A regular meeting of the Southold Town Planning Board was
held at ~:30 P.M., Tuesday, June 9, 1964, at?::the Town Office,
Main Road, Southold, New York.
There were present: Messrs: John Wickham, Chairman, Henry Moisa,
Alfred Grebe, Archibald Young, and William Unkelbach.
Also present: Mr. Otto Van Tuyl, Consultant, and Mr. Howard
Terry, Building Inspector.

The Chairman read the legal notice of hearing, and the affidavit
attesting to its publication in the official newspaper.
The Chairman stated that he had the final maps signed by
the Board of Health, and a letter of approval for the roads from
the Superintendent of Highways.
THE CHAIRMAN: Everything seems to be in ~rder. Is there anyone
who would like to speak in opposition to this subdivision?
(There was no response. )
THE ~CHAIRMAN: Hearing none, doe~s anyone wish to speak in favor
of th~s subdivision, Sterling Homes, in Greenport?
C~RISTSTRATAKIS: We own the-property. Y We have engagedMr.
Van Tuyl's services to draw up the subdivision and werrequired
the approval of the Board on the preliminary drawing by Mr. Van
Tuyl.
THE CHA1/AWaAN: As I said everythingseems to bein order. There
seems to he'no problem. We will close ~th~hearing~ than latter
this evening take action on it. As things seems to be in order
and there are noneopposing it, ~ will be anyproblem.
Oneof the problems that has arisen ~oes for all sub-
divisionsa is some times the Planning Board ~as accepted ther~ds,
and'highways, but theTown has not'when'these subdivisions~are .
readyto dedicate to the Town. The Town has recently changed the
specifications fordedication and it now takesa year.and a half
foraPProval~ therefore~ itis not possible oto dedicate now. under
the circumstances~ we have to require allbonds upon the completetion
of the highways.
CP~IST STRATAKIS: AsMr. Van Tuyl knows, we do have acontract
with'Latham'Sand and Gravel Company.

and requested thathe undertake the running of the p~mbing and
he said he would-be happy to do so. I think the only problem
we may have would be the drainage of the roads.
THE CHAIRMAN: The Town Attorney on this says once this map is
filed and registered with the County'Clerk's Office, our bads are
tied. We are suppose to make all arrangements prior to the filing
of the map and again we have done this a few times ain the past,
but we haven't done it often enough. I do know that the TOWn
Attorney says you have to file a bond for this. Now just how
we sate going to work this out, I don't know. We haven't done it
often enough so that we can very well take a week or 10 days.
CHRIST STRATAKIS: Who does the work fog the final?
THE CHAIRMAN: We have our own engineer 'who does this work
for us.
CHRIST STRATAKI~: The signing of the contract would be setting
the proformance bond~
THE CHAIRMAN: Inv~aw of the fact we sign on this, I feel
that from now on we have to approve this more carefully than we
have in the past. We swill start immediately on this, assuming
that it gets the approval of the Town Board. Is there any reason
that you couldn't put up a proformance bond?
CNRIST STRATAKIS: No.
THE CHAIRMAN: We had hoped to profitby having all our high-
ways dedicated. We will get the Town Board to look at-this on the
t6th of June.
CHRIST STRATAKIS: We will have to set the amount of the
profo~mance bond?
THE CHAIRMAN: Yes.
CHRIST STRATAKIS: ~Do we submit this to ~e Town Board or to
the Planning Board?

