SOUTHOLD TOWN PLANNING BOARD
June 30, 1964
A regular meeting of the Southold Town Planning Board was
held 7:30 P.M., Tuesday, JUh~ 30, 1964, At the Town Office, Main
Road,.Southold, New York.
There were present: Messrs: Archibald Young, Acting Chairman,
Henry Moisa, Alfred Grebe, William Unkelbach, John Wickham came
to the meeting at 7:50 P.M.
There were also present: Mr. Otto Van Tuyl, Consultant, and
Mr. Howard Terry, Building Inspector.
PUBLIC P~.ARING: On the question of approval of the following
plat: Plat of property owned by Henry Smith, entitled Peconic Homes
at Peconic, consisting of a parcel of land of approximately 21.62
acres, situated at Peconic, in the Town of'Southold, Suffolk-County,
New York, and bounded and described as follows:
Beginning at a point on thennortherly Side of North Road where
the same is intersected by the westerly side of land now Or formerly
of J. or Vincent'Simeoni formerly William B. Codling and from said
point of beginning running thence along the northerly side of North
Road the following courses and distances: (1) South 60 degrees 15
minutes 20 sects West 43.29 feet; (2) South 61 degrees 04 minutes
50 seconds West 257.75 feet to land now or formerly of'G. or H.
Stepnoski; running thence along said land the following courses and
distances: (1) North 44 degrees 08 minutes 40 seconds West 253.64 fee~

formerly of George M.~ Williamson fol~merly Floyd W. Vail; running
thence along said land the following courses and distances: (1)

36 degrees 27 minutes 50 seconds'West 169.85 feet; (3) North 45
degrees 17 minutes 10 seconds ~est 218 feet; (4) North 47 degrees
59 minutes 20 seconds West 1029.73 feet to land now or formerly of
Frederick L. Hehn; running thence along said land North 44 degrees
53 minutes 30 seconds East 518.49 feet to land now or formerly of
Leslie, formerly'William B. Codling; running thence along said land
and along land now or formerly of M. Gowan formerly William B.
Codling and along land now or formerly of~Prudential Lumber ~o.
formerlyWilliam B. Codling and along land now or formerly of J.
Or Vincent~Simeoni formerly~William B. Codling South 42 degrees,
09 minutes 30 seconds East 2238.22 feet to the northerly side of
North Road at the point or place of beginning.
The Chairman read the application for the subdivision, notice
of hearing, and affidavit attesting to its publication in the
official newspaper. He also read letter-of approval of the road
layout from the Superintendent of Highways.
THE CHAIRMAN: Is there anyone present who would like to speak
in opposition oto this subdivision?
Mr. Nelson Axien, an adjoining property owner looked at the
map of the subdivision, but did not say anything.
THE'CHAIRMAN: Are there anyquestions you would like to ask
about this subdivision?
NELSON AXIEN: No.
THE CHAIRMAN: Are there any others that would like to speak
in opposition to this subdivision?
(There was no response.)
THE CHAIRMAN: Is there anyone present who would like to speak
in favor of this subdivision?
LEFFER. TSP. EDSON,ESQ.:Having complied with~-all the requirements,
and making the suggested changed for the final map, I ask that the
Board give approval to this subdivision. The only thing I am not
sureabout is the setting of the bond.

HOWARD TERRY: Larry is going to bring the final estimates
for the bond . He said he would be here by 7:30. He should
be here soon.
LEFFERTS P. EDSON,ESQ.: Then I will ask approval subject to
the setting of the amount of the bond, and the completion of the
roads.
THE'CHAIRMAN: Anyone else wish to speak in connection with
this subdivision?
(There was no response.)
The CHAIRMAN: Then I will close the hearing at'this time, and
the Board will make their decision later this evening.
TWo representatives of the Thomas F. Daly~'Estate appeared
before the Planning Board to discuss the layout of property. The~
first thing discussed was~the access roads. The Board advised
them that the :roads would have to have turn arounds, so that'fire,
emergency and snow equipment would have ample room to turn around.
There is presently a private road in the estate which they wish
to keep private. The Board ~id not look on this favorably. They
~w~9~a~ed that usually the road is notmaintained properly. Also
the Board must look into the future when the land might change
ownership, and nomo/~ewants to keep up the road.
The Board advised the representatives that they would have
to put up a bond that water will be put in. Not all the lots have
to have water at the smae time, but.muSt~have water in order to
sell them.
They discussed the possibility of changing the lot size. The
Board advised that the lot size cannot be changed once a map is
filed, however, 1½ lot may be Sotd to one person.
The Board advised that they file a map for a subdivision and
fill out the necessary application forms.

