WITNESSETH, that the party of the first part, by virtue of the power and authority given in and by said last
will and testament and in consideration of TEN ($10.00) ...... dollars, paid by the party of the second part,
does hereby grant and release unto the party of the second part, the heirs or successors and assigns of the
party of the second part forever,
ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected,
situate, lying and being at Orient, Town of Southold, County of Suffolk and State of New York, bounded
and described as follows:
BEGINNING at a point of the easterly side of Village Lane distant 257.96 feet southerly from the comer
formed by the intersection of the southerly side of Main Road (Rte. 25) with the easterly side of Village
Lane, which said point of beginning is also where the southerly line of land now or formerly of Wendell
Tabor intersects the easterly side of Village Lane, and from said point of beginning
RUNNING THENCE along land now or formerly of Wendell Tabor the following two (2) courses and
distances: (I) South 83 degrees 39 minutes 20 seconds East 140.45 feet; (2) North 88 degrees 20 minutes 40
seconds East 47.04 feet to land now or formerly of William W. Shriever;
THENCE along land of Shriever, South 26 degrees 09 minutes 00 seconds West 91.54 feet to land now or
formerly of Joseph L. Magrino, Jr.
THENCE along said land of Magrino the following three (3) courses and distances: (1) North 72 degrees 48
minutes 30 seconds West 85.58 feet; (2) South 22 degrees 34 minutes 40 seconds West 16.16 feet; and (3)
North 76 degrees 07 minutes 30 seconds West 92.36 feet to the easterly side of Village Lane;
THENCE along the easterly side of Village Lane North 26 degrees 09 minutes 00 seconds East 71.10 feet to
the point and place of BEGINNING.
BEING AND INTENDED TO BE THE same premises conveyed to Clyde Wachsberger, now deceased,
by deed dated March 14, 1983 which deed was recorded in the Office of the Clerk of the County of
Suffolk on March 17, 1983 in Liber 9328 at page 267.
TOGETHER with ail right, title and interest, if any, of the party of the first part in and to any streets and
roads abutting the above described premises to the center lines thereof, TOGETHER with the
appurtenances, and also all the estate which the said decedent had at the time of the decedent's death in said
premises, and also the estate therein, which the party of the first part has or has power to convey or dispose
of, whether individual, or otherwise;
TO HAVE AND TO HOLD the premises herein granted unto the party of the second part, the heirs or
successors and assigns of the party of the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered anything
whereby the said premises have been incumbered in any way whatever, except as aforesaid.
AND THE party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of
the first part will receive the consideration for this conveyance and will hold the right to receive such
consideration as a trust fund to be applied first for the purpose of paying the cost of the improvement, and
will apply the same first to the payment of the cost of the improvement before using any part of the total of
the same for any other purpose. The word "party" shall be construed as if it read "parties" whenever the
sense of this indenture so requires.
IN WITNESS WHEREOF, the party of the first part has duly executed this deed the day and year first
above written.
