THIS INDENTURE, made as of April 2nd, 2012,
BETWEEN Edith E. Minnigan, residing at 91 Princeton Avenue, Hewlett, New York 11557,
party of the first part, and
John Minnigan, residing at 42 Yale Place, Rockville Centre, New York 11570 and JoAnne
Lapp, residing at 106 Judson Place, Rockville Centre, New York 11570, as trustees of The
Minnigan Family Trust, party of the second part;
WITNESSETH, that the party of the first part, in consideration of $0.00, lawful money of
the United States, paid by the party of the second pad, does hereby grant and release
unto the party of the second part, the heirs or successors and assigns of the party of the
second part forever;
ALL that plot and parcel of land, with the buildings and improvements thereon
erected, situate at East Marion, Town of Southhold, County of Suffolk, State of New York,
described as follows:
BEGINNING at a point on the southeasterly line of South Lane-which when measured
along said line is distant 77.75 feet northeasterly of the northeasterly line of land conveyed
by the parties of the first part to Flora E. Gernannt (and which point is at the northeasterly
comer of the right of way leading to the beach which is hereinafter described), and running
thence South 31 degrees 1 minute 30 seconds East along said right of way 179.37 feet to
the "Beach" hereinafter described; thence North 37 degrees 21 minutes 20 seconds East
along the "beach" 69.56 feet to other land of the parties of the first part; thence North 31
degrees I minute 30 seconds West along said other land of the parties of the first part
172.53 feet to the southeasterly line of South Lane; and thence South 42 degrees 46
minutes 30 seconds West along South Lane 67.34 feet to the point of Beginning.
Together with an easemen~ of Right-of-way over the following described premises:
BEGINNING at a concrete monument at a point in the southea'stedy line of South Lane
which is distant when measured along said line 67.34 feet northeasterly of the
northeasterly line of land conveyed by the parties of the first part to Flora E. Gernannt; and
running thence South 31 degrees 1 minutes East along other land of the parties 177.68
feet; thence South 41 degrees 45 minutes West along other fand of the parties of the first
part 67.71 feet to a point on the northeasterly line of said land sold to Gernannt which point
is distant 178.94 feet southeasterly of South Lane when measured along Gernannt's land;
thence South 31 degrees I minute 30 seconds East along said land sold to Flora E.
Gernannt 53 feet to the ordinary high water mark of Gardiner's Bay; thence northeasterly
along said ordinary high water mark 150.82 feet more or less to the point of its intersection
with a line drawn on the course south 31 degrees 1 minute 30 seconds East from a
concrete monument on the southerly side of South Lane distant 77.75 feet northeasterly
from the point of beginning; running thence North 31 degrees 1 minute 30 seconds West
40 feet more or less to a concrete monument; thence South 37 degrees 21 minutes 20
seconds West along other land of the parties of the first part 69.56 feet to a concrete
monument; thence North 31 degrees 1 minute 30 seconds West along other lands of
parties of the first 179.37 feet to a monument on the southerly side of South Lane; and
thence South 42 degrees 46 minutes 30 seconds West along South Lane 10.41 feet to the
point of Beginning.
Said premises being known as 580 South Lane, East Marion, New York, also known as
District 1000, Section 038.00, Block 06.00, Lot 009.000 on the Suffolk County Land and
Tax Map.
Being the same premises conveyed to the party of the first part by executor deed dated
February 16, 2005 recorded June 20, 2005 in the Suffolk County Clerk's Office in Deed
Liber 12393 page 351.
TOGETHER with all right, title and interest, if any, of the party of the first part in and to
any streets and roads abutting the above described premises to the center lines thereof,
TOGETHER with the appurtenances and afl the estate and rights of the party of the first
part in and to said premises,
TO HAVE AND TO HOLD the premises herein granted unto the party of the second
part, the heirs or successors and assigns of the party of the second part forever.
AND the party of the first part, covenants that the party of the first part has not done or
suffered anything whereby the said premises have been encumbered in any way
whatever, except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law,
covenants that the party of the first part will receive the consideration for this conveyance
and will hold the right to receive such consideration as a trust fund to be applied first for
the purpose of paying the cost of the improvement and will apply the same first to the
payment of the cost of the improvement before using any part of the total of the same for
any other purpose.