THE CHAIRMAN: Highways are in contract having to comly to
taws set down by the State. The Town has to move in after the
proformance bond is forfeited.
CHRIST STRATAKIS: That is quite all right.
THE CHAIR/~%N: Is there anyone who would like to say anything
further in connection with th~s subdivision?
(There was no response.)
THE CHAIRMAN: If there is northing else to be presented at this
hearing, I will declare it closed.
Lefferts P. Edson, Esq., appeared before the Board with Mr.
Heavy'Smith to discuss proposed subdivision at Peconic, New York.,
entitled "Peconic Shores". Mr. Nelson'Axien, an adjoining property
owner appeared to express his concern about his access. He now
has a right-of-way and wants to know if he Will still have access
to the public road afterthe subdivision is constructed. There
was some question about the boundries and the location of the
proposed right-of-way. Mr. Wickham suggested that Mr. Smith and
Mr. Axien confer together with their lawyers and decide on the
location ofthe right-of-way. Mr. Axien also wanted to know i~
all the highways in the subdivision had to be dedicated, or if just
some of them could be dedicated. He was informed that if the
roads were dedicated tothe Town, they would all be dedicated and
not just some of them.
Mr. Alfred Teeves app~d before the Board to discuss the
possibility of constructing a subdivision at Boisseau~Avenue,z
Southold, NewYork. Mr., Wickham informed him it would bebetter
if he filed it in two sections. The Chairman also explained
to Mr. Teeves the problems with the highways and the requirements
they mustmeet to be dedicated tot_he Town. Mr. Teeves said he
was going to keep all the trees offfthe front'of the property
and the wires off the roads for estatic reasons. Mr. Teeves
also brought up the question of an entrance gate. The Board
informed him that all entrance gates must be 35 feet from the
highway, and that he should ~iscuss this with Harold Price~.
Superintendent of Highways. Mr. WickhamadvisedMr. Teeves

that he should make a preliminary application for a subdivision.
Mr, Teeves said that-nnothing was definite and that he was
also considering putting in apartment houses. Mr. Wickham
said that personally he did not approve of this type of thing
in Sou~hold Town~
Robert Trumanbach appeared before the Board to discuss
putting in a numbering system in the Town of Southold,, whereby
lots,, blocks~ and houses would be numbered for clearer~and
acurate idenification. This numbering system would be carried
through when land isdeveloped. This idea is something for
the Board to look further into.
Mr. and Mrs. Leroy Brown, Greenport~ New York,z appeared
before the Board in reference to the Island's End Golf and
Country'Club~s application for a change of zone. They~wanted
to know~the~'size of the property that was in question for a
change. Mr. Wickham read the legalnotice to~em~,, however,
he explained that he would not discuss itat lenght~with them.
Mr. and Mrs. Brown felt that the parking olot w~ich is adjoining
their property would be a noise hazard and hence affect their
business.
The Planning Board then went back to the application of
Christ~Stratakis's subdivision,~. Sterling Homes and discussed
it.

The Planning Board received from the Town Board a petition for
a change of zone from "A" Residential and Agricultural District
to "B" Business District by Island's End Got~ and~CountryClu~
with the instructions to prepare an official report defining the
conditions described in the petition and determine the area so
effected with the recommendation of the Planning Board. The
request for this change of zone is made for the purpose of
operating the Golf and CountryClUb on a public basis instead
of on a membership basis. This property is bounded and described
as follows:
Beginning at a concretemonument on the northerly line of the
Main Road at the southeasterly corner of land of ErnestWiggins and
the southwesterly corner of land of'Floyd King; from said point.of
beginning running along said land of Wiggins, north 36° 04' 00"

RESOLVED that the Planning Board is not going to take an
immediate action oR this application. They are going to hold
it for further investigation and study.

The Planning Board received fromthe Town Board a resolution
containing proposed amendments to the Building ZoneOrdinance
with instruction to prepare an official report thereon.
The amendments proposed read as follows:
I. By amending'Article III, Section 300, of said Ordinance by
adding a new subdivision, to be subdivision 4A, to,~ead as follows:
4A. Stables and riding academies, when authorized
as a special exception by the Board of Appeals as
hereinafter provided.

