YOUNG: If no one wishes to speak in opposition 'to this subdivision~ anyone wish to speak in favor of it? (There was no response.) (There was not-a letter in the file from F~r. Harold Price~ approving the layout of the roads. However, M~, Lawrence Tuthill did have an estimate for the bond for the roads.) © MR.- YOUNG: I will declare thishearing closed at this time and the Board will discuss it later. Harbor Lights was again put before the Board. THE CPLZiIR/WR~N: In view of the fact that~this legal notice and description has been read and we adjourned the hearing to obtain appro=al or,county Health Department, we will dispense with preliminaries. This subdivision has notreceived the approval of the County Health Departmentyet. On motion byMr. Grebe,~ seconded ~yF~rl Moisa,. it was RESOLVED that the hearing for the subdivision "Harbor ~Aights", located atBayview in $outhold,' be recessed until the next regular meeting of the Planning Board. vote of the Board: Ayes: Mr. Wickham, Mr. Moisa~ Mr. Grebes Mr. Young, andMr. Unkelbach. Mr. Reese was also presentat this meeting to express to the Board that he was in favor~of the change of zone proposed by.the Town Board on his propertylocated at Ba~view in $outhold. He stated that he wanted this property residential and thanked the ~oard for their consideration in the mat~er. The-Board viewed themap of'the property in question. F~r. Howard Uhl and his associate' Mr. Frank~Russell~were present to discuss this proposed change with the Planning Board. Southold Town P~ning Board -5- OC~Der 15, 1964 Mr. Uhl stated that he wished to be heard on this matter because he feltthat the Planning Board.should know first-'hand what 'the plans are regarding this property. He said that theyare actively engaged in tryingto get-a motel set up on this property. He brought along a scale model of their layout of plans for the property. He said their plan was to start-out by putting up 20 motel units, then gradually adding more. When it:was completed there would be 100 units. Mr. Uhl pointed out-on the scale model the location of the motel units, restaurant, tennis court,' convenience store, golf.course, and other facilities. He stated that this would bea self-contained, self-supporting type of an operation. The people willnot haye to go out of the area to find recreation. Mr. Uhl stated that the reason a scale model of this proposed plan was made was because they had no success in raising funds to finance this plan. He said that they tried banks on the North Fork and 'banks in.the Citywithout success. They ne~t turned to the Small Business~Administration, however, this did not'work out either. Thin, scale model was made for the purpose of im- pression banks. Because they could not get started on this project by'themselves, they contacted resort-operations. In appealing to them for aid~ it~was specifically pointed.out that this propertywas zoned for business for the type ofoperation theyhad in mind. If theBusiness Zone is taken away, their idea will be harder to put'across. - The Chairman recommended that this proper~y'be~pzoned to a "M" MUltipleResidence~District~ However, HowardlTe~Y~pointed out that with a "M" Zone, a restaurant and gift Shop, etc., could not be-operated. The~-Chai.~uan stated that they wanted~oassure all their cooperation. He stated t hat-this is the .o~ly large area that~was ever zoned for.'business~and it ~others~the Board a little that~it is not being used for business. The Chairman statedthat he has raked to the'Supervisor, and he feels the sameway on this matter. He.stated that the Board did not want to cuthim off, however they di~n"t~wanttO be in the position of having a large area zoned for business when a "'M" District would,suit the purpose just as we'll. Mr~ Uhl. stated-~hatan "M" District?would handicap them. With the "M"'zonelthey coul sign as large as they could in the "B" Zone, ~ld not'have therestaurant, ~convenience store, etc. He sta ~ went to alot-of trouble to get this "B" zone,- that.itwas given to them in goo~ faith and. theyhaVe used ~t in good faith. Southold Town Pl~ing Board -6- Oct--'er 15,, 1964 Mr. Unkelbach asked if they'have been actively engagedi in trying to put'this ~an through since. 