Duryea Jr. State Office Building, 250 Veterans Memorial Highway, Hauppauge, New York, on February 21, 2013 and upon all other papers in this matter, the Board makes the following determination: NATURE OF GRIEVANCE AND RELIEF SOUGHT The petition pertains to an addition and alterations to an existing industrial building of a mixed B business and F-1 factory occupancy, two stories in height of Type liB, noncombustible construction, approximately 16,489 square feet in gross area, located at 8595 Cox Lane, Cutchogue, Town of Southold, County of Suffolk, State of New York. The petitioner is seeking relief from: ~19 NYCRR 1221, The 2010 Building Code of New York State, Section 1104.4, which requires that a least one accessible route shall connect each accessible level, including mezzanines, in multilevel buildings and facilities. [The petitioner requests relief to allow approximately 4,464 square feet of a combination of second story and mezzanines to not have an accessible route.] FINDINGS OF FACT The building that is the subject of this petition is properly classified as a mixed B and F-1 occupancy of Type liB construction and two stories in height. Five of the tenants in the building have mezzanines that to approximately 1,141 square feet. One tenant has a second story of approximately 3,232 square feet although, up until this time, an area was sealed off so that the square footage for the second story was under 3,000 square feet. Exception 1 of Section 1104.4 in the Building Code of New York State, 2010, states, in part, that an '¢¢¢vW.DOS.NY.GOV E-MAIL: INFO~DOS,NY,GOV Petition No. 2012-0544 Page 2 accessible route is not required to stories and mezzanines above and below accessible levels that have an aggregate area of not more than 3,000 square fe~ h~ this case, the~e is an ag.oregate area cf 4.464 square feet above the accessible level, which represents an approximately 49 percent deviation from the r:'~axirnu m 3,000 square feet permitted 4. The petitioner has pointed out that with the exception of the two-story area, the other tenant spaces with mezzanines would be compliant. 5. The petitioner has listed in the petition that the additional second story and mezzanine square footage over the 3,000 square feet permitted would entail a change so slight as to produce a negligible additional benefit consonant with the purpose of the Code. 6. The petitioner has stated that the estimated cost to install a lift is $45,000, which is 25 percent of the total cost of the alteration. CONCLUSIONS OF LAW Strict compliance with the provisions of the Uniform Fire Prevention and Building Code would entail practical difficulty or. unnecessary hardship, and would create an excessive and unreasonable economic burden, and would entail a change so slight as to produce a negligible additiOnal benefit consonant with the purpose of the Code, and the granting of this variance will not substantially adversely affect the Uniform Code's provision for heal[h, safety and security. DETERMINATION WHEREFORE IT IS DETERMINED that the application for a variance from 19 NYCRR 1221, The Building Code of New York State, Section 1104.4, be, and is hereby PROPOSED TO BE GRANTED with the following conditions: 1. That the second story and mezzanine shall not be further expanded. 2. That any tenants of the second floor shall have access to a usable office space, and toilet room accessible on the first floor. 3. That the toilet rooms on the second floor shall be made adaptable, as per 1109.2, exception 1 of the 2010 Building Code of New York State. 4. Part Section -- MR. SMITH: in there. MR. requires The petitioner is seeking relief from 19NYCRR, 1221 of the Building Code of New York State, 2010. I'm sorry, I didn't put that MAGEE: 2010 version, Section 1104.4, which that at least one accessible route shall connect each accessible level, including mezzanines, in multilevel buildings and facilities. The petitioner requests relief to allow approximately 4,464 square feet of a combination of second story and mezzanines to not have an accessible route. Please state your name and present your case. MR. SENDLEWSKI: My name is Martin Sendlewski, 215 Roanoke Avenue, Riverhead. I'm the architect for the current owner of this particular facility. The owner had purchased the building in 2012. Prior to MODERN SHORTHAND REPORTING AGENCY (631) 421-1602 5 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 the purchase in 2012, the previous owner had to obtain a C.O. for the building. I'm not sure of the date of the original construction of the facility. However, there was no C.O. for the facility, which was required to be obtained prior to the closing. The previous owner had retained an engineering group who had provided documentation to the local building official for occupancy and C.O.'s for the facility. Based on the review of the local building official, a permit was issued in 2011, September, 2011, based on the plans submitted with some notations and modifications. After some improvements, which I believe had to do with some fire separations and a few other issues within the building, a C.O. was issued in February, 2012. One of the conditions of the permit and C.O. was that there was a second floor area which was built within the shell of the building. It's a prefab industrial building. When that second floor area was constructed, it exceeded 3,000 square feet and does not have handicapped accessibility. One of the requirements of the local building official was that the owner basically block off and create a dead space, approximately 300 square feet, to MODERN SHORTHAND REPORTING AGENCY (631) 421-1602 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 allow the building to comply without an elevator, which they did do. I have a copy of the C.O. and permit approved sketches of the Town, if you would like me to produce those to you also. [HANDING] Subsequent to the purchase of the facility, we were hired by the current owner to do some improvements to the facility, basically a renovation of the second floor office area in question. He, not understanding the Code, had looked at the facility and was wondering why this area of about 300 square feet was blocked off, and not accessible. We explained to him what the situation was, and submitted a revision set of documents for revision of the second floor, which also included that same requirement where the area was blocked off, and a permit was issued by the Town of Southold for the revisions. That work has been completed. We have the area blocked off. The owner asked if there was any alternatives to having a small area within an existing office not accessible, and I said that the area alternative that we had was to come before the Board of Review, and that is what brings us here today. When I looked at the