II Action as it falls within the description for 6 NYCRR, Part 617.5 (c) (3); and WHEREAS, on April 9, 2012, a public hearing was held and closed by the Planning Board for the above-referenced site plan; and WHEREAS, on April 19, 2012, the Town of Southold LWRP Coordinator reviewed the above-referenced project and recommended that the proposed project be found consistent with Southold Town LWRP policies; and WHEREAS, on May 5, 2012, the Southold Town Zoning Board of Appeals reviewed the application and request for variances, whereby granting the variances as applied for with three (3) conditions for the site plan, dated December 15, 2011, prepared by Garrett A. Strang, Architect; and WHEREAS, on July 13, 2012, the Southold Town Engineer reviewed the above- referenced application and has determined the project to provide adequate drainage and the proposed drainage meets the minimum requirements of Chapter 236 for Storm Water Management; and WHEREAS, on July 27, 2012, the Southold Town Chief Building Inspector reviewed and certified the proposed site plan as a permitted use in the A-C Zoning District; and WHEREAS, at a Work Session held on July 23, 2012, the Planning Board found that all applicable requirements of the Site Plan Regulations Article XXIV, §280 — Site Plan Approval of the Town of Southold have been met; be it therefore RESOLVED, that the Southold Town Planning Board has determined that this proposed action is consistent with the policies of the Town of Southold Local Waterfront Revitalization Program; and be it further RESOLVED, that the Southold Town Planning Board grants Approval to the site plan entitled "Proposed Greenhouse Addition for De Art of Nature", prepared by Garrett A. Strang, R.A., dated December 15, 2011 and last revised June 29, 2012, and authorizes the Chairman to endorse the site plan. Please note the following requirements in the Southold Town Code relating to site plans: 1. Any outdoor lighting shall be shielded so the light source is not visible from adjacent properties and roadways. Approved Site Plans are valid for eighteen (18) months from the date of approval, within which time all proposed work must be completed, unless the Planning Board grants an extension. 4. Any changes from the Approved Site Plan shall require Planning Board approval. 5. Prior to the issuance of a Certificate of Occupancy, the Planning Board must inspect the site to ensure it is in conformity with the Approved Site Plan, and issue a final site inspection approval letter. Should the site be found not in conformance with the Approved Site Plan, no Certificate of Occupancy may be issued unless the Planning Board approves the changes to the plan. F� ENERGY SOLUTIONS POWER 2 PROFIT Dear Town of Southold: This letter refers to the Planning Board Site Plan approval procedure for De Art of Nature LLC at 23423 Middle Rd, Cutchogue NY 11935.De Art of Nature LLC are applying for a Planning Board Site Plan approval to construct a greenhouse addition,however they have also entered into a contract with P2P Energy Solutions to install a roof mounted solar photovoltaic system that will in part be installed onto the greenhouse addition.Naturally the installation of this system cannot be carried out until the initial Planning Board Site Plan approval is issued. De Art of Nature LLC and P2P Energy Solutions respectfully request that the Planning Board Site Plan approval be addressed at the earliest possible hearing for a number of reasons: The 50,000W system was contracted in December of 2011,and De Art of Nature's LIPA solar rebate was approved and guaranteed as long as the system was installed by April 1r`2012.P2P Energy Solutions submitted the Town Permit paperwork on 2/3/2012 and in line with our experience with your Town Building Department expected an approval within 2 weeks.It was at only this point that we became aware of the Planning Board Site Plan issue,preventing us from having the system installed and operational by April i" Since the initial application for UPA's solar rebate was submitted,the rebate level has dropped from$1.75 per Watt to just$1.30 per Watt.if we are forced to resubmit a LIPA application it will reduce the funding from this source from $87,500 to$65,000. Our negotiations with LIPA have resulted in a verbal assurance that if this Planning Board Site Plan approval can be issued now,an approved permit produced and we can realistically have the project completed as soon as possible, they will still be able to guarantee the initial rebate level. It is vital that we receive this rebate level as in order to overcome the unique installation challenges associated with installing solar system on a greenhouse,this system was designed as'building integrated:This means that when complete,it will be the only building on Long Island and perhaps the North East to have incorporated solar electric panels embedded in the insulated roof of a greenhouse. However these design challenges have resulted in numerous expenses that P2P Energy Solutions and De Art of Nature have already incurred.These include,but are not limited to,the engineering costs that result from a far more extensive design process.Most importantly,P2P Energy Solutions have already constructed