1957~ Mr. Uhl stated that they'hadand this whole operation will take time. Mrl Unkelbach pointed~out that he should see the reluctance of the Town Board to keep this property zoned for business. If they~ere for~ed to sell this land, any sort of business that is provided for in the Ordinance, couldbelocated on this property. TheTown Boarddid not. want any type of business in this location 'that might be harmful to the area. Mr. Russell statedthat they were approached this summer by a gentleman from~Orient~who wanted to run the ferry boat from this location. He said that they would not-make such a propesition. It wouldnot'be advantageous to their operation or to the Town of~Southold. He said he thinks this points out thatthey do have the community interest at heart-and that~they will not jump at the first chance to sell this property. Mr. Unkelbach pointedout that there was always the possibility that they could no longer afford to keep the property. The Chairman explained that the Town Board hasmade the motion on this particular change of zone~~ and that they ask the Planning Board's recommendation~~ however~ they don't-have to take it. The Chairman pointed out thatthere can De mu~h pressure f~omcarry~a large parcel of land without receivingany income from.it. It is with this thought in mind that the TOWn Board does not-want this large prcel of land zoned business. Cove Beach Estates may at some time be forced to dispose of this land. The Board and Mr. Uhl and Mr~ Russell discussed the possibility of spliting~his into different zones. The gotf~course comld be in a "A" zone with a~peciat exception from the BoardofAppeals. ~he motet~nits could be in a "M" District, and the rest of the property could remain business zoned for the convenience store, restaurant, etc. The Board decided .to set-this'matter a~ide un~il laterin the evening when the Supervisor could be present to further discuss the matter,with them. "~Mr.-Clement~Bo~th appem~ed before the Board next. He has propertyon Tuckers Dane which he plans to subdiwide. He has a~ready'been selling lots ontof this area. Mr. Van T~ ma~e amap of the proposed la~out, and~Lr. Booth wanted the Board's permission to construct a road. Southotd Town/Boa~o~ -7-- Octd~r 15, 1964 The:Chairman advised that after January 1~ 1965, the'County Health Department~was requiring municipal sewers~, therefore, Fir. Booth should try to file before the first-of the year. Mr. Booth said he would like to file the final map before January 1, 1965. He presented i~themaplayout~ofthe property. The~Chairman advised that he would need-County.approval to have access come out-on the County Road. Mr. Booth is only planning to file one section of this land, and rent the remainder for farm land for a few more year~. The Chairman advised him that'he should file the whole ~arcel of land now. He advised that the. expense would not be thatmuch greater, and he could submit a performance bond for the roads. On motion by'Mr. Grebe,. seconded by Mr. Moisaz itwas RESOLVED thatthe Southold Town Planning Board give preliminary approval to.Clement Booth for the cut through or'roads on ~he land located on Tuckers Lane and the North Road,-Southold~ New York. Vote of the Board: Ayes:-Mr. Wickham, Mr, Moisa, Mr. Grebe,~ Mr. Young~ and Mr. Unkelbach. The Boardagain took up the matter'or,cove Beach~Estates. Sup ervisor'Albertson was present and the~Chairman advised him of the plan to have three differentzones in this property, so that Mr. Uhl could continue with his original plan. The Super- visor thought~this was a good idea. ~ A lenghty discussion was held as to where each zone would be~ and how large. It~was determined that~a very specific legal description would be necessary. Mrl Uhl should submit his final plans to Otto~Van T~y~, who will make a new map, and submit'itto ~the'Planning Board at their next-meeting. 'Planning Board received from theTown Board a resOlution for a ~ District to "~"~Residential ~nd Agricultural District on propertyiocatedat-Bayview in South~ld, with the instructions to prepare an official rePort defining the conditions described in the petition and determine the area so effected with'the recommendation of the Planning Board. This property is bounded and described as follows: Southold Town'P ing Board -8- October 15~ 1964 Beginning-at a point on the northerly~line of North Bayview Road at,the southwesterly corner of land oformerly-of J.B. Coleman;and running westerly along saidnortherly line of North Bayview Road 420 feet, more or less~ to'~e easterly tine of'North Road to Bayview; thence northerlyalong said easterly line of North Road to Bayview 122 feet, more or less, to land nowor formerly of Meadow Point, Properties, Inc.; thence northerly along said land of Meadow'Point ~Properties, Inc.,1200 feet, more or less; thence easterly through land of'Reese 450 feet, more or less, to land f~rmerly of-Coleman; thence southerly along said land formerly or,coleman, 1200 feet, more or less,_ to the point of beginning~ Containing about 12 acres. On