THIS INDENTURE, made the 23ra day of May, Two Thousand Twelve
BETWEEN
CHARLES DAVEY UTTER, AS TRUSTEE OF THE IRMA JUDITH UTTER
IRREVOCABLE TRUST, residing at 243 Sherman Canal, Venice, California 90291,
party of the first part, and
WILLIAM A. BENNETT III and JAN D. BENNETT, husband and wife, residing at 21 Sparks
Street, Melville, New York 11747,
party of the second part,
WITNESSETH, that the party of the first part, in consideration of Ten Dollars xnd other valuable
consideration paid by the party of the second part, does hereby grant and release unto the party of
the second part, the heirs or successors and assigns of the party of the second part forever,
ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon
erected, situate, lying and being at Mattituck, in the Town of Southold, Suffolk County, State of
New York, more particularly described as follows:
BEGINNING at a concrete monument set on the westerly line of Grand Avenue at the
northeasterly comer of land conveyed by Robert H. Preston, A. Kenneth Monsell and Rober Muir
to Robert Muir and Helen Muir, his wife, by deed in Liber 3230, cp 09; and
RUNNING along said land conveyed to Robert Muir and Helen Muir, his wife, and passing
through a concrete monument set at the northwesterly comer of said land, South 71 degrees 47
minutes 00 seconds West, 219.14 feet;
THENCE along other land now or formerly of Preston, Monsell and Muir, the following three
courses and distances:
1.North 18 degrees 13 minutes 00 seconds West, 74.07 feet;
2.North 57 degrees 54 minutes 50 seconds East, 104.87 feet;
3.North 71 degrees 47 minutes 00 seconds East, 130.00 feet to said westerly line of Grand
Avenue;
THENCE along said westerly line of Grand Avenue, South 10 degrees 56 minutes 40 seconds
East, 100.00 feet to the point or place of BEGINNING.
BEING AND INTENDED TO BE the same premises conveyed to the party of the first part by
deed dated December 19, 2006, and recorded January 9, 2007, in the Office of the Suffolk
County Clerk in Liber 12486, Page 617.
TOGETHER with alt right, title and interest, if any, of the party of the first part in and to any
streets and roads abutting the above described premises to the center lines thereof; TOGETHER
with the appurtenances and all the estate and rights of the party of the first part in and to said
premises; TO HAVE AND TO HOLD the premises herein granted unto the party of the second
part, the heirs or successors and assigns of the party of the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered
anything whereby the said premises have been encumbered in any way whatever, except as
aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that
the party of the first part will receive the consideration for this conveyance and will hold the right
to receive such consideration as a trust fund to be applied first for the purpose of paying the cost
of the improvement and will apply the same first to the payment of the cost of the improvement
before using any part of the total of the same for any other purpose.
The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so
requires.

first above written.