Mr. Wickham took charge of the meeting at 8:30 P.M,
The Board next looked at the application of lIsland's End Golf
and Country.Club for a chage of zone from "A" Residential and
Agricultural District to "B" Business District. The Board asked
Ernest-Wiggins and Floyd King to attend this meeting to express
their views on this change of zone. The Chairman explained that
no recommendation had been made to the Town Board as yet because
the Board felt that they should have the opinion of the owners
of the land before making a recommendation.
Mr. King wanted to know the ~histroy of the application. He
said he was originally asked to go along with 100 acres. The
Chairman advised him that the Planning Board has never approved
anything over 20 acres and don't expect to. The. Chairman also
explained thatthe Planning Board only makes the recommendation and
does not make the final decision in a change of zone. Mr. King
wanted to know the size of the property in question for'a change
of zone. The Chairman read the legal description to him, describing
the property in question.
The Board, Mr. King and Howard Terry discussed the percentage
of the business that was done with the public. It was determined
that the club is doing business mainly for the public. The Board
looked at a brochure sent out by Island's End Golf & Country.Club
inviting the public to enjoy their facilities.
The Board felt that the owner of the property, should make the
application for the change or'at least sign the petition. Mr. King
stated that he was asked to sign the petition by he refused. Mr.
King also felt that a golf club should be in a residential area.
However, Island's End Golf and Country.Club also has a restaurant
and bar which is being~an for business~ There was condern over
the fact'that if this is zoned business, any type of business could
be put there at a later date.
The Board and Mr. King held a discussion on what classified it
as a business. They advised him thatwhen the public'were bought
in off the road, it is a business. It was bought out that the club
is advertising in newspapers, invitif~the'public to the club, and
they also have a sign, plus the brochure that was brought out
ear'lief in the discussion.
Mr. and Mrs. LeRoy B~Dwn were also present at'the meeting to
express their concern. Mr. Brown was concerned were the parking
lot would be located. The noise of ~La~gddoors, etc. would affect

his business. Mr. Young brought out the fact that Island's End
Golf ~ Country Club have to have their property rights. In order
to have this property zoned business, it would have to have a
public hearing bythe Town Board. Mr. Brown would be g~n a
chance then to express his concern. Mr. Wiggins alsO stated
that he did not want the property zoned business.
Mr. Unkelbach again brought out the fact that~the application
should be signed by the'Owners of the land. Mrs. AeRoy Brown
suggested that maybe there was something in the contract Which
permitted the golf club to ask for~a change of zone without
the permission or signature of the owners.
The discussion ended and the'Chairman thanked Mr. Wiggins and
Mr. King for attending the ~meeting and giving their opinons.
The Board looked at the estimate for bond for ~Qads for Henry
Smith, Peconic Homes, as submitted by-Lawrence Tuthill. Mr. Tuthill
recommended a bond of $10,000.00.
On motion by Mr. Moisa, seconded by Mr. Young, it was
RESOLVED that approval be given to Henry, Smith's subdivision
Peconic Homes, and approval be given to the estimate for the bond
for the r~ads with a 25%~to 50% increase above estimate.
Vote of the Board: Ayes: Mr. Wickham, Mr. Moisa, Mr. Young,
Mr. unkelbach, Mr. Grebe.
The Board looked at the estimate for bond for roads for
ChristIStratakis, Sterling Homes,~ as submitted by-Lawrence
Tuthill. Mr. Tuthill recommended a bond of $6,000.00.
On motion by Mr. Moisa, seconded by Mr. Grebe, it was
RESOLVED that approval be given to Christ-.Stratakis's subdivision
Sterling Homes, and approval be given to the estimate for the bond
for the roads with a 25% to 5~ increase above estimate.

The Board next b~iefly discussed Eastwood Estates, Section II.
The applicant~'s would like to get. this subdivision underway. Mr. Van
Tuyl is already to go ahead and make the final maps. The Board
briefly discussed the water and sewage problem.
The Board considered the application for a change of zone from
Island's End Golf and Country Club, Greenport, New York. This request
was for a Change from "A" Residential and Agricultural District to
"B" Business District on property located in Greenport, New'York,
and more particularly bounded and described as follows: Beginning at a
concret~ monument on thenortherly line of the Main Road at the sou~th-
easterly corner of land of Ernest~Wiggins and the southwesterly corner
of land of Floyd King; from's~id point of beginning running along said
land of Wiggins, north 36' 04' 00" west, 300 feet; thence along s~id
land of Floyd King, north 66° 39' 50" east, 190.61 feet to land of
Wayland Brown; thence along said land of-Wayland Brown, south 36° 03'
40" east, 106.84 feet; thence along land of!LeRoy Brown, south 33:
45' 40" east, 193.16 feet to sa~d northerly line of the Main Road; thenc(
along said northerly line, south 67~ 08' 30" west, 183.0 feet to the
point or place of beginning.
On motion byMr. Wickham, seconded by Mr. unkelbach, it was
RESOLVED that the Planning Board does not recommend to the Town
Board the change of zone from "A" Residential and~Agricultural District
to "B"'Business District on the property of Island's End Golf and
Country Club at Greenport, as described above, for the following reasons
1. This is a residential area and there is at present ~no other
"B" Business District near by, and if granted this would constitute
spot zoning.
2. Judging bythe informal discussions with the residents in the
area at previous meetings of the Planning Board, they are opposed
to a business being conducted in this area.
3.-We beleive that there is a very real question about'the
~alidity of this application, in view of the fact that'the owners of
this property did not join in the application.

On motion by Mr. Moisa, seconded by Mr. Unkelbach, it was
RESOLVED thatthe minutes of the Southold Town Planning
Board, dated June 9, 1964, be approved as submitted.
Vote of the Board: Ayes: Mr. Wickham, Mr. Moisa, Mr. Young,
Mr. Unkelbach, Mr. Grebe.
The Board briefly discussed.inviting Shelter Island Planning
Board to attend one of their meetings. This will be done sometime
in the near future.
A letter was written to Supervisor Evans Griffin, Shelter Islandt
advising him of the Southold Town Planning Board's interest in his
proposal to divide the county. The planning Board advised him that
they would like to know more about this plan.
The next meeting of the Southold Town'Planning Board will be
held 7:30 P.M., Monday, July 13, 1964, at,the Town Office, Main
Road, Southold, New York,