motion by Mr. Grebe~ seconded by Mr. Unkelbach, it was RESOLVED that the-Planning Board favorably recommends to the Town Board the change of zone from~"C, Industrial District to "A" Residential and Agriculturai-DiStr~ct on the property described above. Mr. Young has personally inspectedthis property'and he feels that.it should be changed to "A" Residential and Agziculturat~District. Mr. Reese appeared before the BOard to state that-the was in favor of such a change. This piece of property is surrounded by residential propertyand Town property. Vote of the Board: Ayes: Mr. Wickham, Mr. MQiSa, Mr. Grebe~ Mr. Young, andMr. U~kelbach. ~n motion by'Mr. Grebe, seconded by-Mr. Unkelbach, it.was RESOLVED that the minutes of~theSouthold Town Planning Board, dated.~September 21, 1964, be approved as submitted. Vote of the Board: Ayes:-Mr. ~ickham, Mr~Moisa, Mr. Grebe~ blr~ Young, Mr. Unkelbach. Southold TOWn P Ling Board -9- O %~er 15, 1964 The Board next discussed'"Btue Horizons", Peconic, New York.~ A letter was written to the subdivider requesting, an affidavit of the disposition of the right-of-way shown on the map~ The subdividerwas also advised thathe should file a formal application with the Planning Board as soon as possible. On motion by F~r. Grebe, seconded by Mr. Young, it was RESOLVED that the Southold Town'Plar~ningBoardauthorize Mr~..Lawrence Tuthill, Professi~mal Engineer, to make an estimate fora performance bond for the roads in "Blue Horizons",~ Peconic, New York. Vote of the Board: Ayes:-Mr. Wickham, Mr. Moisa,' Mr. Grebe, Mr. Young, and Mr. Unkelbach. On motion by'Mr. Grebe~ seconded byMr~ Unkelba~, it was RESOLVED that the Planning Board recommend a bond of $12,000.00-for performance bond for the roads in Eastwood Estate, Section II~ located at Fteet~s Neck in'Cut~houge. Vote of the Board: Ayes:-Mr. Moisa, Mr. Young, Mr. Grebe, Mr..Unkelbach. On motion by'Mr. Moisa, seconded by Mr. unkelbach,, it was RESOLVED that the subdivision knownas Eastwood Estates~ Section II, owned by Kathryn Fleet'and others be approved, subject to the approval of the layout of the roads by Harold Price. Vote of the Board: Ayes:-Mr. Young, Mr. Moisa, Mr. Grebe, and Mr. unkelbach. (Mr. Wickham abstained from.any.participation in the matter fof:EaStwood.Estates, Section. II because of a conflict of interest.) So~thold Town Pl~ing Board -10- OC~ber 15, 1964 The-Chairman read a letter fromAlbert'w. Richmond, Town Clerk, stating that the Town Board accepted $13,000.00 .cash in exerow from Henry~Smith, Peconic, New York, for the security of completion of raods in the subdivisionknown as "Peconic Homes" in Peconic, New York. The Chairman also read a letter from~.Albert~W. Richmond, stating that the Town Board resolved that Northwest~Loop Road, Nassau Point, Cutchogue, New York~ Shall hereafter be known as West~Cove Road. The Chairman next reada letter fromFrederick'P. Rich sta~$g l~is disapproval of any change in the Zoning Ordinance regarding apartment houses. The Board ~scussed raising the fee ~for 'applications for subdivisions. It was unanimously agreed that the $outhold Town Planning Board recommend as a fee for all subdivisions the following: Fifty dollars for the first l0 acres in the sub- division, and vfive dollars for each additional acre over 10 acres. On motion by'Mrl Grebe, seconded byMrl Moisa, it was RESOLVED that the-Southold Town P~nning Board recOmmend to the Town Board thatLawrence Tuthill, professional engineer, be paid for his services on the foltow~ing basis: Making estimates for bonds for~r~ads, he shall receive $25~00 for the first 10 acres in the subdivision, and $1.00 foreach additional acre over t0 acres. Based on thepast'.few cases he has made estimate this would be the same as a~two per cent, which he feels and we feel is very reasonable for this work. Vote of the Board: Ayes: Mr. Wickham,~ Mr.. Moisa~ Mr. Grebe, Young, and Mr~ Unkelbach. SOdthold Town Planing Board -11- OctOber 15, 1964 Mr. Grebe felt~that the Planning Board shouldstart work on making rules and regulations for'Swimming pools. TheChair- man felt that this should wait until after January 1,1196~, in view of the fact that the Planning Board wants to giveapproval ~n as many subdiwisions as possible before that date. A letterwas written to Mr. Manning in regard to Race Point Corp. He was advised that every effort should be made to complete this subdivision and have the final approval of itbefore the first dayof Januaryt 1965. The next meeting of the%Southold Town.Planning Board will be held '?:30. P.M. Wednesday~ November 4t 1964, at the Town Office, Main Road, Southold, New York.