II. By amending'Article III,. Section 300~ subdivision 5 of
said Ordinance to read as follows:
5. Clubs, fraternity houses and golf courses~ when
authorized as a special exception by the Board of'Appea~s
as hereinafter provided.
III. By amending'A~ticle IVy. Section 400, subdivision 5 of
said Ordinance to read as follOWs:
5. Offices, banks,, and financial institutions.
IV. By amending Article IV~ Section 400,, subdivision 10 of
said Ordinance to read as follOWs:
10. Storage houses, express carting or hauling offices
or stations,, ice manufacturing, yards for storage and sale of
coal and building materials.
V. By amending ~Article X~ of said Ordinance by adding thereto
a new sectiOn to be Section 1000B,~ to read as follows:
Section 1000B - No dwelling shall b~ hereafter be
erected or altered in any district unless provisions shall
be made therein for not less than eight hundred and fifty
(850) square feet of space within the exterior of the
foundatio~walls at ground level exclusive of a garage,
carport~ carpark, open porch~ or terraces~ or other
extensions outside the body of the house. Provided,
however, that fifty (50%) percent of the habitable area
of the se:cond story may be used and applied to the areaa
requirement of the first floor.
Notwithstanding anything hereinabove to the contrary
the area of the second floor shall be included in .computing
the area of the total habitable area when the~ finished floor
of the second story has a clear headroom ~of not less than
seven and one-half (7½) feet.withknee ~alls of not less
than five (5) feet ~nd When the second floor is serviced
by a permanently placed stairway.
The provisions of this section shall not-apply to
~wellings located within a tourist ~camp as defined in
the SoutholdTown Ordinance~ ~roviding for~:the regulation
of tourist camps, house trailer camps~ house trailers

or similar establishments when a permit for such
tourist-camp has been issued by the Town Board
pursuant to the provisions of said Ordinance.
On motion by Mr. Moisa~ seconded by Mr. Young~ it was
RESOLVED that 'the Southold Town Planning Board favorably
recommends tothe Town Board the above amendments to the
South~ld TownZoning Ordinance.
The Planning Board finds that the changin~~ of the times and
demands on the Town have increased to the point where we feel that
the proposed changes in the Ordinance are necessary. The'Planning
Board feels that these changes are in the public interest of the
Town of Southol~.

Mr. Howard Terry~ Building Inspector attended the Riverhead
Town's Master-Plan preliminary meeting, and gave a brief report
on it to'the Planning Board. The biggest ~objection tothePlan
was the apartment houses and green belt,, which is open farm land.
The term "green belt" was not looked ~pon favorably.
LAwrence Tuthill came to the meeting to obtain information
of "Peconic Shores" and"Sterling Homes"to make an estimate for
proformance bonds.

RESOLVED that the Planning Board minutes dated May-5, 1964,
be approved as submitted.

The subdivision~ "Eastwood Estates"~ Section II~ was
discussed briefly by the Board.
On motion by Mr. Moisa, seconded by Mr. Grebe, it was
RESOLVED that tentative approval be given to the maps
of Eastwood Estates~ Section II.

The Planning Board received an application from Race Point
Corp., Fishers Island,. New York, for a subdivision. The ~oard
held a lengkty discussion on this proposed subdivision. The
application wasnot in complete form to meet the requirements
of the Planning Board. A letter was forward to Mr. James
Manning, with carbon copies of said letter'toChandler & Palmer,
Alfred. Grebe, Supervisor. Albertson~ Otto Van Tuyl,, and James
E.~ Plymire, Esq.,. recommending ways in which the application
for the subdivision could be improved.
The Planning Board received from Ernest W. Whitlock~ Malcolm
Pirnie"Engineers the proposals for the study of ground water in
the Town of Southold. The Board discussed them.
On motion by Mr. UnkelbaCkl, seconded by Mr.~ Wickham,it was
RESOLVEDthat the~Plann~ing Board recommend that the Town
Board also approve the proposals for the study of ground water
in the Town of~Southold.

The Chairman dictated three letters to the Secretary.
(1) To Mr. Ernest'-W.-W/%itlock, Malcolm Pirnie Engin~ers~
informing h/m that the Planning Board met and approved the
proposals, and submitted them 'to the Town Board with the
recommendation that they.approve them. (2) To the TOWm
Board informing them that.the Planning Board accepted the
proposals of'Malcolm-Pirnie Engineers and reco~end that
the Town Board also approve them. (3) To Mr. John'Diffigos~
Department of Commerce, informing him that the proposals
of MalcolmPirnie'Engineers had been accepted by the
Planning Board and that copies of the proposals were sent
with the letter in hopes that work will commence as soon
as possible on thisp~ject.
The next-meeting of the'Southold Town-Planning Board
will be held 7:30 P.M.~ Tuesday,. June ~0,~ 1964~ aththe Town
Office, Main Road~ Southold,, New york.
