MINUTES
SOUTHOLD TOWN PLANNING BOARD
May 21, 1963
A regular meeting of the Southold Town Planning Board was
held 7:00 P.M., Tuesday,.May~.21, 1963 at the Town Office, Main
Road, Southold, New York.
There were present: Messrs. John Wickham~ Chairman, Alfred
Grebe, Henry. Moisa, Archibald Young~ and William Unkelbach.
Also present: Messrs. Otto W. Van Tuyl, Consultant and
Howard Terry~ Building Inspector.
PUBLIC ~.~.T.~G: The public hearing upon the application of
Ernest and Harold Wilsberg for approval of a subdivision plat to
be known as "West-Creek-~Estabes: was reopened.
The minutes of the hearing held May 7, 1963 were read.

MR. VAN TUYL: Yes~ and the stamp of the Health Department is
on the cloth prints you have before you.
THE CHAIRMAN: We also have the letter from the Highway
Superintendent stating thathe has inspected the roads at "West
Creek~Estates", Bayview, and found them suitable as to layout and
reasonable access.
Since the Board found everything in order, on motion of Mr~
Grebe, seconded by Mr. Moisa~ it was
RESOLVED: W1EEREAS Ernest and Harold Wilsberg have petitioned
the Southold Town Planning Board for final approval of their plat
known as "West Creek Estates", at Main Bayview Road, $ou thold, New
York; and
WHEREAS, the Superintendent of Highways of the Town of Southold
has inspected the map and propertyand approves the highway layout
and his report is hereby approved by the Planning Board; and
WHEREAS, the SDuthold Town Planning Board, pursuant to due
notice thereof, held a public hearing on the matter of approval of
the plat at which time all intereste~ persons were given an
opportunity to be heard; and
WHEREAS, the Southold Town Planning .Board waives the provisions
in the rules and regulations for the subdivision of land requiring
park and playground or cash equivalent; and
WR~REAS, the highways in this subdivision will not be dedicated
to the Town of~SoUthold at this time, the highways must meet the
specifications of'~he Highway superintendent when they.are offered
for dedication~ and the requirement for a performance bond is waived;
NOW~TPIEREFORE BE IT RESOLVED that the subdivision to be known as
"West Creek Estates" at Main Bayview Road, Southold~ New York, con-
sisting of 33.2 acres and owned by Ernest and Harotd Wilsberg be
approved.
This plat is bounded and described as follOws:Beginning at a
monument on the ea~rty line of Main Bayview'Road at the southwesterly
corner of land of-Polywoda; running thence along said land of Polywoda
two courses as follows: (1) S. 69° 19' 10" E. 200~0feet to a monument;

thence (2) N. 26° 06' 30" E. 421.66 feet to land of Dart; thence
along said land of Dart, three courses as follows: (1) S. 72°
59' 30" E. 590.23 feet to a monument; thence (2) So 75° 09' 30"
E. 727.64 feet; thence (3) N. 14° 54' 00" E. 55.86 feet; thence
along land of Wilsberg, N. 74° 00' 00" Eo 386.83 feet; thence along
otherland of said Dart Cwo courses as follows: (1) S. 71° 42' 20"
E. 345.95 feet to a monument; thence (2) S. 26° 17' 40" E. 415.97
feet to the ordinary high water line of West Creek; thence in a
general southwesterly direction along said ordinary'~high water mark
about 1500 feet to the center of a gutter; thence along land of an
unknown owner and the center of said gutter, S. 78° 05' 40" W. about
330 feet; thence along lands of McAslan, Frederickson, Foster and
Hanff~ N. 62° 45' 40" W. 775 feet more or less; thence along land
of said Hanff two courses as follows: (1) S. 18° 3~' 0.0" W. 165.00
feet to a monument; thence (2) N. 65° 29' 00"'W. 228.63 feet to a
monument on said easterly line of Main Bayview Road; thence along
said easterly line, N. 26° 06' 30" E. 407.49 feet to the p~int of
beginning.