paperwork, we had a chance of 361 square feet, which was the area that the second floor office is over the requirement to remain without MODERN SHORTHA/qD REPORTING AGENCY (631) 421-1602 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 an elevator. It was pointed out at that time that the aggregate area of mezzanines, which are in other separate locations, may apply to that number. I'm not really sure if this does or doesn't because they're in separate areas. That being the case, we noted 1,141 square foot as the relief that we are looking for. If you looked at your Attachment A, which is the existing plan to the facility prior to our doing the work, the green and pink area is the area in question, the pink area being the unaccessible area, and the blue areas are the additional mezzanines which are separate individual tenant locations within the facility. That basically is really the total content of our appeal at this time. MR. MAGEE: I'll mark this as Exhibit 1, a copy of the C.O. from the Building Department, which is from the Town of Southold. [WHEREUPON COPY OF C.O. WAS MARKED EXHIBIT 1 IN EVIDENCE.] MR. SENDLEWSKI: documents. These are not set I had gotten from the clearer than those. MR. He's occupying a large portion of it, and he has two small additional tenant areas, which are small for leased offices. MR. HAIMES: On the second floor? MR. SENDLEWSKI: Correct. MR. HAIMES: That would be this area? [INDICATING] MR. SENDLEWSKI: That would be the green -- well, actually, his tenancy is located within the outlying of the green area, the whole thing. also. MR. SMITH: MR. SENDLEWSKI: MR. HAIMES: one area. He has portions of the first floor, Correct. But a separate tenant would be this MR. SENDLEWSKI: Actually, separate tenants would be on the top of the sheet here. If you look right here in the middle of the top, it says "Tenant area B." That would be the one small tenant area. Above the area would be the owner's space, and included within that green area is actually one bathroom, which is accessible from the location in the lobby, and he has a bathroom within his own space. MR. MAGEE: pink dead space? MR. SENDLEWSKI: Are you proposing to take away the Take away that wall and allow that to remain an unoccupied office without accessibility. MR. MAGEE: Blocking it off doesn't help, anyway. MR. SMITH: He's a separate tenant. MR. MAGEE: What type of business is that? MR. SENDLEWSKI: The owner of the facility, he does have a couple of occupancies in the industrial area. One is a potato chip factory, and his office -- what he's looking to do, he occupies this office for himself. He lives in Cutchogue, has another office in Riverhead. This building is part of a larger parcel that he's going to subdivide. He has a concept. It's called farm to factory to family. What he's looking to do is encourage his tenants to have properties that he can expand on, so that he's going to subdivide and allow them to purchase. SENDLEWSKI: There is a facility, up the stair from the lobby, there is a facility off of that existing upper lobby. That is the bathroom that the two additional tenants would have use of. MR. PETERSON: The existing upper lobby? MR. SENDLEWSKI: Correct. There is a bathroom off the existing upper lobby, and he also has a bathroom for his facility, and if need be, he can access the other toilet from the lobby. The lower level has their own. MR. I think that the owner would -- at this point, he would look into that as an option. If not, prior to that, he would close off the area and get that signed off by the Town to obtain the C.O. for the alteration. They have space on the floor that is unoccupied. MR. SMITH: It's part of the same facility? MR. SENDLEWSKI: Yes. Basically, this area here, that is the lower lobby, and the stair going up, directly below that location. MR. MAGEE: We have that MR. SENDLEWSKI: Correct. and the office area is already. That is the plan on Attachment A. One requirement that we could look at is what they have down is they do have a lower foyer area. From that foyer area, you come into a small alcove where that first lower office is. If we wanted to, we would make that lower fire area an exclusive area that allows us -- or actually, from the first floor, we could provide access to the lower level toilet from the foyer, if need be. MR. SMITH: Can't you get to that, anyway? MR. SENDLEWSKI: You can get to that regardless. He basically has that first floor space open at this point. He's remaining the occupancy open at this point himself. MR. SMITH: Keep in mind, you can have a totally separate business office on the second floor. If that was less than 3,000 square feet, that would not need to be accessible. With respect to the petition of Marvin Sendlewski, Petition Number 2012-0544, the petition pertains to an addition and alterations to an existing industrial building of a mixed B business and F-1 factory occupancy, two stories in height, of Type 2B, noncombustible construction, approximately 16,489 square feet in gross area, located at 8595 Cox Lane, Cutchogue, Town of Southold, of New York. The petitioner is seeking relief, variance with respect to 19NYCRR, Part Building Code of New York State, 2010, County of Suffolk, State requesting a 1221 of the Section 1104.4, which requires that at least one accessible route shall connect each accessible level, including mezzanines, in multilevel buildings and facilities. The Board makes the following findings: 1. The building that is the subject of this petition is properly classified as a mixed B and F-1 occupancy of Type 2B construction and two stories in height. 2. mezzanines feet. In this case, there is an aggregate area of 4,464 square feet above the accessible level, which represents an approximately 49 percent deviation from the maximum 3,000 square feet permitted. 4. The petitioner has pointed out that with the exception of the two-story area, the other tenant spaces with mezzanines would be compliant. 5. The petitioner has listed in the petition that the additional second story and mezzanine square footage over the 3,000 square feet permitted would entail a change so slight as to produce a negligible additional benefit Code. cost consonant with the purpose of the 6. Wherefore, it is determined that the application for a variance from the provisions of 19NYCRR, Part 1221 of the 2010 Building Code of New York State, Section 1104.4, be and is hereby proposed to be granted with the following conditions: 1. That the second story and mezzanine shall not be further expanded. 2. That any tenants of the second floor shall have access to a usable office space, and toilet room accessible on the first floor. 3. That the toilet rooms on the second floor shall be made adaptable, as per 1109.2, Exception 1 of the 2010 Building Code of New York State. 4.