off-site and at great - expense the insulated roof panels that will be used to mount the PV modules. We hope you can understand how this whole project may be placed in jeopardy if we are unable to show LIPA that the Planning Board can issue the Site Plan Approval as soon as possible. BASIS OF APPLICATION: Request for Variances from Article III Code Sections 280-13A(2), based on an application for building permit and the Building Inspector's December 29, 2011 Notice of Disapproval concerning proposed additions/alterations to existing greenhouse structure and new office trailers, at; 1) less than the code required front yard setback of 60 feet,2) less than the code required minimum side yard setback of 20 feet, 3)more than the code permitted maximum lot coverage of 20%. RELIEF REQUESTED: The applicant requests variances to construct additions/alterations to the main greenhouse and add a new office trailer, with front yard setback of 11.6 feet where the code requires 60 feet, a single side yard setback of 15.8 feet where the code requires 20 feet and lot coverage of 28.8% where the code permits 20% maximum lot coverage. ADDITIONAL INFORMATION: The Zoning Board requested comments from the Southold Town Planning Board. In a memo dated February 28, 2012,the Planning Board stated that the proposal is consistent with the goals of supporting and maintaining agriculture. Furthermore, the Planning Board supports the application with the condition that the fire district finds the narrowed side yard sufficient for emergency access to the residential properties to the north that use the shared R.O.W.. During the hearing, several neighbors expressed their concerns about ingress and egress on the R.O.W. from their adjoining properties to CR. 48. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on April 5,2012 at which time written and oral evidence were presented. Based upon all testimony, documentation,personal inspection of the property and surrounding neighborhood,and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law 4267-b(3)(b)(1). Grant of the variances will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. Agricultural operations have been in existence on this property for more than 20 years without any negative impacts. The Right of Way shall be improved and allow for unobstructed access to the adjoining properties to the north. The properties to the east and west are both agricultural and the proposed greenhouse additions on the subject property are in keeping with the character of these adjoining agricultural operations. 2. Town Law 6267-b(3)(b)(2), The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The main greenhouse is a 179'X 207' glass building. The proposed perimeter additions to all four sides of the existing greenhouse building are necessary to enable the applicant to move his specialty crops to a different solar orientation throughout the seasons as required by best management practices for growing his specific produce. 3. Town Law 6267-b(3)(b)(3). The variances granted herein are mathematically substantial, representing 81% relief from the code for the front yard setback and 44% for the lot coverage. However, the property has two front yards (CR 48 and a R.O.W.) and the right of way is only used by the applicant and two residential homes to the north. The proposed lot coverage is due to the number/size of greenhouse structures needed to sustain this agricultural business, since all crops must be grown under glass to meet the industry's food safety standards. The requested side yard setback variance is also substantial representing a 21% relief from the code. However, the proposed side yard widens along the building length so that only about 53% of the proposed side yard setback is non-conforming, 4. Town Law 6267-b(3)(b)(4) No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. All storm water runoff will be retained on site. The right of way will be improved for easier and safer emergency access. 5. Town Law 6267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law 6267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of an improved greenhouse and organic farm operation while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. The driveway to Lots 1 & 2 must meet state codes and local codes for a driveway and access. The existing site plan does not meet those codes. (Ref: R311.4.1 & F511.2, 2.1, 2.2, & 2.3 and local codes) ii. If Lot #1 is subdivided (as I believe it was) then a 25' ROW will be required, etc. The existing site plan looks as [though] there is encroachment on the ROW. This possibly would impede emergency vehicle access. This becomes more important as there is a LPG (Liquefied Petroleum Gas) aboveground storage tank approximately 25' from the ROW. b. Suffolk County Planning Commission (SCPC) i. The SCPC considers this application to be matter of local determination as there appears to be no significant county-wide or inter-community impact(s). A decision of local determination should not be construed as either approval or disapproval. 1. It should be noted that because SCRPTM lot # 1000-84.-1-10.4 is in an Agricultural District, it would appear that an Agricultural Data Statement is needed for this application.