Mr. Van Tuyl brought before the Board the preliminary map of
Stars Manor. He explained that Mr. Stars had installed six drainage
basins sometime ago and the location of the basins was approved in
writing by Highway Superintendent Price. On the preliminary maG
Mr. Van Tuyl had shown two drainage areas also. Further, Mr. Stars
wants to leave a small strip of land for himself at the entranc~ of
the property from the Main Road.
After considerable discussion, on Mo~ion of~Mr. Grebe, seconded
by Mr. Young, it was
RESOLVED that the Boarddoes not recommend any change of the
map as to the location of~the drainage areas or change of the location
of the lines of the subdiviaion at the entrance at the~Main~Road.
Vote of the Board: Ayes:- Mr. Wickham, Mr. Moisa, Mr. Grebe,
Mr. Youngl and Mr. Unkelbach.
The Board received a copy of a letter from'R. W. Gillispie,
Jr., Chairman of the Board of Appeals to S~pervisor Albertson
recommending that a survey be required in connection with building
permit applications.

The matter of the application for a change of zone from
"A" Residential and Agricultural District to "B" Business District
by JoSeph Riccardo and Jack Driscoll on property at Mattituck was
tabled to the next meeting of the Planning Board on June 11, 1963.
On motion of Mr. Unkelbach~ seconded by Mr. Grebe~ it was
RESOLVED that the minutes of the meeting of May 7, 1963 be approved
as submitted.
Vote of the Board: Ayes:- Mr. Wickham~ Mr. Moisa, Mr. Grebe,
Mr. Young, and Mr. Unkelbach.
The next meeting of the Southold Town Planning Board will be
held 7:30 P.M., Tuesday~ June 11, 1963 at the Town Office, Main
Road, Scuthold, New York.
The Board again considered the application of A. John Gada
and Margaret J. Gada for a change of zone from."A" Residentialand
Agricultural District to "B" Business District on property on Fishers
Island. T~is matter was presented to the Board on May 7th and the
recommendation was held over rD thiS date. Mr. Young and Mr. Moisa
with Mr. Terry and Mr. Grebe visited the property~on Fishers Island
on May t3th and made their'report. The Board has received sevdral
letters from adjoining property owners in opposition to this change
of z~ e. Letters were received from: Albert D.~ Dawson, Gordon S.
Murphy, Serge J. Doyen~ Jr.~ Mrs. Katherine Paquet and H.~Lee
Ferguson, Jr. AlsO many of the property owners in the area have
indicated .their opposition verbally to the Board members.
Mr. Mo!sa and:Mr. Young reported that the property abutts the
business prQper%y of ~the Pequ0t House andlit is so narrow it is
almost useless at~e place where it is adjacent. Also, Mr. Gada
indicates that this is a hardShip and he is unable to rent these
properties for summer occuPancy~ but the~'members after investigation
found that the property is unrentable because adjoining property is
maintained by Mr. Gada as a dumping ground for his contracting
equipment and materials. Investigation also~ revealed that the las~
tenants on property underconsideration were outspoken about the
nuisance value of the applicants non-conforming pr!operty.

The Planning Board is not willing to recommend the change of
zone in this case for the following reasons: First, the other
property of the petitioner is non-conforming but nevertheless is
"A" Residential District and if this property were to be zoned "B"
Business it would intrude in residential areas as per letters of
protest on file with this office. This property in question does
Rbut the "B" Business zone of the Pequot House but is sonarrow as
to be almost useless at the place, where it is adjacent.
In the second place, Mr. Gada bases his request for change of
zone on the hardship involved in his being ~nabte to rent these
properties for summer occupancy, upon inve.stigation this Boardhas
found that the reason they are unrentable is because the petitioner
maintainshis non-conforming propezty as a depot or dumping ground
for contracting equipment and materials, and in our file are photographs
taken by our investigating team on May 13th showing this condition.
Inasmuch as this condition is self-imposed or at least can be
rectified.by petitioner if he so desires, we fe~l that a change of
zone would not be necessary.

In interviewing real estate agents on Fishers Island our
investigating team discovered that the lasttenants on property
covered by this petition were quite outspoken about thenuisance
value of petit~ hers non-conforming property.
The contents of our file on this are available to the Town
Board at any time.
