(631) 765-1809 ° Fax (631) 765-9064 MINUTES SPECIAL MEETING THURSDAY JULY 19, 2012 A Special Meeting of the SOUTHOLD TOWN ZONING BOARD OF APPEALS was held at the Southold Town Hall Annex, Capitol One Bank Building, First Floor Conference Room, 54375 Main Road at Youngs Avenue, Southold on Thursday July 19, 2012 commencing at 5:00 P.M. Present were: Leslie Kanes Weisman, ChairpersonfMember Gerard P. Goehringer, Vice Chairperson/Member Ken Schneider, Member James Dinizio, Member George Homing, Member, via video conferencing Jennifer Andaloro, Assistant Town Attorney (left at 6:12 PM) Vicki Toth, Zoning Board Assistant Call to Order at 5:08 P.M. by Chairperson Leslie Kanes Weisman. The Board proceeded with the Agenda as follows: 5:09 P.M. Motion was offered by Chairperson Weisman, seconded by Member Goehringer to enter into Executive Session for the purpose of Attorney/Client advice. Vote of the Board: Ayes: All. This Resolution was duly adopted (5-0). 5:41 P.M. Motion was offered by Chairperson Weisman, seconded by Member Schneider, to exit Executive Session and reconvene the meeting. Vote of the Board: Ayes: All. This Resolution was duly adopted (5-0). 6:12 P.M. Assistant Town Attorney Andaloro left. STATE ENVIRONMENTAL QUALITY REVIEWS: A. New Applications: reviews (pending). Page 2 - Minutes Special Meeting held July 19, 2012 Southold Town Zoning Board of Appeals DELIBERATIONS/POSSIBLE DECISIONS/RESOLUTIONS: DEBORAH PENNEY #6484 - (Board to consider request from applicant in a letter dated July 1, 2012, received by the ZBA July 5, 2912, to re-open the hearing for relief from Condition #! (landscaped buffer) in ZBA Findings and Determination #6484 approved for filing on 9/20/2011.) Request for Variance from Code Article XXII Section 280- 116 and 280-124 and the Building Inspector's June 3, 2011 Notice of Disapproval based on an application for building permit for demo and new construction of a single family dwelling at: 1) less than the code required setback of 75 feet from a bulkhead, 2) less than the code required front yard setback of 35 feet, located at: 160 Sailors Needle Road, (adj. to James Creek) Mattituck, NY. SCTM#1000-144-5-26 RESOLUTION ADOPTED: Motion offered by Chairperson Weisman, seconded by Member Schneider, to re-open hearing September 6, 2012. Vote of the Board: Aves: All. This Resolution was duly adopted (5-0). The Board continued with agenda items, and commenced deliberations on the following applications. RESOLUTION ADOPTED: Motion offered by Chairperson Weisman, seconded by Member Goehringer, to set the next Regular Meeting with Public Hearings to be held August 2, 2012 at 8:30 AM. Vote of the Board: Aves: All. This Resolution was duly adopted (5-0). B. RESOLUTION ADOPTED: Motion offered by Chairperson Weisman, seconded by Member Goehringer, to approve minutes from Regular Meeting held July 5, 2012. Board discussed request from the Fire Marshall, Robert Fisher, to include a condition for Bed and Breakfast applications, regarding required yearly inspections. B. Board discussed new website. There being no other business properly coming before the Board at this time, Chairperson declared the meeting adjourned. The meeting was adjourned at 7:03 P.M.
